CHAPTER 6

RESIDENTIAL DISTRICTS

11-6A-1: PURPOSE:

The major purpose of this district is to allow the continuation of existing residential development and infilling of existing lots in the older residential areas of the City and also new dwelling units in the developing areas of the City. (1998 Code)

11-6A-2: PERMITTED USES:

Essential services including necessary equipment and structures.
Food Trucks.
Historic sites.
Permitted home occupations.
Public recreation including parks and playgrounds.
Signs subject to standards in chapter 14 of this title.
Single-family residential structures.
Solar and earth-sheltered residential structures.
Sport Courts not exceeding one-hundred twenty (120) square feet.

11-6A-3: ACCESSORY USES:

Any incidental structures or buildings necessary to the conduct of a permitted use, including private garages, carports, screen houses, swimming pools, storage buildings for use of occupants of the principal structures and television towers and satellite dishes when erected in the rear yard. 11-6A-4: CONDITIONAL USES:

Bed and breakfasts.
Child daycare facilities.
Condominiums.
Golf courses.
Home occupations.
Hospitals.
Nursing home/care center.
Planned unit developments (PUDs).
Private garages on existing lots fifty feet (50') in width or less which contain no principal structure.
Public office buildings.
Public swimming pools.
Religious facilities.
Schools (public and private).
Sport Courts exceeding one-hundred twenty (120) square feet.
Townhouses.
Other uses determined by the Zoning Administrator or Planning Commission to be of the same general character as the permitted and conditional uses designated in this article and found not to be detrimental to existing uses and the general public's health, safety or welfare. 11-6A-5: PERFORMANCE STANDARDS:

   A.   Height Regulations: The maximum height of all buildings shall not exceed forty five feet (45').
   B.   Front Yard Regulations:
      1.   Minimum Required: There shall be a front yard of not less than twenty five feet (25').
      2.   Double Frontage Lot: Where a lot is located at the intersection of two (2) or more roads or highways there shall be a front yard setback on each road or highway side of the corner lot.
      3.   Uniform Setback: Where a uniform front yard setback on a street between intersections exists that is less than twenty five feet (25'), any building or structure hereafter erected, structurally altered or enlarged must conform to the established setback, but in no case shall a setback of less than fifteen feet (15') be allowed.
      4.   No Uniform Setback: Where a uniform front yard setback on a street between intersections does not exist, the minimum required setback shall be the average of the setback of the two (2) adjacent principal buildings; but in no case shall a setback of less than fifteen feet (15') be allowed.
   C.   Side Yard Regulations:
      1.   Minimum Required: There shall be a minimum side yard of not less than ten feet (10') for principal structures and attached accessory structures.
      2.   Substandard Lot: The minimum side yard for existing substandard lots less than one hundred feet (100') in width shall be not less than ten percent (10%) of the lot width.
      3.   Detached Accessory Structure: There shall be a minimum side yard of not less than three feet (3') for detached accessory structures located in the rear yard.
   D.   Rear Yard Regulations: There shall be a rear yard of not less than twenty feet (20') for principal buildings including attached accessory buildings and three feet (3') for detached accessory buildings.
   E.   Lot Area And Density:
      1.   The minimum lot area shall be twelve thousand (12,000) square feet.
      2.   The minimum lot area for twin homes, condominiums and townhomes shall be seven thousand eight hundred (7,800) square feet per unit.
      3.   The maximum density shall be five (5) units per acre.
   F.   Lot Width And Depth Regulations: Minimum lot width shall be one hundred feet (100'). Minimum lot depth shall be one hundred twenty feet (120').
   G.   General Regulations: Additional requirements for parking, signs, sewage systems and other regulations are set forth in chapters 13 and 14 of this title.
   H.   Yard/Green Space: The Yard/Green Space shall be landscaped except vegetation areas left in a natural state during initial construction may remain if properly maintained. The Yard/Green Space shall occupy not less than twenty-five percent (25%) of the exposed ground area of the lot. The Yard/Green Space shall include not less than fifty percent (50%) live materials (vegetation) with the balance being permeable landscaping decorative materials such as landscape rock or mulch. The Yard/Green Space may include a sport court for which a conditional use permit has been obtained.
   I.   Sport Court: Sport Courts may not be constructed on right of way , easements or within setbacks without a variance. (1998 Code; amd. Ord. 970, 4-18-2022)

   F.   Lot Width And Depth Regulations: Minimum lot width shall be eighty feet (80'); minimum lot depth shall be one hundred twenty feet (120').
