Two-family and multiple-family dwellings, where permitted, may be constructed upon the same lot, or upon separate lots to provide for separate or divided ownership, as follows:
1. Where constructed upon the same lot, two-family dwellings or multiple-family dwelling shall be considered as one building occupying one lot for purposes of determining applicable yard and area requirements.
2. Two-family dwellings and multiple-family dwellings may be constructed upon separate lots to provide for separate or divided ownership of laterally connected dwelling units, subject to the following requirements:
A. Each laterally connected dwelling unit shall have separate access and separate utility services including without limitation gas, water, sewer, and electricity.
B. Whether initially constructed on separate lots or subsequently subdivided for purposes of establishing separate or divided ownership, each lot upon which a laterally connected two-family dwelling or laterally connected multiple-family dwelling is situated shall satisfy all applicable yard and lot area requirements, provided that side yard setbacks shall not apply where laterally connected dwelling units meet. Further, for purposes of determining compliance with applicable yard and lot area requirements, laterally connected dwellings on separate lots shall be considered as one building occupying one lot.
C. Each lot upon which a laterally connected two-family dwelling or multiple-family dwelling is situated shall be subject to restrictive covenants of record with the Jackson County Recorder providing for the joint and uniform maintenance and repair of the common wall(s) and all exterior portions of the attached dwellings including but not limited to the roofs, siding, trim, doors, driveways, sidewalks, and gutters and downspouts, so as to ensure a consistent and uniform appearance. Copies of such restrictive covenants, as proposed, shall be submitted together with the owner’s preliminary plat and/or final plat for review pursuant to applicable subdivision regulations.
