CHAPTER 21

62 - OATS PARK SCHOOL HISTORIC DISTRICT

21.62.010 - Oats Park School historic district established.

Pursuant to N.R.S. 384.005 the Oats Park School historic district is established to preserve and protect the Oats Park Schoolhouse and its environs which shall expressly include only those buildings and improvements constructed before 1940, situated in the historic district whose boundaries shall be fixed as being that area known as "Block 5 of the Oats Park Addition to and in the City of Fallon, Nevada," said block being bounded on the north by Court Street, on the east by Sherman Street, on the south by Center Street and on the west by East Park Street.

21.62.011 - Old Post Office historic district established.

Pursuant to NRS 384.005 the Old Post Office historic district is established to preserve and protect the Old Post Office and its environs which shall expressly include only those buildings constructed prior to 1940, situated in the historic district whose boundaries shall be fixed as being that area known as "Lots 15, 16 and the North ½ of 14 of Block 205 of the John Oats Addition to and in the City of Fallon, Nevada," said block being bounded on the North by A Street, on the West by Maine Street, on the East by Nevada Street, and on the South by Williams Avenue.

21.62.012 - Churchill County Courthouse historic district established.

Pursuant to NRS 384.005 the Churchill County Courthouse Historic District is established to preserve and protect the Churchill County Courthouse and its environs which shall expressly include only those buildings constructed prior to 1940 situated in the historic district whose boundaries shall be fixed as being that area known as "Lot 5 of Block 60 of the Williams Tract in the City of Fallon, Nevada," said block being bounded on the North by A Street, on the East by Maine Street, on the West by Carson Street, and on the South by Williams Avenue.

21.62.013 - Fallon City Hall Complex historic district established.

Pursuant to NRS 384.005, the Fallon City Hall Complex historic district is hereby established to preserve and protect the Fallon City Hall Complex and its environs which shall expressly include only those buildings constructed prior to 1940, situated in the historic district whose boundaries shall be fixed as being that area known as 55 West Williams Avenue and 10 South Carson Street.

21.62.020 - Review board established.

Pursuant to NRS 384.005 the city council is designated as the review board with the power to review proposed alterations to structures within all historical districts within the city of Fallon.

21.62.030 - Preservation and rehabilitation criteria.

A.

Permits. Permits for construction or alteration of any applicable building or structure within any historical district shall be required for any work, with results in a change in the appearance of such building structure. No painting or ornamental work of any kind shall be done except in accordance with the permit.

B.

Uses Permitted. The uses permitted by the zoning ordinance applicable to the area included in a historical district shall be permitted without restriction by the provisions of this chapter. Provided that no advertisements, billboards or signs may be permitted except for advertising activities or sales conducted on the premises.

C.

Review of Plans Required. No person, firm, corporation, or association shall build any new building or alter any applicable existing building within a historical district without submitting the plans and specifications for the building or alteration to the review board for review.

No such construction or alteration shall be started until the review board has approved the plans as being in compliance with all of the requirements of this chapter.

D.

Compliance. Upon receipt of the plans, the city engineer shall recommend approval or denial of same to the review board, and shall proceed as rapidly as possible to determine whether the proposed construction or alteration complies with all of the terms of all ordinances relating to a historical district. In the case of new buildings, the plans must indicate a type of structure which will be compatible with the typical architecture of the particular historical district. In the cases involving alterations to existing buildings, the plans will, to the extent feasible show a design consistent with the existing buildings and with the architectural forms typical to the existing building within that particular district.

21.62.040 - Penalty for violation.

Any person, firm or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this chapter is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than five hundred dollars or by imprisonment not to exceed six months, or by both such fine and imprisonment.
