CHAPTER 17

50 - SUPPLEMENTAL DEVELOPMENT

17.50.010 - Purpose.

It is the purpose of this chapter to establish development standards that supplement those established within the various use districts. These supplemental standards are intended to address certain unique situations that may cross district boundaries, and to implement related policies of the Darrington comprehensive plan.

17.50.020 - Height regulations around airports.

For the purposes of regulating heights within the vicinity of airports, there are established and created certain height limitation zones which include all the land lying within the instrument approach zones, noninstrument approach zones, transition zones, horizontal zones and conical zones. Such areas may be shown and defined on an airport height map which shall become a part of the ordinance codified in this section by adoption of the council and found on file in the office of the town clerk. No building or structure shall be erected, altered or maintained, nor shall any tree be allowed to grow to a height in excess of the height limit herein established in any of the several zones created by this section; provided. Where an area is covered by more than one height limitation zone, the more restrictive limitations shall prevail. Under the provision of this section, the town adopts the most current airport height map as amended.

17.50.030 - Yard regulations.

A.

Poles, ports, fences and other customary yard accessories, ornaments, and furniture may be permitted in any yard subject to height limitations and requirements limiting obstruction of visibility to the detriment of public safety. Additional restrictions may apply to ensure public safety. Fences, hedges, and free standing walls are subject to the following restrictions:

They may be constructed of any suitable material except barbed wire;

2.

They shall not be electrified;

3.

Fences, hedges and walls in side and rear yards may not exceed six feet in height and must step down to forty-two inches in height at the front setback line;

4.

Fences, hedges and walls in front yards may not exceed forty-two inches in height;

5.

On corner lots, for safety reasons, a fence, hedge or wall may not be constructed of any material or be built in any location or to any height that would obstruct vision of an intersecting street.

B.

In the case of through lots, unless the prevailing front yard pattern on adjoining lots indicates otherwise, front yards shall be provided on all frontages.

C.

Where the front yard that would normally be required on a lot is not in keeping with the prevailing yard pattern, the planning commission may waive the requirement for the normal front yard and substitute therefor a special yard requirement which shall not exceed the average of the yards provided on adjacent lots.

D.

In the case of corner lots, a front yard of the required depth shall be provided in accordance with the prevailing yard pattern, and a second front yard of half the depth required generally for front yards in the district shall be provided on the other frontage.

E.

In the case of corner lots with more than two frontages, the planning commission shall determine the front yard requirements, subject to the following conditions:

1.

At least one front yard shall be provided having the full depth required generally in the district;

2.

The second front yard shall be the minimum set forth in the district;

3.

In the case of through lots and corner lots, there will be no rear yards but only front and side yards;

4.

In the case of through lots, side yards shall extend from the rear lines of front yards required. In the case of corner lots, yards remaining after full and half-depth front yards have been established shall be considered side yards.

17.50.040 - Exemption of rooftop appurtenances.

The height limitations specified in this chapter shall not apply to church spires, monuments, chimneys, water towers, elevator towers, mechanical equipment, and other similar rooftop appurtenances usually required to be placed above the roof level and not intended for human occupancy or the provision of additional floor area; provided, that mechanical equipment rooms or attic spaces are set back at least ten feet from the edge of the roof and do not exceed twenty feet in height. Such mechanical apparatus shall be screened from pedestrian view.

17.50.050 - Maximum building length.

In the R-MD zone, the maximum building length shall be as follows:

For all buildings except as described below: R-MD: 50 ft.
Maximum building length with bonus for modulating off-sets:
For structures with a maximum building height of 2 stories or 25 ft., whichever is less, and having horizontal modulation or a minimum vertical change in roof profile of 4 feet at lease every two units or 50 feet, whichever is less:
R-MD 100 ft.
For structures with a building height over 2 stories or 25 ft., whichever is less, with a horizontal and vertical modulation of 4 ft. or an 8 ft. modulation in either direction: R-MD 100 ft.

 

Modulation shall be required for every two units or fifty feet; whichever is less, as measured along the building's length. Grouping of offsets in maximum four unit modules may be permitted only with BAR approval.

17.50.060 - Certain requirements waived.

Minimum parking requirements are waived for all indoor emergency shelters, transitional housing, indoor emergency housing and permanent supportive housing.

17.50.070 - Exemptions.

Exemptions to development regulations in the Darrington Municipal Code, including but not limited to setback requirements, density limits, restrictions on support spaces inside buildings (e.g., office space for tenants) and public noticing requirements, regarding indoor emergency shelters, transitional housing, emergency housing and permanent supportive housing may be permitted with administrative approval by the planning official and building official and fire marshall to address Darrington's housing needs allocation through shelter and housing forms that do not meet building codes or other requirements. These types may include but are not limited to pallet shelters and tiny shelters. Regardless of the form, the housing or shelter must be indoors and allow access to bathrooms and showers.

17.50.080 - Special provision for religious organizations.

Any affordable housing development, including permanent supportive housing and transitional housing with a lease, of any single-family or multifamily residence located on real property owned or controlled by a religious organization is allowed an increased density bonus consistent with local housing needs allocation with administrative approval by the planning official or building official or fire marshall.

17.50.090 - Temporary shelters and encampments on religious organization property.

Outdoor encampments, safe parking efforts, indoor overnight shelter and temporary small houses are permitted on property owned or controlled by a religious organization and must adhere to state regulations in RCW 35.21.915 and RCW 36.01.290.
