ARTICLE XV

Communications Antennas and Towers

§ 330-75 Regulations governing communications antennas and communications equipment buildings.

A. 
Building-mounted communications antennas shall not be located on any single-family detached dwelling, single-family semidetached dwelling or townhouse.
B. 
Building-mounted communications antennas shall not be permitted to exceed the height limitations of the applicable zoning district by more than 20 feet.
C. 
Omnidirectional or whip communications antennas shall not exceed 20 feet in height or seven inches in diameter.
D. 
Directional or panel communications antennas shall not exceed five feet in height or three feet in width.
E. 
Any applicant proposing communications antennas to be mounted on a building or other structure shall submit evidence from a Pennsylvania-registered professional engineer certifying that the proposed installation will not exceed the structural capacity of the building or other structure, considering wind and other loads associated with antenna location.
F. 
Any applicant proposing communications antennas to be mounted on a building or other structure shall submit detailed construction and elevation drawings indicating how the antennas will be mounted on the structure.
G. 
Any applicant proposing communications antennas to be mounted on a building or other structure shall submit evidence of agreements and/or easements necessary to provide access to the building or structure on which the antennas are to be mounted so that installation and maintenance of the antennas and communications equipment building may be accomplished.
H. 
Communications antennas shall comply with all applicable standards established by the Federal Communications Commission governing human exposure to electromagnetic radiation.
I. 
Communications antennas shall not cause radio frequency interference with other communications facilities located in Franklin Township.
J. 
A communications equipment building shall be subject to the height and setback requirements of the applicable zoning district for a principal use, and landscaping shall be required to screen as much of the equipment building as possible. An evergreen screen shall surround the site. The screen may be either a hedge (planted three feet on center maximum) or a row of evergreen trees (planted 10 feet on center maximum). The evergreen screen shall be a minimum height of six feet at planting and shall grow to a minimum of 15 feet at maturity.
K. 
The owner or operator of communications antennas shall be licensed by the Federal Communications Commission to operate such antennas.

§ 330-76 Standards for communications towers.

A. 
The owner or operator of a communications tower is required to demonstrate, using technological evidence, that the communications tower must go where it is proposed in order to satisfy its function in the company's grid system.
B. 
Any applicant proposing construction of a new communications tower shall demonstrate that a good faith effort has been made to obtain permission to mount the communications antennas on an existing building, structure or existing communications tower. A good faith effort shall require that all owners of potentially suitable structures within a one-half-mile radius of the proposed communications tower shall be contacted and that one or more of the following reasons for not selecting such structure apply:
(1) 
The proposed antennas and related equipment would exceed the structural capacity of the existing structure and its reinforcement cannot be accomplished at a reasonable cost.
(2) 
The proposed antennas and related equipment would cause radio frequency and interference with other existing equipment for that existing structure, and the interference cannot be prevented at a reasonable cost.
(3) 
Such existing structures do not have adequate location, space, access or height to accommodate the proposed equipment or to allow it to perform its intended function.
(4) 
Addition of the proposed antennas and related equipment would result in electromagnetic radiation from such structure exceeding applicable standards established by the Federal Communications Commission governing exposure to electromagnetic radiation.
(5) 
A commercially reasonable agreement cannot be reached with the owners of such structures.
C. 
The applicant shall demonstrate that the communications tower is the minimum height required to function satisfactorily.
(1) 
The maximum height of any new communications tower shall be 199 feet.
(2) 
An existing communications tower may be modified or extended to a height not to exceed a total height of 215 feet, to accommodate the co-location of additional communications antennas:
(a) 
All modifications or extensions of a communications tower to accommodate the co-location of additional communications antennas shall be of the same type of construction as the existing communications tower. Such a modification of an existing communications tower may only occur once. The setback requirements set forth in § 330-76D must be met for the post-modification height.
(b) 
Any applicant proposing a modification or extension in height to a communications tower shall submit evidence from the Pennsylvania Register of Professional Engineers certifying that the proposed modifications or extension will not exceed the structural capacity of the communications tower, considering wind and other loads associated with the modification or extension.
(c) 
Any applicant proposing a modification or extension in height to a communications tower shall submit detailed construction and elevation drawings indication and describing the modification or extension to the communications tower, and the communications antennas will be mounted on the structures.
(d) 
Any applicant proposing a modification or extension in height of a communications tower shall submit evidence of agreements and/or easements necessary to provide access to the communications tower so that maintenance of the modified or extended communications tower can be accomplished.
D. 
The required setback from the base of the communications tower or any guyed wire anchors to any property line shall be the largest of the following:
(1) 
One hundred percent of the height of a communications tower.
(2) 
The minimum setback in the underlying zoning district.
E. 
A linear two-mile separation shall be maintained between communications towers, measured from the base of the communications tower.
F. 
A fence shall be required around the communications towers and equipment buildings and be of a minimum height of eight feet.
G. 
The following landscaping shall be required to screen as much of the base of the communications tower and equipment building as possible, the fence surrounding the support structure and any other ground-level features, and, in general, soften the appearance of the communications tower site. Franklin Township may permit any combination of existing vegetation, topography, walls, decorative fences or other features instead of landscaping if they achieve the same degree of screening as the required landscaping.
(1) 
An evergreen screen shall be required to surround the site., The screen can either be a hedge (planted three feet on center maximum) or a row of evergreen trees (planted 10 feet on center maximum). The evergreen screen shall be a minimum height of six feet at planting and shall grow to a minimum of 15 feet at maturity.
(2) 
In addition, existing vegetation on and around the site shall be preserved to the greatest extent possible.
H. 
In order to reduce the number of communications towers needed in the community in the future, the proposed communications tower shall be required to accommodate other users, including other communications companies and local police, fire and ambulance companies.
I. 
The communications company must demonstrate that it is licensed by the Federal Communications Commission; shall submit a copy of its current Federal Communications Commission license; shall provide the name, address and emergency telephone number for the operator of the communications tower; and shall provide a certificate of insurance evidencing general liability coverage in the amount of $1,000,000 per occurrence and property damage coverage in the minimum amount of $1,000,000 per occurrence covering the communications tower and communications antennas. In January of each following year, the owner or operator of the communications tower shall submit written verification to the Township Supervisors that there have been no changes in the operating characteristics of the communications tower as represented at the time of approval of the use by conditional use.
J. 
Communications towers shall be painted silver or have a galvanized finish retained in order to reduce the visual impact. No communications tower may be artificially lighted except as provided for and required by the FAA. No signs shall be mounted on any communications towers or antennas.
K. 
A site development plan shall be required for all proposed communications towers, showing the antenna, building, fencing, buffering and access.
L. 
Access shall be provided to the communications tower and communications equipment building by means of a public street or easement to a public street. The easement shall be a minimum of 20 feet in width and shall be improved to a width of at least 10 feet with a dust-free all-weather surface for its entire length.
M. 
The owner or operator of the communications tower and antennas shall provide an annual inspection report regarding the structural integrity of the tower and antennas to Franklin Township.
N. 
All conditional uses approved under this section will automatically lapse if the communications tower is not used for 12 continuous months. In such case, all portions of the communications facility will be removed by the party responsible for erecting the facility, with costs of removal to be borne by that party.

§ 330-77 Standards for antenna support structures.

The required setback from the base of an antenna support structure or any guyed wire anchors to any property line shall be the largest of the following:
A. 
One hundred percent of the height of the antenna support structure; or
B. 
The minimum setback for a principal use in the underlying zoning district.
