CHAPTER 4

ZONING DISTRICTS AND MAP

9-4-1: DISTRICTS ESTABLISHED:

In order to accomplish the purpose of this title as stated in section 9-1-2 of this title, the village is hereby divided into the following districts:
R-1
One-family residence district
R-2
One-family residence district

General residence district

9-4-2: ZONING MAP:

The boundaries of the zoning districts are established as shown on the map entitled "official zoning map of Hawthorn Woods, Illinois", which map is made a part hereof, and shall have the same force and effect as if the zoning map, together with all notations, references and other information shown thereon, were fully set forth and described herein. 9-4-3: DISTRICT BOUNDARIES:

When uncertainty exists with respect to the boundaries of the various districts as shown on the zoning map, the following rules shall apply:
   A.   District boundary lines are either the centerlines of railroads, highways, streets, alleys or easements, or the boundary lines of sections, quarter sections, divisions of sections, tracts or lots, or such lines extended unless otherwise indicated.
   B.   In areas not subdivided into lots and blocks, wherever a district is indicated as a strip adjacent to and paralleling a street or highway, the depth of such strips shall be in accordance with the dimension shown on the map measured at right angles from the centerline of the street or highway, and the length of frontage shall be in accordance with dimensions shown on the sections, quarter sections, divisions of sections, tracts or lots, or such lines extended unless otherwise indicated.
   C.   Where a lot held in one ownership and of record on the effective date hereof is divided by a district boundary line, the entire lot shall be construed to be within the less restricted district; provided, that the construction shall not apply if it increases the less restricted frontage of the lot by more than twenty five feet (25'). 9-4-4: ZONING OF PUBLIC WAYS:

All streets, alleys, public ways, waterways and railroad rights of way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting on such streets, alleys, public ways and railroad rights of way or waterways. Where the centerline of a street, alley, public way, waterway or railroad serves as a district boundary, the zoning of such areas, unless otherwise specially designated, shall be deemed to be the same as that of the abutting property up to such centerline. 9-4-5: ZONING OF ANNEXED LAND:

   A.   A petition for annexation to the village may include a request from the petitioner that the land being annexed shall, upon annexation, be zoned other than for single-family residence. Should such a request be contained in the petition, the proper authorities shall refer the matter to the plan commission to conduct a public hearing and make their recommendation. Following the recommendation of the plan commission, the board of trustees shall proceed to take a vote as they normally do in zoning matters and notify the petitioner of the result. The petitioner then may withdraw his petition for annexation or may continue unless new evidence is introduced with it if the decision is adverse to his request.
   B.   Except as modified by a valid annexation agreement or other provision authorized by law, all property, upon annexation to the village, shall be classified to R-1 one-family residence. (Ord. 381-87, 6-9-1987)

9-4-6: PLANNED UNIT DEVELOPMENTS; MULTIPLE ZONING DISTRICTS:

Notwithstanding anything in this title to the contrary, multiple zoning districts shall be permitted with respect to property that is granted a special use permit for a planned unit development. (Ord. 1079-04, 7-26-2004)
