HOME OCCUPATIONS
Home occupations are permitted in any dwelling unit subject to the limitations established herein. It is the intent of this article to ensure the compatibility of home occupations with other permitted uses, to preserve the character or residential neighborhoods, and to prevent noise, traffic, nuisance, and safety hazards and other potential adverse impacts of commercial uses conducted in residential areas.

Any person desiring to establish a home occupation, as authorized herein, shall submit a home occupation permit application to the zoning administrator on a form provided by the town. The zoning administrator shall review the application for compliance with this article and other applicable provisions of law and shall make a decision to approve or disapprove the application within thirty (30) days of the date an application is received.
(1)
Duration. All home occupation permits shall remain valid unless the use is determined to be in violation of this article.
(2)
Violation. The zoning administrator upon becoming aware of any violation of the article or the conditions of the permit shall serve a notice of violation to the operator of the home occupation. Upon receipt of such notice the operator of such activity will have ten (10) days to correct the violation.
(3)
Revocation of permit. Following the ten-day period, the zoning administrator may revoke a home occupation permit for violation of this article. Notice of revocation shall be given to the operator of the home occupation, by hand-delivery or certified mail, setting forth the reasons for revocation, the date and time upon which the revocation is effective and the appeal procedure. This provision shall not preclude the use of any other remedy prescribed by law with respect to violations of the provisions of the zoning ordinance.

Appeal. Any person aggrieved of an action of the zoning administrator in granting, denying or revoking a home occupation permit may appeal the decision to the joint board of zoning appeals.

In addition to the regulations applicable in the zoning district, all home occupations shall be subject to the following:
(1)
The use of the dwelling unit for a home occupation shall be clearly incidental and subordinate to its use for residential purposes by its occupants. The use shall, under no circumstances, change the residential character of the dwelling.
(2)
The home occupation shall be a secondary use of the dwelling. All business activity shall be conducted wholly within the building.
(3)
Only individuals residing on the premises shall be engaged in the occupation.
(4)
No sign shall be permitted.
(5)
There shall be no outdoor display of goods or outside storage of equipment of materials used in such home occupation.
(6)
No equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes, odors or electrical interference detectable to the normal senses off the lot.
(7)
No additional parking spaces shall be added to the premises.
(8)
The home occupation permit is valid to the original applicant only and is not transferable.
(9)
The home occupation shall generate no additional traffic to the dwelling unit.
