The Manufactured Home Residential District (MH) is a special and unique zoning district which will be appropriate to smaller lots in relatively few areas of the city. The uses in the MH district are envisioned to be primarily single-family detached dwellings. Due to the age, previous platting, and subdivision patterns, and location of these areas, they contain a variety of residential types and uses. This district allows manufactured homes on individual lots and certain other dwelling types. Most of the areas zoned for MH already have a high percentage of mixed residential uses. The use of this district is limited predominantly to areas platted and containing a variety of residential uses.
All uses permitted in a SF-2 zoning district with the addition of: temporary purposes to allow the owner of a tract or lot of land to place a manufactured home during the construction of a permanent dwelling, not to exceed 365 days.
(a) One manufactured home or principal building is allowed per lot in the Manufactured Home Residential District (MH).
(b) Any lot or property located in the Manufactured Home Residential District (MH) shall not be subdivided, in any way without written approval of both the city planning and zoning commission and the city council in accordance with the provisions of the city's zoning ordinances.
(c) All lots or property with a street frontage address located in a non-manufactured home zone residential district shall not have manufactured home on that property or lot, even if that property or lot extends to other property owned by the same owner that is located in a lot that is within a Manufactured Home Residential District (MH). The address will define the zone.
(d) Any person or corporation violating any of the provisions of this section shall, upon conviction, be fined any sum not exceeding $1,000.00 for each and every day that the provisions of this section are violated and each violation shall constitute a separate and distinct offense. In addition to the penalty provided for, the right is hereby conferred and extended upon any property owner owning property in any district, where such property owner may be affected or invaded, by a violation of the terms of this section, to bring suit in such court or courts having jurisdiction thereof and obtain such remedies as may be available by law and equity in the protection of the rights of such property owners.
Sec. 46-224. Building regulations for nonresidential uses.
The building regulations for nonresidential uses in the Manufactured Home Residential District (MH) are as follows:
(1) Temporary buildings and buildings for agricultural purposes shall be a maximum size of 500 square feet.
(2) Nonresidential principal buildings shall be a minimum size of 1,000 square feet.
(3) Nonresidential uses in this district, with the exception of parks, shall be located on a corner lot with driveway access directly onto a collector or arterial street.
(4) No residential dwelling shall be constructed or moved into the district which contains less than 1,000 square feet within the living area except for manufactured homes.
Sec. 46-225. Regulations specific to this district.
The regulations specific to this Manufactured Home Residential District (MH) are as follows:
(1) All manufactured homes shall be securely tied down, blocked and completely skirted prior to occupancy as provided in the installation standards adopted pursuant to V.T.C.A., Occupation Code §§ 1201.251 and 1201.252.
(2) All manufactured homes in the city shall comply with all regulations of the state.
(3) Domestic animals over the age of six months shall be limited to three per species and a total of six per household.
(4) Open storage is prohibited, (except for materials for the resident's personal use or consumption i.e., firewood, gardening materials, etc.).
(5) No temporary structures, such as recreational vehicles, travel trailers, construction trailers, or mobile homes may be used for on-site dwelling purposes.
(6) Duplex, patio home, and townhouse dwellings permitted conditionally in this district shall conform to standards as specified in article XXIV of this chapter.
