ARTICLE VII

C Commercial, Retail, Sales and Service District

§ 330-28 Purpose.

Several small strip commercial malls and other businesses have been built on Routes 65 and 288, designed to serve the residents of Franklin Township and the greater Ellwood City area, in proximity to the largest part of the Township's population and the heart of the highway network. The Commercial, Retail, Sales and Service Zone is intended to provide sufficient space for development and expansion of a broad array of shopping, personal services and business services uses.

§ 330-29 Permitted uses.

A lot or property may be used, and a building or structure may be erected or used, for any of the following:
A. 
Principal uses.
(1) 
Antique sales, amusement enterprises, indoor automotive parts sales, automobile sales new or used, auto service station, automotive repair services, auto tire or glass sales and installation, auto washing or rental, baked goods sales, bank, savings and loan or credit union, barbershop or beauty shop, beverage distributorship, bicycle and/or outdoor gear sales, sales of books, magazines and/or newspapers, boat and watercraft sales and supplies, building materials sales, business or trade school, catering business and/or rental hall, church, including educational and social halls and parking, clothing and shoe sales, computing equipment and software sales, convenience sales, including gasoline, day-care center (consistent with § 330-46B), department or variety store, drugstore, dry cleaning, dyeing and pressing, essential services, farm equipment and supplies and equipment service, floor covering and carpet sales, flowers and accessories, food sales including delicatessen, supermarket and specialty foods, funeral home, garden supplies and plant materials, gift and card sales, hardware sales and supplies, household appliance sales, interior decorating services and sales, jewelry, watches, china and silverware, laundromat and/or dry cleaning pickup, locksmith, mailing services, medical, dental, chiropractic or optician office, laboratory or clinic, motel, motorcycle sales and service, musical instrument sales and instruction, office supplies and business machines, offices (business, professional and governmental), parking lot or garage, pet shop and supplies, photocopying, photographic studios, supplies and developing, radio, television or recording studio, recreation vehicle sales, supplies and service, recreation, commercial, repair services for household appliances, electric and electronic equipment, restaurant without drive-through service, restaurant with drive-through service, rental of videos, tools, equipment, party goods and/or apparel, shopping center or mall as an integrated plan, social hall, lodge or fraternal organization, sporting goods, clothing and equipment, tailor and/or dressmaker, taxidermist but not including meat processing, theater indoors, therapeutic massage, used merchandise sales from within an enclosed building and single-family detached dwellings, general farming, and forestry.

B. 
Accessory uses.
(1) 
Parking lots, garages and truck servicing areas, drive-through services, outdoor sales and storage, dumpster or other trash storage area, banking machine, apartment over commercial space.

§ 330-30 Special exceptions.

A. 
Uses similar to and compatible with those uses that are listed as permitted, cellular or telecommunications tower, overland public utility lines.
B. 
Apartments in mixed use buildings subject to the requirements of § 330-45F.

§ 330-31 Conditional uses.

Townhouses (attached single family dwellings, including condominiums).

§ 330-32 Bulk and dimensional standards.

A. 
Minimum lot area.
(1) 
Single-family detached dwelling: 21,780 square feet.
(2) 
Any use with public sewers or water lines: 21,780 square feet.
(3) 
Any use without public sewers or water lines: 43,560 square feet.
(4) 
Townhouse group: 21,780 square feet.

B. 
Minimum lot width.
(1) 
All uses: 100 feet.
C. 
Minimum setback.
(1) 
Front yard: 50 feet.
(2) 
Side yard, each side: 10 feet.
(a) 
Abutting zones other than C or I: 20 feet.
(3) 
Side yard, abutting street: 50 feet.
(4) 
Rear yard: 10 feet.
(a) 
Abutting zones other than C or I: 20 feet.
(5) 
Accessory building, side or rear: 10 feet.
(6) 
Rear townhouses: 30 feet.

D. 
Maximum height.

All principal structures: 45 feet.
(2) 
All accessory structures: 30 feet. (Note: No accessory structure can exceed 75% of the height of the principal structure.)
E. 
Maximum lot coverage (all buildings on lot).
(1) 
Total area occupied by buildings, divided by lot area:

Townhouses: 45%.

Accessory buildings as part of coverage total: 5%.
F. 
The setback distances contained in this section shall not apply to property in plans of subdivision recorded prior to the effective date of Chapter 275, Subdivision and Land Development. For such lots, the setback distances contained in Chapter 275, Subdivision and Land Development, of the Township's Code shall be in effect and shall supersede the setback distances contained in this chapter.
