ARTICLE 13

C-2, Commercial 2 District

Sec. 16-13-10.- Permitted and conditional uses.

(a)

No building or land shall be used and no building shall be hereafter erected, converted or structurally altered unless otherwise provided herein, except for one (1) or more of the uses specified herein.

(b)

Permitted uses:

(1)

Retail sales.

(2)

Business and professional office.

(3)

Recreational and entertainment facility.

(4)

Service establishment.

(5)

Parking lot and parking garage as a principal use.

(6)

Workshops and custom small industry.

(7)

Community and religious assembly.

(8)

Eating establishment.

(9)

Pawnbroker.

(10)

Sexually oriented business.

(11)

Deferred deposit lender establishment.

(12)

Accessory building or use.

(13)

Custom industry.

(c)

Conditional uses:

(1)

Automobile service station.

(2)

Animal sales and service.

(3)

Hotel and motel.

(4)

Custom industry (with outdoor cultivation).

(5)

Workshops and custom small industry (with outdoor cultivation)

(6)

Custom food and beverage production and sale facility.

(7)

Indoor storage or warehousing of materials that is clearly incidental to and commonly associated with, and is subordinate in area, extent and purpose to, the principal commercial use of the building or land as permitted hereinabove. As used in this Paragraph, storage or warehousing means the act of depositing goods, ware or merchandise in any structure or part of a structure.

Sec. 16-13-20. - Height.

No building shall exceed forty (40) feet in height, except for those buildings located on Sheridan Boulevard, which shall not exceed forty-five (45) feet in height.

Sec. 16-13-30. - Area and minimum width of lot.

Area and minimum width of lot requirements shall be as follows: None.

Sec. 16-13-40. - Front yard.

The minimum depth of the front yard for a principal building shall be thirty (30) feet, except that buildings on Sheridan Boulevard, on 25th Avenue and on 20th Avenue from Sheridan Boulevard to Depew Street shall have no minimum front yard. The minimum depth of the front yard for an accessory buildings shall be thirty (30) feet.

Sec. 16-13-50. - Side yard.

(a)

No side yard is required, except on a corner lot.

(b)

On corner lots, the minimum side yard for principal buildings shall be thirty (30) feet, except that buildings on Sheridan Boulevard, on 25th Avenue and on 20th Avenue from Sheridan Boulevard to Depew Street shall have no minimum side yard.

On corner lots, the minimum side yard for accessory buildings shall be thirty (30) feet.

Sec. 16-13-60. - Rear yard.

The minimum depth of the rear yard shall be ten (10) feet, except where the rear abuts a public alley, then the minimum depth shall be fifteen (15) feet to the center of the alley, and except that, where the rear yard abuts a public street, the minimum rear yard shall be thirty (30) feet.

Sec. 16-13-70. - Lot coverage.

Maximum lot coverage is fifty (50) percent.
