CHAPTER 6

BUSINESS DISTRICTS

9-6A-1: PURPOSE:

The purposes of the GO general office district are to: (Ord. 381-87, 6-9-1987; amd. Ord. 1314-10, 1-19-2010)
   A.   Allow development of areas for office use on fairly large, open landscaped sites with every possible assurance that the residential quality of the adjacent neighborhoods will be maintained.
   B.   Allow development of areas for office use on small sites as a special use, provided the scale and design of the development is compatible with the residential character of the village.
   C.   Allow development of areas for large scale office use as a special use provided the scale and design of the development is compatible with the residential character of the village. (Ord. 381-87, 6-9-1987)

9-6A-2: PERMITTED USES:

The following uses are permitted, provided they are operated entirely within a building, except for off street parking and loading facilities, and provided access to a sewer and water has been obtained:
Accessory uses.
Administrative or executive offices.
Architectural and/or engineering offices.
Employment agencies.
Financial institutions.
Insurance offices, not to include drive-in facilities.
Libraries, art galleries and museums.
Medical offices, including, but not limited to, chiropodist, chiropractor, dentist, medical doctor, optician, optometrist, orthodontist and osteopath, psychiatrist and psychologist.
Off street parking and loading facilities, as regulated in chapter 11 of this title.
Offices, including business, professional and governmental, but not including offices used for the display, sale, lease, delivery, processing, storage, manufacturing, servicing or advertisement of merchandise, commodities or other chattel, except where such uses clearly are accessory or incidental to and located in the same building as the permitted use.
Philanthropic and charitable institutions, but not including businesses sponsored by such institutions, except such as are accessory or incidental to and located in the same building as such institution proper.
Photography studios.
Signs, as regulated in chapter 12 of this title. (Ord. 381-87, 6-9-1987)

9-6A-3: SPECIAL USES:

The following uses may be allowed by special use permit:
Churches, rectories, seminaries, convents, monasteries and similar religious institutions, including dormitories and other similar accessory uses required for operation.
Clubs and lodges, private.
Daycare center nursery school.
Medical facilities, including laboratories, clinics (limited to outpatient care) and dispensaries.
Parks, when publicly owned and operated.
Planned unit developments, as defined in chapter 15 of this title.
Professional and business schools, but not including those of an industrial character.
Public service uses, including potable water facilities, filtration and treatment plants, pumping stations and water reservoirs, sewage treatment plants, sanitary landfills, police and fire stations, telephone exchanges, electric substations and other similar public service uses.
Public utility facilities.
Other office type uses not specifically listed above, when found to have compatibility with established uses on adjoining property.
All uses listed as permitted uses for the GO general office district may be processed as a special use with the special use requirements set forth in subsections 9-6A-5A and B of this article and the special use procedure, chapter 14 of this title. 9-6A-4: EXTERIOR LIGHTING RESTRICTED:

Exterior lighting shall be in accordance with the provisions outlined in Section 9-12 and Section 9-19. (Ord. 381-87, 6-9-1987; amd. Ord. 1965-19, 9-23-2019)

9-6A-5: SITE AND STRUCTURE REQUIREMENTS:

      1.   Landscape Plan: Uses listed as special uses in section 9-6A-3 of this article, as well as uses listed as permitted uses in section 9-6A-2 of this article, may be allowed as special uses as part of a unified plan with lot and yard requirements as specified in subsection A of this section and this subsection B, provided the developer submits a landscape plan for review and recommendations to the village board by the plan commission 1 and the architectural review commission.
      2.   Setback Parking: No parking shall be permitted in the area required for front, side, or rear yards, except where such parking is authorized by the village in a special use permit. (Ord. 1021-03, 4-21-2003)
   C.   Maximum Lot Coverage: Not more than fifty percent (50%) of the lot shall be covered by an impervious surface, including the principal building and any accessory building or use including parking lots and structures, except that where decorative pavers are used, the amount of impervious surface may be increased to fifty five percent (55%), provided the developer submits an overall design for review and recommendations to the village board by the plan commission and the architectural review commission.    D.   Building Height Limitations: In the GO general office district no principal building shall exceed a height of thirty five feet (35') or two and one-half (21/2) stories, whichever is lower. These height restrictions shall not apply to steeples on churches. No accessory building or use shall exceed a height of twenty feet (20').
   E.   Floor Area Ratio:

9-6A-6: OFF STREET PARKING:

Off street parking shall be provided in accordance with the requirements set forth in chapter 11 of this title, except that where a special use permit is granted, up to twenty five percent (25%) of the parking spaces required may be land banked in accordance with chapter 11 of this title. Layout of the parking area shall be reviewed by the plan commission. (Ord. 381-87, 6-9-1987)

9-6A-7: PRIVATE SYSTEMS PROHIBITED:

Private sewage disposal systems other than a septic tank system as approved by the Lake County health department, including, but not limited to, land treatment and spray irrigation systems, are prohibited in the GO general office district. (Ord. 560-93, 5-10-1993; amd. Ord. 1314-10, 1-19-2010)

The purpose of the ORD office research and development district is to allow for the development of areas for office or similar uses on small sites, provided that the scale and design of the development is compatible with the residential character of the village. 9-6A1-2: PERMITTED USES:

The following uses are permitted, provided they are operated entirely within a building, except for off street parking and loading facilities, and provided access to publicly dedicated sanitary sewer has been obtained:
Accessory uses.
Financial institutions, credit unions and banks including indoor and outdoor automatic teller machines which are attached to the principal building but excluding drive-in establishments.
Insurance office, not to include drive-in facilities.
Medical, veterinary and dental service offices including clinics.
Off street parking and loading facilities, as regulated in chapter 11 of this title.
Offices, including business, professional and governmental, but not including offices used for the display, sale, lease, delivery, processing, storage, manufacturing, servicing or advertisement of merchandise, commodities or other property, except where such uses are clearly accessory or incidental to and located in the same building as the permitted use.
Private tutoring/personalized educational services.
Professional, business and personal service offices.

9-6A1-3: SPECIAL USES:

The following uses may be allowed by special use but only when conducted entirely within an enclosed building, unless otherwise specified:
Cannabis dispensary.
Cannabis infuser.
Cannabis processor.
Cannabis transporter.
Communications offices, but limited to:
Cable and other pay TV services.
Radio and television broadcasting on lots of no less than five (5) acres.
Telephone communication, including telemarketing operations.
Daycare centers - adult and child, including outdoor recreation equipment. All centers must meet state licensing requirements.
Drive-in establishments accessory to financial institutions, credit unions and banks.
Drive-through establishments accessory to financial institutions, credit unions and banks, as regulated in section 9-11-9, "Drive-Through Facilities", of this title.
Drugstores and proprietary stores, but only when located in an office or clinic of a medical or dental practitioner.
Laboratories, but limited to optical, medical and dental.
Planned unit developments as defined in chapter 15 of this title.
Public utility facilities.
Research, development and testing services.
All uses listed as permitted uses for the ORD office research and development district may be processed as a special use with the special use yard requirements set forth in subsections 9-6A1-6A and 9-6A1-5C of this article and the special use procedure, chapter 14 of this title. The village may require landscape material to be used in combination with berming and the caliper of the material to be larger than the minimum standards set forth herein or in other applicable ordinances so as to provide immediate visual screening of the parking lot from the adjacent roads or properties. 9-6A1-4: EXTERIOR LIGHTING RESTRICTIONS:

9-6A1-5: SITE AND STRUCTURE REQUIREMENTS:

   A.   Lot Size Requirements: The minimum lot size required in the ORD office research and development district is thirty thousand (30,000) square feet.
   B.   Lot Width: The minimum lot width for the ORD office research and development district is seventy five feet (75') as measured at the required front yard setback line. (Ord. 808-97, 10-13-1997; amd. Ord. 1314-10, 1-19-2010)

   D.   Landscape Plan: Except as may be otherwise provided for and in addition to the requirements as may be found in this code, the developer of a subdivision shall submit a landscape plan to the plan commission and board of trustees for review and approval as a part of the subdivision review process. For the developer of an individual zoning lot, a landscape plan shall be submitted to the architectural review commission and the board of trustees for review and approval as a part of the certificate of approval process as specified elsewhere in this code.
   E.   Maximum Lot Coverage: The maximum lot coverage for all impervious surfaces on any individual lot shall be sixty percent (60%). All other areas on any zoning lot in the district shall be landscaped and maintained as open space.
   F.   Building Height: The maximum building height shall be two and one-half (21/2) stories or forty feet (40') including rooftop equipment, whichever is lower for principal structures and twenty feet (20') for an accessory building.
   G.   Floor Area Ratio: The maximum floor area ratio (FAR) in the district for a structure shall be 0.25.
   H.   Site Plan Requirements: A site plan for all zoning lots in the district is required prior to their development. (Ord. 808-97, 10-13-1997)

9-6A1-6: OFF STREET PARKING:

The minimum design requirements for parking lots, in addition to those required in chapter 11 of this title, shall be as follows: (Ord. 808-97, 10-13-1997)
   A.   No parking shall be permitted in the area required for setbacks from any federal, state or county road or other front, side or rear yards, except where such parking is authorized by the village in a special use permit. (Ord. 1021-03, 4-21-2003)
   B.   Parking lot rows containing fifteen (15) stalls or more shall be required to have mid row landscape islands at a frequency of one island for each not to exceed ten (10) parking stalls. Landscape islands shall be a minimum width of nine feet (9') and a minimum length of sixteen feet (16'). Each island shall contain one shade tree as specified by the village and shall be a minimum of a three inch (3") caliper tree.
   C.   There shall be a landscape island or landscaped area at the end of every parking row. Said landscape island or landscaped area shall be landscaped so as to screen the parking lot.
   D.   An eight foot (8') landscaped strip shall be required between all facades of any building on the zoning lot and any parking area or circulation drive.
   E.   Masonry wheel stops or curbs shall be placed so as to prevent protrusion of vehicles into street rights of way, yards, and other areas where parking is prohibited.
Layout of the parking area shall be reviewed by the architectural review commission and the board of trustees as a part of the certificate of approval process as set forth in this code. (Ord. 808-97, 10-13-1997)

9-6A1-7: PRIVATE SYSTEMS PROHIBITED:

Private sewage disposal systems including, but not limited to, land treatment and spray irrigation systems are prohibited in the ORD office research and development district. (Ord. 808-97, 10-13-1997; amd. Ord. 1314-10, 1-19-2010)

9-6B-1: PURPOSE:

The B retail business/commercial district is established to provide areas for a limited range of retail stores and personal service establishments which are desirable to provide day to day and occasional shopping needs. (Ord. 381-87, 6-9-1987; amd. Ord. 1314-10, 1-19-2010)

9-6B-2: PERMITTED USES:

Permitted principal uses of land or buildings as hereinafter enumerated, shall be permitted in the B retail business/commercial district only in accordance with conditions specified. Only those uses specifically listed hereunder shall be considered permitted principal uses, and no building or lot shall be devoted to any use other than a use permitted herewith with the exception of uses lawfully established prior to the effective date of this title or uses authorized as a special use in this section. The following uses constitute the only permitted principal uses in the B retail business/commercial district:
   A.   Retail uses:
      Antique shops.
      Apparel shops.
      Art and school supply stores.
      Art galleries and studios.
      Automobile and boat sales shops, but not including exterior display or storage.
      Bakery shops, including the baking and processing of food products when prepared for retail sales on the premises only.
      Banquet facilities.
      Bicycle sale and repair shop.
      Book and stationery stores.
      Brewpubs.
      Building and home materials and supplies; provided that no outdoor storage of such products shall be permitted.
      Camera and photography supply shops for retail sale.
      Candy and ice cream shops.
      Carpet, rug and other floorcovering shops.
      Catalog offices for mail order stores.
      China and glassware stores.
      Coffee shops.
      Coin and philatelic stores.
      Computer and computer software stores.
      Cookware shop and cooking school.
      Department stores.
      Drapery stores.
      Drug and pharmaceutical stores.
      Electrical equipment and fixture sales and repairs, but not including manufacture or assembly.
      Florist shops.
      Food stores, including, but not limited to, grocery stores, meat and fish markets, fruit and vegetable markets, and delicatessens.
      Furniture stores.
      Furrier, when conducted for retail trade on the premises only.
      Garden supply store, without exterior sales and storage.
      Gift shops.
      Greeting card shops.
      Hardware stores.
      Hobby and craft stores (not including video game parlors).
      Household appliance stores, including repair, but not including manufacture or assembly.
      Interior decorating shops, including upholstering services.
      Jewelry and watch sales and repair shops.
      Leather goods and luggage stores.
      Mixed uses; combination of economically compatible permitted uses.
      Municipal parking lots.
      Music stores, including the sale and service of stereo equipment, audio recordings, and sheet music.
      Musical instrument sales and repair stores.
      Office machine, service, and supply stores.
      Orthopedic and medical appliance stores, not including the assembly or manufacture of such articles.
      Outdoor dining use that is ancillary to a primary restaurant use, and not adjacent to residentially zoned property.
      Paint, glass and wallpaper stores.
      Picture framing, retail only.
      Plumbing supplies and fixture sales.
      Radio, television, and consumer electronics stores.
      Restaurants.
      Shoe stores.
      Sporting goods stores.
      Toy stores.
      Wine and martini bars.
      Winetasting shops.
   B.   Service uses:
      Accessory uses.
      Banks and financial institutions.
      Barber and beauty shops.
      Blueprinting and photocopying establishments.
      Dry cleaning and pressing establishments facilities for the cleaning and pressing of not more than one thousand seven hundred fifty (1,750) pounds of dry goods per day, and when using perchloroethylene or other similar noninflammable solvents approved by the state fire marshal.
      Health clubs.
      Health or day spas.
      Laboratories; medical, dental and optical.
      Lock and key services.
      Medical offices, including, but not limited to, chiropodist, chiropractor, dentist, medical doctor, optician, optometrist, orthodontist, osteopath, psychiatrist and psychologist.
      Off street parking and loading facilities, as regulated in chapter 11 of this title.
      Package handling services.
      Private tutoring services.
      Professional and general offices, including, but not limited to, accounting, auditing, and bookkeeping services; engineering, architectural, and surveying services; insurance carriers, agents, and brokers; legal services; real estate offices; security and commodity brokers, dealers and exchanges; and tax preparation services.
      Public offices, including, but not limited to, administration offices and post office.
      Retail and custom tailor and dressmaking shops.
      Shoe, clothing, hat, and leather repair shops.
      Signs as regulated in chapter 12 of this title.

9-6B-3: SPECIAL USES:

The following uses may be allowed by special use permit:
Ambulance service.
Automatic teller machines.
Automobile and boat sales shops, with outdoor display and storage.
Automobile service facilities, including oil change, brake and muffler repair and other similar services. The outside overnight storage of vehicles is prohibited.
Automobile service station, with or without minimart, for the sale of petroleum products and permitted retail goods only, but excluding automobile repair.
Billiard facilities.
Bowling alleys.
Building and home materials and supplies, including outdoor storage.
Cannabis dispensary.
Car (passenger) rental and leasing.
Churches, rectories and parish houses.
Clubs and lodges (nonprofit), fraternal and religious institutions.
Daycare centers and nursery schools.
Drive-through facilities accessory to principal use, as regulated in section 9-11-9, "Drive-Through Facilities", of this title.
Entertainment uses, with or without alcohol service, and including movie theaters, concert or music halls.
Equipment rental shops.
Garden supply stores, with exterior sales and storage.
Hotels or motels.
Liquor stores, limited to package goods only.
Medical and dental clinics, limited to outpatient care only.
Outdoor dining use that is ancillary to a primary restaurant use, if adjacent to residentially zoned property.
Parks, when publicly owned and operated.
Personalized educational service facility, including drivers' education facilities.
Pet shops.
Planned developments, as defined in chapter 15 of this title.
Police and fire stations.
Public utility facilities.
Schools; music, dancing, business, martial arts studios.
Sign printing and lettering shops.
Sports training facilities.
Theaters (outdoor prohibited).
Tobacco shops, retail sales only.
Veterinary clinics.
Video or media rental shops.
All uses listed as permitted uses for the B retail business/commercial district may be processed as a special use with the special use yard requirements set forth in subsections 9-6B-5A and B of this article and the special use procedure of chapter 14 of this title. 9-6B-4: CONDITIONS OF USE:

All uses permitted in this district shall be retail and service establishments dealing directly with consumers and shall be subject to the following conditions:
   A.   The sale of foodstuffs, articles and services shall be conducted wholly within an enclosed building, except when outside sale or display is authorized as a special use.
   B.   There shall be no manufacture, processing or treatment products other than that which is clearly incidental and essential to the retail business conducted on the same premises.
   C.   Such uses, operations or products shall not be objectionable due to odor, dust, smoke, noise, vibration or other similar causes.
   D.   Any exterior sign displayed shall pertain to a use conducted on the premises.
   E.   Exterior lighting shall be in accordance with the provisions outlined in Section 9-12 and Section 9-19.
   F.   For restaurant uses that may request outdoor seating, plans must be submitted to indicate areas for tables and seating capacity, areas for refuse containers, lighting plans and any associated storage areas.
   G.   For restaurant uses that may request drive-up window(s) service, a traffic study must also be included in the special use application and access lanes must meet applicable yard setback requirements.
