CHAPTER 7

BUSINESS DISTRICTS

11-7A-1: PURPOSE:

The purpose of this district is to encourage the continuation of a viable business area by allowing retail, service, office and entertainment facilities as well as public and semi-public uses. In addition, residential uses will be allowed as a conditional use. (1998 Code)

11-7A-2: PERMITTED USES:

Business establishments offering merchandise or services to the general public in return for compensation. Such establishments to include but not be limited to the following:
Art gallery.
Auto-related retail and service use located inside a building.
Automobile parking lot, parking garage, bus and transportation station.
Bakery.
Barber/beauty shop.
Bowling alley.
Business and professional office.
Camera and photographic supplies and studio.
Child daycare facility.
Convenience store.
Drug store.
Dry-cleaning.
Essential services.
Financial institution.
Fitness center and dance studio.
Florist shop.
Food trucks.
Funeral home.
Furniture store.
Grocery, fruit or vegetable store, but not including sales from moveable, motorized vehicles.
Hardware and enclosed building materials sales.
Hospital with medical center.
Laundromat.
Licensed daycare, group family daycare, and residential facilities.
Locksmith.
Meat market, but not including slaughtering facilities.
Motel and hotel.
Newspaper publishing.
Restaurant/delicatessen.
Retail sales and service.
Shoe repair.
Tavern, off-sale liquor, private club and lodge.

11-7A-3: ACCESSORY USES:

Uses incidental to the principal uses such as off-street parking, loading and unloading areas, storage buildings, fencing and signage. (1998 Code)

11-7A-4: CONDITIONAL USES:

Animal clinics or hospitals.
Bed and breakfast.
Car washes (drive through, mechanical and self-service).
Commercial communication towers.
Custom or limited manufacturing, compounding, assembly or treatment of articles or merchandise from previously prepared materials.
Drive-ins and convenience food establishments.
Governmental and public utility buildings and structures necessary for the health, safety and general welfare of the community.
Open or outdoor service, sales and rental as a principal or accessory use including motor vehicle and recreational equipment sales.
Public or semi-public recreational buildings or uses and neighborhood or community centers; public and private educational institutions; religious institutions; and governmental and public buildings and structures.
Service stations, auto repair and auto body repair.
Single- and multiple-family dwellings.
Other uses determined by the Zoning Administrator or Planning Commission to be of the same general character as the permitted uses designated in this article and found not to be detrimental to existing uses and the general public's health, safety or welfare. (Ord. 953, 7-15-2019)

11-7A-5: PERFORMANCE STANDARDS:

   A.   Height Regulations: The maximum height of any building shall be forty five feet (45').
   B.   Front Yard Regulations: There shall be a front yard setback having a depth of not less than ten feet (10') except in a block where two (2) or more structures have been built facing the same street, the setback for the remaining lots in that block fronting on the same street shall be determined by the average setback of existing buildings.
   C.   Side Yard Regulations: There shall be no minimum side yard requirements except that no building shall be located within ten feet (10') of any side lot line abutting a lot in any Residential District not buffered by a street or alleyway.
   D.   Rear Yard Regulations: There shall be no minimum rear yard requirements except that no building shall be located within ten feet (10') of any rear lot line abutting a lot in any Residential District not buffered by a street or alleyway.
   E.   Lot Area Restrictions: None.
   F.   Screening And Fencing: Screening or fencing of commercial uses must be considered during a site plan review and may be required on side and rear yards which face Residential Districts.
   G.   General Regulations: Requirements for signs, parking and other regulations are set forth in chapters 13 and 14 of this title. (1998 Code)

11-7B-1: PURPOSE:

This district is established to accommodate the type of businesses that are oriented to the traveling public and require highway access. A B-2 District shall typically be located adjacent to existing or proposed County State aid and State trunk highways or Municipal State aid streets. Multi-family residential uses will be allowed to locate within the commercial establishment area as a conditional use. (1998 Code)

11-7B-2: PERMITTED USES:

Auto sales and service.
Barber/beauty shops.
Business and professional offices.
Cannabis retail.
Child daycare facilities.
Commercial recreational and entertainment facilities when contained within a building.
Convenience stores.
Essential services.
Farm implement sales and service.
Financial institutions.
Food trucks.
Grocery store.
Hotels and motels.
Laundromat/dry cleaning.
Nursery and landscape supplies.
Photography studios.
Recreation vehicles and equipment sales and service.
Restaurants.
Retail sales and service uses.

11-7B-3: ACCESSORY USES:

The same accessory uses as permitted in the B-1 District and including outdoor garden centers and sidewalk cafes in conjunction with a freestanding restaurant. (1998 Code)

11-7B-4: CONDITIONAL USES:

Adult entertainment.
Animal hospitals or clinics.
Bed and breakfasts.
Building material sales.
Car wash operation.
Commercial communication towers.
Light manufacturing.
Manufactured home sales.
Mini-storage.
Multiple dwellings when integrated into multiuse structures.
Off sale liquor.
Outdoor display, sales or storage conducted on an accessory use to a permitted or conditional HB use.
Private clubs and lodges not operated for a profit.
Rental shop.
Seasonal produce stands.
Service stations, auto or truck repair and auto body repair.
Small engine and appliance repair.
Other uses determined by the Zoning Administrator or Planning Commission to be of the same general character as the permitted and conditional uses designated in this article and found not to be detrimental to existing uses and the general public's health, safety or welfare. (Ord. 953, 7-15-2019)

11-7B-5: PERFORMANCE STANDARDS:

   A.   Height Regulations: The maximum height of all buildings shall not exceed two and one-half (21/2) stories or thirty five feet (35'). (1998 Code)
   B.   Front Yard Regulations: There shall be a front yard of not less than twenty five feet (25'), provided, however, on lots bordering heavily traveled State highways, the front yard setback shall be one hundred ten feet (110'), unless already served by a frontage road. For purposes of this section, heavily traveled State highways shall mean:
      1.   State Highway 7 east from Benson Road to the City limits;
      2.   State Highway 29 north from County Road 41/Wolfe Avenue to the City limits;
      3.   State Highway 59 northwest from Pioneer Drive/Highway 7 to the City limits;
      4.   Highways 59/212 west from Gravel Road/Minnesota River Bridge to the City limits;
      5.   Highway 212 southeast from Gravel Road to the City limits. (Ord. 835, 2-18-2003)
   C.   Side Yard Regulations: There shall be a minimum side yard of not less than ten feet (10').
   D.   Rear Yard Regulations: There shall be a minimum rear yard of not less than twenty feet (20').
   E.   Lot Area: The minimum lot area shall be fifteen thousand (15,000) square feet.
   F.   Screening And Fencing: Screening and fencing must be considered during a site plan review and may be required along any lot line adjacent to a Residential District.
   G.   General Standards: Other standards and regulations related to parking, signs, etc., are set forth in chapters 13 and 14 of this title.
   H.   Cannabis Retail:
      1.   Cannabis Retail businesses shall be located a minimum distance of five hundred feet (500') from any school, church, daycare (home or center) or park that is regularly used by minors, including a playground or athletic build.
      2.   A Cannabis Retail business may not sell cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products between nine o’clock (9:00) p.m. and ten o’clock (10:00) a.m. the following day.

11-7C-1: PURPOSE:

The purpose of this district is to encourage the continuation of viable medical institutions and businesses and encourage the expansion and creation of other medically related offices, businesses and institutions. In addition, related residential uses will be allowed. (Ord. 840, 9-22-2003)

11-7C-2: PERMITTED USES:

Institutional, public, commercial, and business establishments offering medical services or products to the general public or the medical community. Such establishments to include, but not be limited to, the following:
Child daycare facilities.
Essential services.
Food trucks.
Hospitals.
Medical business and medical professional offices.
Medical centers.
Medical clinics.
Medical retail sales or service.
Nursing homes.
Pharmacies.
Residential hospice facility.

Custom or limited manufacturing, compounding, assembly, or treatment of articles or merchandise, devices and pharmaceuticals of a medical nature.
Detoxification or psychiatric facilities.
Governmental and public utility buildings and structures necessary for the health, safety, and general welfare of the community.
Heliport.
Multiple dwellings when integrated into medically related multiuse structures.
Public or semipublic recreational buildings, parks or uses; and governmental and public buildings and structures.
Research laboratories.
Other uses determined by the Zoning Administrator or Planning Commission to be of the same general character as the permitted and conditional uses designated in this article and found not to be detrimental to existing uses and the general public's health, safety or welfare. (Ord. 953, 7-15-2019)
