Fences, Walls and Obstructions
The purpose and intent of this Article is to ensure that walls and fences are attractive and in character with the community and to improve public safety and welfare of persons using City sidewalks and streets by maintaining adequate visibility into and from private property and within public rights-of-way.

(a)
No fence, wall, planter or other structure shall be placed or erected, and no hedge, shrub, tree, plant or other growth or substance of any nature shall be placed, planted or maintained in any location upon any lot as to constitute a traffic hazard because of obstruction of view of any person upon, within or using streets, sidewalks or alleys.
(b)
Without limiting the generality of the foregoing, on corner lots, no fence, wall, planter or other structure shall be placed or erected that is taller in height than thirty-six (36) inches if located within one (1) or both of the following site distance triangles, measured from the street flow-line or alley pavement line:
(1)
At the intersection of two (2) streets, the required site distance triangle is twenty (20) feet.
(2)
At the intersection of a street and an alley, the required site distance triangle is ten (10) feet.

(a)
Fences and walls are hereby classified as follows:
(1)
Masonry or textured walls.
(2)
Ornamental iron.
(3)
Woven wire, excluding chicken wire.
(4)
Wood picket (more than fifty percent [50%] open).
(5)
Solid fences (wood or metal less than fifty percent [50%] open).
(6)
Hedges of natural plant materials.
(7)
Weather-resistant plastic, such as vinyl.
(b)
The materials permitted for fences and walls shall be limited to the types set forth in Subsection (a) above.

Fences and walls in the R-A, R-1, R-2, R-3, R-4, R-C1, R-C2 and R-PD zone districts shall conform to the following requirements:
(1)
Fences and walls along the side and rear yards of a corner lot adjacent to a street shall not exceed a height of seventy-two (72) inches, or thirty-six (36) inches within the site distance triangles defined in Subsection 16-20-20(b) of this Article.
(2)
Fences and walls within twenty-five (25) feet of the front lot line shall not exceed a height of forty-two (42) inches, or thirty-six (36) inches within the site distance triangles defined in Subsection 16-20-20(b).
(3)
Fences and walls within the rear and side yards, not on a corner lot, shall not exceed a height of seventy-two (72) inches.

Fences and walls in the C-1, C-2 and C-3 zone districts shall conform to the following requirements:
(1)
No fence or wall shall be erected within a front yard, except for fences of Class 2, 3, 4 or 6 that do not exceed thirty-six (36) inches in height.
(2)
Fences and walls along the side and rear yards of a corner lot adjacent to a street shall be of Class 2, 3, 4, 6 or 7 and shall not exceed a height of seventy-two (72) inches, or thirty-six (36) inches within the site distance triangles defined in Subsection 16-20-20(b) of this Article.

Fences and walls within the rear and side yards may be of any class and shall not exceed a height of seventy-two (72) inches, or thirty-six (36) inches within the site distance triangles defined in Subsection 16-20-20(b).

(a)
No barbed wire, sharp-pointed or electrically charged fence shall be erected or maintained anywhere in the City.
(b)
Except for the relocation of an existing fence on the same property, recycled and other similar materials may be used as fencing materials only if:
(1)
The recycled material proposed to be used is a material authorized by Section 16-20-30 of this Article;
(2)
A sample of the recycled or other material proposed to be used is submitted to the City Manager;
(3)
The recycled material is of similar quality, appearance, structural stability and durability to new materials of like composition;
(4)
The City Manager approves the use of the recycled or other material; and
(5)
The recycled or other materials used in the fence, as built, conform in quality, appearance, structural stability and durability to the sample submitted.
(c)
The owner and the occupants of the premises on which a fence is located shall be jointly and severally liable to maintain such fence in such a manner that prevents the development of rust, corrosion, rotting, peeling, cracking or other deterioration in the physical appearance, functionality, stability or safety of such fence.
