ARTICLE XII

Exceptions And Modifications

Section 405.590 General.

A. 
The regulations specified in this Chapter shall be subject to the following exceptions and modifications:
1. 
Area Requirements. In any district, where neither public water supply nor public sanitary sewer is available, the lot area requirements shall be twice the square feet minimum stated in the yard requirements of each district, and lot widths at the building line shall be twice the requirements within each district. Where either public water supply or sanitary sewer is accessible, the stated requirements within each district shall prevail. The area requirements shall be subject to an application for a variance submitted to the Board of Adjustment.
2. 
Double Frontage Lots. Buildings on through lots and extending through from street to street, shall provide the required front of a variance issued by the Board of Adjustment.
3. 
Exceptions To Prohibited Uses. The Board of Aldermen of the City may after a public hearing conducted by the Planning and Zoning Commission, authorize the location of any of the following buildings or uses in any district from which they are not authorized or prohibited by this Chapter.
a. 
Any public building erected and used by any department of the City, County, State, or Federal Government.
b. 
Airport or landing field.
c. 
Community building or recreation field.
d. 
Country clubs and golf courses.
e. 
Public and private cemeteries.
f. 
Other uses that may be deemed beneficial to the City and are not contrary to the spirit of this Zoning Ordinance overall.
4. 
Utilities. Existing utilities may continue to be operated and maintained in dwelling and commercial districts, but no new utility other than the usual poles, wires, and underground conducts shall be established in such districts, except when so authorized by the Board of Aldermen after review by the Planning and Zoning Commission.
5. 
Fences. In any residential district, no fence, structure, or planting shall be maintained within thirty (30) feet of any corner lot street line intersection, which would impair the sight distance of the operator of a motor vehicle, as determined by the Zoning Administrator.
