ARTICLE IX

Conservation District

§ 330-38 Purpose.

Much of the Township land abutting the Connoquenessing Creek is in the 100-year floodplain or impacted by wetlands. Development has long been present in the floodplain, mostly residential and mainly summer cottages, some of which are now permanent homes. Further development within the floodplain should occur only in accordance with the Township's floodplain management regulations.[1] Very-low-density housing and open space activities are appropriate in this district.

§ 330-39 Permitted uses.

Lot or property may be used, and a building or structure may be erected or used, within the zoning district, for any of the following:
A. 
Principal uses.
(1) 
Nursery and agricultural field operations.
(2) 
General farming.
(3) 
Commercial kennels or stables.
(4) 
Commercial recreation, outside.
(5) 
Essential services.

Residential use in compliance with federal floodplain regulations and Chapter 168, Floodplain Management, of the Code of Franklin Township.

(7) 
Forestry.

B. 
Accessory uses.
(1) 
Private on-lot recreation facilities.
(2) 
Private kennels or stables.
(3) 
Minor residentially related structure.
(4) 
No-impact home-based business.

§ 330-40 Conditional uses.

A. 
Extraction of minerals or soils.
B. 
Commercial feedlot operations.
C. 
Mineral extraction, subject to the standards and criteria attached.[1] The standards and criteria governing the grant of a conditional use or a special exception for extraction of minerals include the following: special requirements for the application; special requirements for roads, bridges, traffic and parking; special site requirements; special emergency management provisions; special fees for conditional uses and special exceptions.

§ 330-41 Bulk and dimensional standards.

A. 
Minimum lot area.
(1) 
Single-family detached dwelling: 43,560 square feet.
(2) 
All other uses: 43,560 square feet.
(3) 
Any use without public sewers and water service: 65,340 square feet.
B. 
Minimum lot width: 125 feet.
C. 
Minimum setback distances.
(1) 
Front yard: 50 feet.
(2) 
Side yard, each side: 15 feet.
(3) 
Side yard, abutting street: 50 feet.
(4) 
Rear yard: 50 feet.
(5) 
Accessory buildings, side or rear yard: five feet.
D. 
Maximum height.
[Amended 3-9-2005]
(1) 
All principal structures: 45 feet.
(2) 
All accessory structures: 30 feet. (Note: No accessory structure can exceed 75% of the height of the principal structure.)
E. 
Maximum lot coverage (all buildings on the lot):
(1) 
Total area occupied by buildings, divided by lot area: 10%.
(2) 
Accessory building as part of coverage total: 2%.
F. 
The setback distances contained in this section shall not apply to property in plans of subdivision recorded prior to the effective date of Chapter 275, Subdivision and Land Development. For such lots, the setback distances contained in Chapter 275, Subdivision and Land Development, of the Township's Code shall be in effect and shall supersede the setback distances contained in this chapter.
