ARTICLE I

- INTRODUCTION

Sec. 100.1 - Title.

The full title of this ordinance shall be the "Zoning Ordinance and General Development Regulations" for the City of Flatwoods Kentucky. This ordinance consists of the enclosed text and the official zoning map as filed with the clerk of Greenup County, Kentucky.

Sec. 100.2 - Authority.

This ordinance has been developed pursuant to the provisions of Kentucky Revised Statutes 100.201 and 100.203.

Sec. 100.3 - Adoption and effective dates.

A.

Public hearings: The Greenup County Joint Planning Commission conducted a public hearing on behalf of the City of Flatwoods concerning the development of these zoning and general development regulations on the following date: November 25, 2014.

B.

Planning commission adoption: The Greenup County Joint Planning Commission reviewed and approved these zoning and general development regulations on: November 25, 2014.

C.

City council reading and adoption: The city council adopted this ordinance with the first reading on December 2, 2014, with the second reading on: December 16, 2014 and duly adopted as Ordinance Number 8 of 2014. The ordinance was duly published in The Greenup News on December 25, 2014.

D.

Effective date: The ordinance becomes effective on the date of publication.

Sec. 100.4 - Purpose.

The purpose of this ordinance is to avoid congestion in streets, to secure safety from fire, panic and other dangers; to provide adequate light and air, to prevent the overcrowding of land; to avoid undue concentration of population; to facilitate adequate provision for traffic, transportation, water, sewerage, schools, parks and other public requirements; to encourage the most appropriate use of land throughout the city with reasonable consideration to be given to the character of any district and its peculiar suitability for given uses, with a view to preserving the natural environment, the values of land, buildings and other structures; to guide and accomplish a coordinated, adjusted and harmonious development of all of Flatwoods, Kentucky; to promote the public health, safety, morals and general welfare of the community.

Sec. 100.5 - Interpretation and scope of regulations.

A.

This regulation shall be strictly construed and may not be extended by implication except where the intention of the city will prevail.

B.

This regulation shall apply to all lands located within the corporate limits of the City of Flatwoods.

C.

Whenever higher or more restrictive standards are established by the provisions of any other applicable statue, ordinance or regulation than are established by the provisions of this ordinance, the provisions of such other statute, ordinance, or regulation shall govern. Whenever this Ordinance is more restrictive than a private covenant or a state or federal statute or regulations, and provisions of this ordinance shall prevail.

Sec. 100.6 - Severability clause.

If any word or words, phrase or phrases, sentences or sentences, of this ordinance should be declared unconstitutional, it shall not thereby invalidate any other portion of this ordinance.

Sec. 100.7 - Repeal of conflicting ordinances and regulations.

All ordinances, regulations, or parts of ordinances or regulations in conflict with this zoning ordinance, or inconsistent with the provisions of this ordinance, are hereby repealed to the extent necessary to give this ordinance full force and effect. Ordinance 13-1969 is repealed in its entirety.
