SECTION 3

Area regulations.

(1)

Front Yard.

(a)

There shall be a landscaped front yard on lots containing dwelling units having a minimum depth of 30 feet.

(b)

No structure shall be located in the front yard unless as an element of permissible landscaping.

(c)

No off-street parking shall be allowed in any front yard area. However, drives of ingress and egress from the public street to a parking area shall be allowed to cross the front yard from front to rear.

(2)

Side Yard. There shall be a side yard distance of 30 feet from the side lot line to the nearest foundation.

(3)

Rear Yard. Where such rear yard exists, there shall be a rear yard distance of 30 feet from the rear lot line to the nearest foundation.

(4)

Unusable Land Areas. No pond, creek or other unusable terrain shall be changed without the approval of such plans by the Planning and Zoning Commission. All required setback areas shall be measured from the edge of the usable land available for development as determined by the planning and zoning commission. Such unusable land areas shall be planned as open greenbelt area to the maximum extent possible.

(5)

Overhang And Fireplaces. The maximum setback requirements shall apply in all cases, except that fireplaces, eaves, bays and balconies may extend up to a maximum of three and one-half feet into the required front, side or rear yard.

(6)

Width of Lot. The minimum width of the lot shall be 200 feet throughout the depth of the lot from front to rear.

(7)

Depth of Lot. The minimum depth of lot shall be not less than 200 feet.

(8)

Area of Lot. Every lot shall have an area of not less than two acres.

(9)

Coverage.

(a)

The average minimum floor area per apartment living unit shall not be in the aggregate less than 850 square feet. Outside walls shall be constructed of Standard Masonry construction.

(b)

There shall be a cumulative minimum space area of 2,700 square feet of space for each apartment living unit in apartment buildings.

(c)

In no event shall the number of dwelling units exceed 16 units per acre, exclusive of all public street right-of-ways, alleys and parking areas, but inclusive of open space, recreational and service areas.

(d)

For each lot platted for a single-family dwelling, the regulations set forth in the SF-3 Residential District shall be applicable.

(10)

Height Regulations. No apartment building shall exceed two standard stories in height, but in no case more than 30 feet; provided the Town Council, after receiving a recommendation from the Planning and Zoning Commission, may grant a special permit in excess of the above, subject to appropriate safeguards and conditions.

(11)

Refuse and Waste Storage. Refuse and waste storage areas shall conform to standards as required by this ordinance herein.

(12)

Access. Alleys may be used for ingress and egress to parking and service areas; provided a minimum paved alley width of 20 feet is provided from a street to the parking or service area. Such ingress and egress shall be approved by the planning and zoning commission, giving consideration to adjacent properties and appropriate screening.

(13)

Parking Regulations.

(a)

Off-street parking space shall be provided behind the front building line in the side or rear yard of the lot or tract of land upon which an apartment building is constructed in accordance with the following requirements:

(1)

Adequate off-street parking space shall be provided to meet the requirements of the residents and their guests in each apartment project with a minimum of two parking spaces for each living unit.

(b)

Every apartment lot or parcel of land used as guest or private parking area shall be developed and maintained in the following manner:

(1)

Surface of Parking Area: Off-street driveways and parking areas shall be curbed, paved and maintained to Town of Hickory Creek, Texas specifications.

(c)

No parking area or vehicle storage space shall be used for the storage or parking of any vehicle in excess of one and one-half ton capacity.

(14)

Fire Lanes. There shall be a fire lane of not less than 24 feet in width within 50 feet of every building served. This shall be on at least one side of the building and cannot be obstructed.
