CHAPTER 7

I INDUSTRIAL DISTRICT

9-7-1: PURPOSE:

The I industrial district is established to provide areas for industrial development of the highest quality, which can exist in harmony with residential and business areas. (Ord. 381-87, 6-9-1987; amd. Ord. 1314-10, 1-19-2010)

9-7-2: MINIMUM AREA:

The minimum area for an I industrial district is ten (10) acres. The owner of a tract of undeveloped land or land cleared for redevelopment which is designed for industrial development on the official land use plan may submit to the village plan commission 1 for its review, a preliminary plan for the use and development thereof for an I industrial district, regardless of the zoning district in which such tract is located at the time said plan is filed. 9-7-3: PERMITTED AND SPECIAL USES:

The following uses may be permitted in an industrial district:
   A.   Permitted uses:
      Any use permitted in and meeting the performance standards of chapter 13 of this title, except retail and service business uses, and except that there may be permitted the following accessory uses:
      Accessory service uses which are necessary to the conduct of the principal use.
      Medical clinics.
      Offices accessory to the principal use on a zoning lot.
      Research facilities.
      Any other accessory use approved by the village board as part of the industrial district which the board finds to be compatible with the plan and which will have no undue adverse effect upon surrounding properties. (Ord. 1312-10, 1-19-2010)
   B.   Special uses:
      Funeral homes.
      Personal wireless service (PWS) facilities. (Ord. 1312-10, 1-19-2010; amd. Ord. 1465-13, 10-21-2013)

9-7-4: CONDITIONS OF USE:

All permitted uses are subject to the following conditions:
   A.   All business, production, servicing and processing shall take place within completely enclosed buildings unless otherwise specified.
   B.   Within one hundred fifty feet (150') of a residence district, all storage shall be in completely enclosed buildings or structures and located elsewhere in this district may be open to the sky but shall be enclosed by a solid wall or fence (including solid doors or gates thereto) at least eight feet (8') high, but in no case lower in height than the enclosed storage and suitably landscaped.
   C.   However, open off street loading facilities and open off street parking of motor vehicles under one and one-half (11/2) tons' capacity may be unenclosed throughout the district, except for such screening of parking and loading facilities as may be required. (Ord. 381-87, 6-9-1987)

9-7-5: PLAN COMMISSION FINDINGS:

The plan commission shall incorporate in its report to the village board findings that the proposed project will comply with each of the following conditions:
   A.   Integrated Design: That the plan provides for an industrial district consisting of several buildings or groups of buildings of efficient and harmonious design, together with properly arranged trafficways, parking and loading facilities and landscaping, so arranged as to create an attractive project readily integrated with and having no undue adverse effect on adjoining or surrounding areas and developments.
   B.   Thoroughfares: That the industrial district shall abut a street on the official major street plan as a highway, primary or secondary thoroughfare, or that direct access to such street is provided by means of an acceptable industrial service street. (Ord. 381-87, 6-9-1987)

9-7-6: DESIGN STANDARDS AND REQUIRED IMPROVEMENTS:

The following minimum design standards shall be observed and the owner or developer shall post with the village a surety bond or furnish other kind of guarantee, satisfactory to the village board, assuring the installation at the expense of the owner or developer of improvements specified in the following:
   A.   Right Of Way And Pavements: All interior streets shall have a right of way width of not less than eighty feet (80') and any cul-de-sac terminus shall be generally circular in shape, with a minimum radius of forty six feet (46') to the centerline of the pavement, and with its center on the cul-de-sac centerline.
   B.   Utilities: All necessary utilities shall be installed meeting village specifications and the subdivision regulations of the village.
   C.   Off Street Parking: Off street parking shall be installed as required in chapter 11 of this title, except that for employee parking, one space shall be provided for each one and one-half (11/2) employees on the maximum shift. Customer or visitor parking, at least ten (10) spaces shall be provided per plant. In particular circumstances where customer or visitor parking may reasonably be expected to exceed ten (10) spaces, the village may require such additional spaces as shall be determined to be adequate to provide such parking.
   D.   Loading Facilities: Loading facilities shall be installed in accordance with chapter 11 of this title. Loading docks shall not be placed along building fronts.
   E.   Plant Vehicle Storage: Such storage shall be sufficient to accommodate all plant vehicles off the street.
   F.   Lot Area: Lot area minimum of forty thousand (40,000) square feet.
   G.   Maximum Lot Coverage: The maximum area occupied by all buildings on any lot shall not exceed forty five percent (45%) of the total area of the lot.
   H.   Yard Requirements: No building or structure shall hereafter be erected or structurally altered unless the following yards are provided and maintained in connection with such building:
      1.   Front Yard: On every zoning lot a front yard of not less than two hundred fifty feet (250') in depth shall be provided. However, where lots within the same block and comprising forty percent (40%) of the frontage on the same street are already developed on the effective date hereof with front yards with an average depth of less than two hundred fifty feet (250'), then such average depth shall be the required front yard depth for such frontage in said block.
      2.   Side Yards:
         a.   A side yard of two hundred fifty feet (250').
         b.   However, where lots have been duly recorded prior to the effective date hereof, and an industrial district lot does not exceed twenty thousand (20,000) square feet in area, side yards shall be not less than ten feet (10').
      3.   Rear Yard:
         a.   On every zoning lot there shall be a rear yard of not less than two hundred fifty feet (250').
         b.   However, where lots have been duly recorded prior to the effective date hereof, and an industrial district lot does not exceed twenty thousand (20,000) square feet in area, there shall be a rear yard of not less than ten feet (10').
   I.   Building Height Limit: The height of any structure shall not exceed three (3) stories, nor shall it exceed forty five feet (45'), except as provided herein.
   J.   Distance Between Buildings: Distance between principal buildings, fifty feet (50'); distance between accessory structures, twenty feet (20').
   K.   Reserved.
   L.   Landscaping Of Unsurfaced Areas: All unpaved areas shall be landscaped subject to village board approval.
   M.   Greenbelts: The I industrial district area shall be enclosed on all sides adjacent to a residential district by a planted strip at least fifty feet (50') wide. The plant material, subject to village board approval, shall have initially a height and density of not less than fifty percent (50%) of the ultimately required height and density.
   N.   Illumination: Exterior lighting fixtures shall be so installed in accordance with the provisions outlined in Section 9-12 ans Section 9-19. (Ord. 381-87, 6-9-1987; amd. Ord. 1021-03, 4-21-2003; Ord. 1314-10, 1-19-2010; Ord. 1965-19, 9-23-2019)

9-7-7: FINAL DEVELOPMENT PLAN:

   A.   Submission Of Plan: Upon recommendation of the plan commission and approval of the village board that the proposed I industrial district, as shown in the preliminary plan, appears to conform to the requirements herein and all other applicable requirements of this title, the proponents shall submit a final development plan.    B.   Recommendation To Village Board Of Trustees: When the preliminary plan has been reviewed and comments incorporated, the plan commission shall submit said plan with its report and recommendation to the village board. After village board approval of the preliminary plan, a public hearing on both the plan and the proposed change in zoning district classification shall take place: 1) a public notice shall be published as per standard village procedure, and 2) all preliminary plan documents shall be on file for public inspection in the village clerk's office. When the final plan is found to be in compliance with the requirements herein, the plan commission shall submit said plan with its report and recommendation to the village board.
   C.   Final Board Action: The village board may modify the plan consistent with the intent of this title and make such other changes as it may deem appropriate prior to final approval.
   D.   Adjustments: After the final development plan has been approved by the village board and in the course of carrying out the plan, minor adjustments in rearrangements of buildings, service areas and other features requested by the developers shall be reviewed by the plan commission and recommendation submitted to the village board for approval.
