CHAPTER 8

AGRICULTURAL DISTRICTS

9-8A-1: PURPOSE:

This district is created to provide areas for agricultural and certain related uses. The specific intent is to facilitate the proper use of lands best suited to agriculture and related uses through preventing the admixture of urban and rural uses creating incompatibility and conflict. 9-8A-2: MINIMUM AREA:

The minimum area in this district shall be ten (10) contiguous acres. (Ord. 381-87, 6-9-1987)

9-8A-3: PERMITTED USES:

The following uses are permitted:
Apiary.
Arboretum or botanical garden.
Cultivation of field and garden crops.
Dairy farming.
Flower, grass (or sod) and general farming.
Greenhouse, nonretail.
Orchard.
Single-family dwelling.
Truck farm. (Ord. 381-87, 6-9-87)

9-8A-4: SPECIAL USES:

The following uses are permitted as special uses upon obtaining a special use permit as authorized by chapter 14 of this title, as amended:
Camp, day or youth.
Cemetery, church or other place of worship.
Conservation club.
Convent, monastery.
Dairy products and processing.
Extraction of earth products.
Golf course.
Golf driving range (as part of a golf course).
Greenhouse, retail.
Kennels.
Mushroom production barn, commercial.
Nursery school.
Nursery, tree or shrub.
Public utility facilities.
Religious retreat.
Schools: university, college, theological seminary, junior college, high school, junior high school, elementary school.
Stable, commercial.
Stable, private.
Veterinary clinic, boarding animal variety veterinary clinic, nonboarding animal variety. (Ord. 381-87, 6-9-1987; amd. Ord. 1242-07, 12-17-2007)

9-8A-5: TEMPORARY USES:

The following uses are permitted as temporary uses upon obtaining a temporary use permit from the village board of trustees:
Christmas tree sales.
Contractor's project office and equipment sheds.
Seasonal sale of farm produce.
Summer theater.
Tent meeting or tent theater. (Ord. 381-87, 6-9-1987)

9-8A-6: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained:

9-8A-7: MAXIMUM LOT COVERAGE:

Not more than two percent (2%) of the lot area may be occupied by buildings and structures. (Ord. 381-87, 6-9-1987)

9-8A-8: BUILDING HEIGHT:

No building or structure shall exceed a height of fifty feet (50'). (Ord. 381-87, 6-9-1987)

9-8A-9: OFF STREET PARKING:

Off street parking and loading shall be provided as required or permitted by chapter 11 of this title. (Ord. 381-87, 6-9-1987)

9-8B-1: PURPOSE:

This District is created to provide areas for agriculturally-related business uses that may be controlled to permit a compatible transition with existing and future low density single-family residential neighborhoods characteristic of the Village. The specific intent is to facilitate the proper use of lands that have rural historic agricultural significance while recognizing that there are other related uses which both support agricultural and are suitable commercial uses found in rural, transitional agricultural-type areas. Uses allowed in the AB Agricultural Business District represent those that are carefully controlled with agricultural uses while supportive of the broader commercial and low density single-family residential goals of the community. 9-8B-2: MINIMUM AREA:

   A.   The minimum area in this District shall be five (5) contiguous acres.
   B.   By recommendation of the Plan Commission and approval of the Village Board, parcels of land under the five (5) acre standard may receive AB Agricultural Business District if it can be demonstrated that the property has particular historic, cultural or aesthetic importance, while maintaining a minimum lot size of three (3) acres and meeting all applicable setback and bulk requirements. 9-8B-3: PERMITTED USES:

The following uses are permitted:
Farm produce stand.
Historical building and landmark.
Historical structures including historical agricultural structures established prior to the adoption of this Article.
Horticultural uses.
Single-family farm dwelling. (Ord. 584-93, 12-13-93)

9-8B-4: SPECIAL USES:

The following uses may be allowed by special use permit:
Accessory agricultural buildings, i.e., barns, silos, sheds, etc.
Accountant office (less than 1,500 square feet of floor area).
Antique shop.
Arboretum or botanical garden.
Architectural office (less than 1,500 square feet of floor area).
Art gallery.
Art supply shop.
Artist studio.
Attorney office (less than 1,500 square feet of floor area).
Barber shop.
Beauty salon.
Bicycle shop.
Boat, canoe, sail boats, other nonmotorized water recreation sporting goods-sales, rental and service.
Book shop.
Camera and photographic, sales, supplies, studio.
Camp, day or youth (minimum 15 acres).
Camping equipment and related sporting goods.
Candy and confectionery store.
Cannabis craft grower.
Cannabis cultivation center.
Catalog sales office.
Cemetery, church or other place of worship.
Chamber of Commerce office.
Child care, day care centers.
Children day school, nursery.
China and glassware shop.
Cleaners (dry cleaning and laundry pick-up stations only).
Coin, stamp collectors shop.
Conservation club.
Convent, monastery.
Country style foodstuff shop, bakery goods, cheese, sausage, taffy apples, gourmet foods and similar food items.
Cultivation of field and garden crops.
Dairy products shop.
Drapery shop.
Dress makers shop.
Engineers office (less than 1,500 square feet of floor area).
Farm store.
Fences, existing prior to adoption of this Article or when used in conjunction with an existing agricultural use.
Florist.
Flower, grass (or sod) and general farming.
Furrier shop, including storage.
Garden supply store.
Gift shop.
Golf course.
Golf equipment and related sporting goods-sales and service.
Greenhouse, nonretail.
Greenhouse, retail.
Haberdashery.
Hardware shop (less than 20,000 square feet of floor area).
Health club.
Hearing aid store.
Hobby shop.
Home occupation.
Home office operation.
Household pet supplies store.
Insurance agency (less than 1,500 square feet of floor area).
Interior decorator shop, office or studio.
Jewelry shop.
Landscape architect office (less than 1,500 square feet of floor area).
Landscape contracting business and equipment yard.
Leather goods shop.
Libraries.
Locksmith shop.
Mail order house.
Mailbox and packaging service.
Millinery shops.
Museum.
Nursery, tree or shrub, retail or nonretail, with greenhouse buildings.
Orchard.
Picture framing studio.
Public utility facilities.
Religious retreat (minimum 15 acres).
Saddles shop, leather goods, accessory sales, including clothing.
Schools, university, college, theological seminary, junior college, high school, junior high school, elementary school.
Shoe stores and repair service (less than 1,500 square feet of floor area).
Snowplowing service.
Tree trimming business.

9-8B-5: TEMPORARY USES:

The following uses are permitted as temporary uses upon obtaining a temporary use permit from the village board of trustees:

9-8B-6: MINIMUM LOT AREA:

The minimum lot sizes required in the AB agricultural business district shall be as follows:

9-8B-7: YARD AREAS:

   B.   Accessory Structure Setback: Where an existing structure is located within a required yard and serves as an accessory structure to the principal use of the property and provided said structure is less than or equal to three hundred (300) square feet in size and is a minimum of ten feet (10') from the lot line, the village board may authorize the continued use of said structure in a special use permit.
   C.   Setback Parking: No parking shall be permitted in the area required for front, side, or rear yards except where such parking is authorized by the village in a special use permit. (Ord. 1021-03, 4-21-2003)

9-8B-8: MAXIMUM LOT COVERAGE:

Not more than ten percent (10%) of the lot area may be occupied by buildings and enclosed structures. (Ord. 584-93, 12-13-1993)

9-8B-9: BUILDING HEIGHT:

No building shall exceed a height of thirty five feet (35') or two and one-half (21/2) stories, whichever is less. These height restrictions shall not apply to existing agricultural buildings provided said agricultural buildings shall not exceed fifty feet (50'). (Ord. 584-93, 12-13-1993)

9-8B-10: OFF STREET PARKING:

Off street parking shall be provided in accordance with the requirements set forth in chapter 11 of this title, except that where a special use permit is granted, up to twenty five percent (25%) of the parking spaces required may be land banked in accordance with chapter 11 of this title.
