INTERPRETATION; PENALTIES, VALIDITY AND CODIFICATION
10-18-1: INTERPRETATION:
In their interpretation and application, the provisions of this title shall be held to be minimum requirements, adopted for the promotion of the public health, morals, safety, and general welfare. It is not intended for this title to repeal, abrogate, annul or in any way impair or interfere with private agreement, or with restrictive covenants running with the land. Where this title imposes a greater restriction upon provisions of law, ordinance, contract or deed, the provisions of this title shall control. Wherever the requirements of this chapter are at variance with the requirements of any other lawfully adopted rules, regulations, or ordinances, the most restrictive, or that imposing the higher standards shall govern. 10-18-2: PENALTY:
(A) Any person who violates, disobeys, omits, neglects, or refuses to comply with or who resists the enforcement of any of the provisions of this title shall be fined not less than five dollars ($5.00) nor more than fifty dollars ($50.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense.
(B) In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted, or maintained, or any building, structure or land is used in violation of this title, the proper authorities of the city council, in addition to other remedies, may institute any appropriate action or proceedings to prevent such unlawful erection, maintenance, or use; to restrain, correct, or abate such violation; to prevent the occupancy of said building, structure, or land; or to prevent any illegal act, conduct, business, or use in or about such premises. 10-18-3: ENFORCEMENT:
Notwithstanding any provision herein, the enforcement of said provisions may be in any manner cognizant with the law. (Ord. 567, 11-1976)
10-18-4: VALIDITY:
Should any article, section, clause or provision of this chapter be declared by court to be invalid, the same shall not affect the validity of this chapter as a whole or any part thereof other than the part so declared to be invalid. (Ord. 567, 11-1976)
10-18-5: CODIFICATION:
As of the date of council adoption, this ordinance shall be made a part of the codified Canton municipal code as title 10 thereof. (Ord. 567, 11-1976)
