PREFACE
This volume contains the Land Development Regulations of Haines City, Florida, as adopted by the City Commission on December 5, 1991.
The ordinance is printed herein substantially as enacted, except where deemed expedient for stylistic reasons or to facilitate indexing, words or phrases were added by the editors and are indicated by brackets.
Section Numbering System
The section numbering system used in this republication is the same as that originally adopted in the Haines City Land Development Regulations.
Page Numbering System
The page numbering system used in this republication is a prefix system. The number to the left of the colon represents the chapters of the Land Development Regulations. The number to the right of the colon represents the sequence of the page within that chapter; thus, page 3 of Chapter 4 of the Land Development Code would appear as 4:3.
Index
The index has been prepared with the greatest of care. Each particular item has been placed under several headings, some of which are couched in lay phraseology, others in legal terminology, and still others in language generally used by local government officials and employees. There are numerous cross references within the index which stand as guideposts to direct the user to the particular item in which the user is interested.
Looseleaf Supplements
A special feature of this publication is the looseleaf system of binding and supplemental servicing of the publication. With this system, the publication will be kept up-to-date. Subsequent amendatory legislation will be properly edited, and the appropriate page or pages affected will be reprinted. ORDINANCE NO. 12-1423
AN ORDINANCE OF THE CITY OF HAINES CITY, FLORIDA AMENDING ORDINANCE NO 796, THE LAND DEVELOPMENT REGULATIONS OF THE CITY, BY AMENDING THE CITY WIDE ZONING MAP OF THE CITY AND BY ADOPTING THE CHANGES IN THE LAND DEVELOPMENT REGULATIONS OF THE CITY BY RESTATING THE ENTIRE LAND DEVELOPMENT REGULATIONS INCLUDING THE AMENDMENTS THEREIN; PROVIDING FOR SEVERABILITY; PROVIDING FOR A COPY TO BE KEPT ON FILE, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapter 163, Florida Statutes, empowers the City Commission of the City of Haines City, Florida to prepare and enforce Land Development Regulations for the implementation of the adopted Haines City Comprehensive Plan; and
WHEREAS, the City Commission did adopt Ordinance No. 796, Land Development Regulations to implement the adopted Haines City Comprehensive Plan; and
WHEREAS, the adopted Haines City Land Development Regulations contain Chapter 5, Zoning, including a Zoning Map; and
WHEREAS, through a series of workshops the Haines City Commission, Community Redevelopment Agency, Planning Board and focus group meetings, specific changes to the Land Development Regulations where identified and discussed; and
WHEREAS, the Haines City Planning Commission, at an advertised public hearing as required by Chapter 21 of the Land Development Regulations, has reviewed, heard public input and recommended that the City Commission amend the Zoning Map and adopt specific changes in the Land Development Regulations by restating the entire Land Development Regulations; and
WHEREAS, the City Commission of the City of Haines City, Florida considered all oral and written comments received during advertised public hearings, the recommendations of the Haines City Planning Commission; and
WHEREAS, in exercise of its authority, the City Commission of the City of Haines City, Florida has determined it necessary and desirable to amend the Zoning Map contained in Chapter 5, Zoning of the Land Development Regulations, adopted by Ordinance No. 796, and adopt specific changes in the Land Development Regulations by restating the entire Land Development Regulations consistent with the public interest within Haines City, Florida.
NOW, THEREFORE BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF HAINES CITY, FLORIDA, AS FOLLOWS:
Section 1: Land Development Regulations.
A.
That the Zoning Map attached hereto as Exhibit A shall be the Official Zoning Map referred to in Chapter 5, Article 5 of the Land Development Regulations of the City of Haines City, Florida and such Official Zoning Map hereby supersedes and replaces the Official Zoning Map adopted December 5, 1991 as part of Ordinance No. 796, as amended.
B.
That there is hereby ADOPTED BY REFERENCE the restated and amended Haines City Land Development Regulations to be applied throughout the corporate limits of the City of Haines City, Florida and that three (3) copies of such Land Development Regulations are on file in the office of the City Clerk.
Section 2: Severability. If any provision of this Ordinance or the applications thereof is held invalid, such invalidity shall not affect the other provisions or application of this Ordinance which can be given effect without the invalid provisions or application, and to this end the provisions of this Ordinance are hereby declared severable.
Section 3: Codification. The Ordinance shall be codified and made a part of the official Code of Ordinances of the City of Haines City.
Section 4: Repeal of Ordinance in Conflict. All other ordinances of the City of Haines City, Florida, or portions thereof which conflict with this or any part of this Ordinance are hereby repealed.
Section 5: Effective Date. This Ordinance shall take effect immediately upon its being read in two meetings of the City Commission of the City of Haines City, its approval and adoption by said Commission and when certified to passage.
