CHAPTER 13

PERFORMANCE STANDARDS

9-13-1: JURISDICTION:

Any use hereafter established in any zoning district in the Village shall be used and maintained in such a manner as to comply with applicable performance standards as hereinafter set forth governing noise, smoke, particulate matter, toxic and noxious matter, odors, fire and explosive hazards, vibration, radiation, or glare or heat, for the district in which such use shall be located; and no use already established on the effective date of this Title shall be so altered or modified as to conflict, with or further conflict with applicable performance standards for the district in which such use is located. 9-13-2: NOISE:

Each land use must conform to the standards set forth from time to time by the Illinois Environmental Protection Agency. Such standards shall include, but not be limited to, the requirements as outlined in the publication entitled State of Illinois Noise Pollution Control Regulations, current publication, as amended. 9-13-3: VIBRATION:

   A.   Excessive Vibrations Prohibited:
      1.   In any district, no activity or operation shall cause or create earthborne vibrations in excess of the displacement values given below.
      2.   Measurements shall be made at or beyond the adjacent lot line or the nearest residence district boundary line, as described below:
Vibration displacements shall be measured with an instrument or complement of instruments capable of simultaneously measuring in three (3) mutually perpendicular directions. The maximum vector shall be less than the vibration displacement permitted. For the purpose of this Title, steady state vibrations are vibrations which are continuous, or vibration in discrete impulses more frequent than one hundred (100) per minute. Discrete impulses which do not exceed one hundred (100) per minute shall be considered impact vibrations.
   B.   Maximum Permitted Displacements: The maximum permitted displacements shall be determined in each district by the following formula:

   C.   Maximum Earth Displacement: The maximum earth displacement permitted at the points described below shall be determined by use of the formula in the preceding subsection B and the appropriate K constant shown in Table 1.

9-13-4: SMOKE AND PARTICULATE MATTER:

Each land use must conform to the standards set forth from time to time by the Illinois Environmental Protection Agency. Such standards shall include but not be limited to the requirements as outlined in the publication entitled State of Illinois Smoke and Particulate Matter, adopted by the Illinois Air Pollution Control Board, current publication as amended. 9-13-5: TOXIC MATTER:

Each land use must conform to the standards set forth from time to time by the Illinois Environmental Protection Agency. Such standards shall include, but not be limited to, the requirements as outlined in the publication entitled State of Illinois Toxic Matter, adopted by the Illinois Air Pollution Control Board, current publication as amended. 9-13-6: ODOROUS MATTER:

Each land use must conform to the standards set forth from time to time by the Illinois Environmental Protection Agency. Such standards shall include the publication entitled State of Illinois Odorous Matter, adopted by the Illinois Air Pollution Control Board, current publication as amended. (Ord. 381-87, 6-9-87)

9-13-7: FIRE AND EXPLOSION:

Fire and explosive hazards shall be controlled, as follows:
   A.   Activities involving the storage or manufacture of materials or products which decompose by detonation are not permitted in the Village.
   B.   Material or products which produce flammable or explosive vapors or gases under ordinary weather temperatures shall not be permitted in any district, with the exception of the following, which are permitted:
Flammable liquids and oils stored, sold and used in conjunction with the operations of any automobile service station and customarily required or used in such operation. (Ord. 381-87, 6-9-87)

9-13-8: GLARE:

In any district, any operation or activity producing glare at night shall be conducted so that direct and/or indirect illumination shall be mitigated onto adjacent properties in accordance with the provisions outlined in Section 9-19. (Ord. 381-87, 6-9-87; amd. Ord. 1965-19, 9-23-2019)

9-13-9: RADIATION HAZARDS:

   A.   Release Outside Property Lines: In any district, the release of radio-active materials or the emission of ionizing radiation outside of property lines shall be in accordance with the standards set forth from time to time by the Illinois Environmental Protection Agency. Such standards shall include, but not be limited to, the requirements as outlined in the rules and regulations of the State of Illinois, Rules and Regulations for Prevention of Radiation Hazards, adopted April 18, 1961, amended May 15, 1967.
   B.   Unsealed Radioactive Materials: In any district, unsealed radioactive materials shall not be manufactured, utilized, or stored except when such materials are stored in a fireproof container at or below ground level. (Ord. 381-87, 6-9-87)

9-13-10: WATER POLLUTION:

Each land use must conform to the standards set forth from time to time by the Illinois Environmental Protection Agency. Such standards shall include, but not be limited to, the requirements as outlined in the publication entitled, Water Pollution Regulations of Illinois, dated March 7, 1972 (Division of Water Pollution Control).
