SECTION 240

OFF-STREET PARKING AND TRUCK LOADING SPACE REQUIREMENTS AND REGULATIONS.

240-20 - Schedule of Off-Street Parking Space Requirements for Residential Uses.

Parking requirements in the A-2, OP, RO, B-3, CBD, ARUD, TOD-EM-1, TOD-EM-2, TOD-ES-1, and TOD-ES-2 districts shall supersede the off-street parking requirements for residential uses in this section. [Approved 10-3-24, Item #36535-3]

240-30 - Schedule of Off-Street Parking Space Requirements for Nonresidential Uses.

Parking requirements in the TOD-EM-1, TOD-EM-2, TOD-ES-1, and TOD-ES-2 districts shall supersede the off-street parking requirements for nonresidential uses in this section. [Approved 10-3-24, Item #36535-3]

240-40 - Off-Street Truck Loading Space Requirements.

In nonresidential districts, off-street truck loading spaces shall be required in accordance with the following schedule:

Under 40,000 sq. ft. 1 space
40,000 sq. ft. or more. 1 additional space for each 40,000 sq. ft. in addition to the first 40,000 sq. ft. up to a maximum, of 4 additional spaces

 

240-10-10

The requirements for a simple use (e.g. a one family dwelling or a retail store shall be determined directly from the schedule of such requirements which is a part of this section, except as provided in Section 240-10-60.

240-10-20

The requirement for a combination use made up of several component uses e.g. a bowling alley combined with auditorium and a restaurant and bar, or a retail store combined with office building) shall be determined by establishing the requirements for each component use from the schedule of such requirements which is a part of this section, and adding them together.

240-10-30

When the required number of spaces is determined to result in a fractions, it shall be increased to the next highest whole number.

240-10-40

If the use is not specifically listed in the schedule of such requirements, the requirement shall be the same as for the most similar listed use.

240-10-50

Uses which require approval pursuant to the special exception use procedure set forth in Section 270-40 may be required to provide off-street parking spaces in excess of the requirements of this section as indicated in Section 270-40-30.80.

240-10-60

240-50-10

Accessory private garages shall not be designed for rental of parking spaces to persons living off the premises.

240-50-20

Not more than one parking space per dwelling unit may be rented to persons living off the premises in the case of single or two family dwelling uses, nor more than one parking space per each two dwelling units may be rented to persons living off the premises in the case of any other residence use.

240-50-30

Not more than one commercial vehicle shall be housed or parked in a private garage or off-street parking area. Such commercial vehicle shall not exceed a gross motor vehicle weight of 10,000 pounds. Such commercial vehicle shall also not exceed thirty feet in length and eight feet in height. [Approved 4-12-00, Item #24826-2]

240-50-35

No motorhome, camper, trailer or other similar personal use vehicle that exceeds eight (8) feet in height or 24 feet in length may be parked in a front yard area in any residential, RO or OP zoning district. Such motorhome, camper, trailer or other similar vehicle may be parked within a rear yard area on a private residential property, provided that it is not parked within 5 feet of any neighboring property line. No motorhome, camper, trailer or other such vehicle that is not owned by the property owner may be kept on any residential, RO or OP zoned property. [Approved 8-29-06, Item #29091-2]

240-50-40

Parking in the required front yard in the S-1, S-2, S-3, T, and is prohibited except within a single driveway with a maximum width of twenty (20) feet; except that any front yard paved parking lot not in conformance with this section, but in existence prior to the effective date of this section, is allowed to continue in its original configuration. 240-50-50

240-60-10

Access driveways for parking garages, public parking areas, motor vehicle fueling stations, motor vehicle repair garages or trucking stations may have separate or combined entrances and exits. [Approved 4-18-17, Item #33769-3]

240-60-20

Every entrance or exit driveway shall have a minimum unobstructed width of ten (10) feet. Every combined entrance and exit driveway shall have a minimum unobstructed width of twenty (20) feet, for parking in excess of 10 spaces. [Approved 2-21-86, Item #17164-1]

240-60-30

In all Districts, the intersection of entrance or exit driveways with the public street shall have the same corner clearances as prescribed for intersecting streets in Section 230-70. [Approved 3-28-08, Item #29947-2]

240-60-40

Unless subject to Section 240-50-40, parking in the required front yard shall be prohibited for any property solely used as a residential use unless within a driveway or driveways with a maximum width of twenty (20) feet, except that any front yard paved parking lot not in conformance with this section, but in existence prior to the effective date of this section, is allowed to continue in its original configuration. 240-60-50

No more than forty (40) percent of a property line, abutting a street, shall be curb cut. [Approved 10-21-25, Item #36885-3]

240-70-10

All accessory off-street parking and truck loading areas shall be located in accordance with the provisions of Section 230-10.

240-70-20

The physical improvements of off-street parking and truck loading areas shall include:

240-70-30

In all Districts, all aisles within parking areas shall have a minimum width of 24 feet when the parking spaces are a 90 degree angle with the driveway; 18 feet when the parking spaces are at 60 degrees; and 16 feet when the parking spaces are at 45 degrees. [Approved 3-28-08, Item #29947-2]

240-70-40

Aisles and turning areas shall have adequate radii to assure ease of mobility, ample clearance, and convenient access and egress.

240-70-50

In all Districts, centerline gradients of aisles shall not exceed 8 per cent. [Approved 3-28-08, Item #29947-2]

240-70-60

In all Districts, accessory off-street parking areas shall be marked off into parking spaces with a minimum width of nine (9) feet, and minimum length of 18 feet; or, in the case of parking spaces for trucks or special equipment, parking spaces of a minimum size to be determined by the City Engineer based on the nature of the parked vehicles. 240-70-70

In all Districts, an accessory off-street truck loading space shall have a minimum width of 10 feet, a minimum length of 25 feet, and a minimum clear height of 14 feet. The related aisle shall have the same minimum width and clear height. [Approved 3-28-08, Item #29947-2]

240-70-80

Except in the B-1R and the S1, S2, S3, T, T-6, A1, A2 and A3 residential districts, accessory off-street parking areas may have 33% of their total amount of parking spaces designated for compact cars. The designated compact car parking spaces must have a minimum width of 7.5 feet and a minimum length of 15 feet. The minimum width of the parking aisle shall be 18 feet. In addition, the compact car parking area must be clearly marked for compact cars and physically set apart from the standard parking areas. Site plan designs for compact cars parking shall be approved by the Director of City Planning before a building permit can be issued. [Approved 6-21-84, Item #16242-1]

240-70-90

In all districts, all parking spaces, loading facilities, and access roadways for all uses shall be improved to the standards established by the City Engineer and shall have a durable all-weather surface of asphalt, bituminous, cement or other properly bound pavement that will inhibit dust. [Approved 12-18-24, Item #36630-3]

240-70-100 - Landscaping Requirements. [Approved 3-25-13, Item #32144-2; Amended 12-18-24, Item #36631-3]

The intent of these landscaping requirements is to provide a buffer between parking areas and adjoining public streets, sidewalks, land uses and buildings; to aid in filtering and controlling stormwater runoff; direct safe on-site vehicular and pedestrian movement and to provide a high quality aesthetic setting for development. These regulations relate to any proposed parking areas of twenty-five (25) or more parking spaces or any major modification of any existing parking lots involving fifty (50) or more parking spaces. These requirements do not negate or supersede any other transitional yard, setback or buffer requirements for driveway or parking lot paving contained elsewhere in these ordinances. These requirements represent the minimum acceptable landscaping standards; higher quality landscaping is encouraged. All landscaping plans shall be prepared by a qualified design professional and done in accordance with good professional standards. [Amended 12-18-24, Item #36631-3]

240-70-110 - General Landscaping Requirements. [Approved 12-18-24, Item #36631-3]

The following requirements apply to all new parking areas or any major modification of any existing parking lots involving twenty-five (25) or more parking spaces. [Approved 12-18-24, Item #36631-3]

240-70-120

Tandem or stacked parking may be permitted for residential uses where tandem spaces are assigned to the same dwelling unit and meet access requirements. [Approved 10-21-25, Item #36885-3]

240-70-130

Off-street parking requirements for non-residential uses may not utilize tandem or stacked parking. [Approved 10-21-25, Item #36885-3]

240-80-10 - Existing buildings and uses are exempt:

The provisions of this section shall not apply to any building or structure or lot lawfully in use at the effective date of this ordinance, whether continued as a permitted or legal nonconforming use, or thereafter converted or changed without enlargement to a different lawful use having the same parking and truck loading requirements.

240-80-20

The off-street parking space requirements stipulated in this section shall be automatically waived for parcels located within a Municipal Parking District having a lot size of less than one (1) acre, except for residential uses, which shall be provided in accordance with this section. Said District shall be established by the City Plan Commission, with the approval of the Common Council and the bounds thereof may be amended by action of those bodies from time to time. 240-80-30

The Zoning Board of Appeals, subject to the applicable provisions of Section 270-50, may waive the requirements, in whole or in part, for the off-street parking or truck loading spaces stipulated in this section.

240-80-40

Waiver of Immediate Installation. [Approved 8-20-12, Item #31921-2]

Upon a request made by the property owner or authorized agent, for non-residential properties with a calculated parking requirement of two hundred fifty (250) or more spaces, the City Plan Commission may waive the immediate installation of a portion of the required parking spaces, up to twenty (20) percent of the total, subject to the following:

i.

That the parking plan submitted to the Commission depict the full parking requirement and identify those spaces for which waiver of immediate installation is sought;

ii.

That upon reviewing data and evidence provided by the applicant, the Commission finds the number of parking spaces planned for immediate installation to be adequate for the development; and

iii.

That all parking area(s) held in reserve be planted with grass and appropriately landscaped.

240-70-20.10

Curbs, paving, sidewalks and drainage facilities complying with the standards established in the ordinances of the City of New Britain and such additional standards as the City Engineer shall require.

240-70-20.20

Adequate lighting in public parking areas to assure the general safety and convenience of the public.

240-70-20.30

Appropriate screening for the protection of adjacent properties particularly along District boundary lines as provided for in Section 230-110.

240-70-100.10

A minimum of twenty (20) percent of the parking area shall be landscaped open space, which may be provided in the form of landscaped islands, planting strips, landscaped stormwater retention features, buffer areas or suitable areas of preserved natural vegetation. [Amended 12-18-24, Item #36631-3]

240-70-100.20

Landscaped "end-cap" islands at the end of a row of parking shall be a minimum width of nine (9) feet by eighteen (18) feet in depth. End cap islands shall be required at every entrance and, as a minimum, at the end of every other row or double row of parking stalls. [Amended 12-18-24, Item #36631-3]

240-70-100.30

Each landscaping strip shall be planted with a mix of shrubs and up-right deciduous trees. Deciduous trees shall be spaced at between thirty (30) to fifty (50) feet on center and shrubs planted either clustered or spaced at a rate of no less than five (5) shrubs for every forty (40) lineal feet of landscape strip. Each landscaped "end-cap" island shall contain at least one (1) deciduous tree and two (2) shrubs. In locations where deciduous up-right trees interfere with safe sight-line, additional shrubs may be substituted. [Amended 12-18-24, Item #36631-3]

240-70-100.40

Planting and landscaped buffer strips along the side and rear yard property lines shall include a mix of shrubs and up-right evergreen and deciduous trees, as appropriate, to serve the desired buffering and screening function. [Amended 12-18-24, Item #36631-3]

240-70-100.50

Slotted curbs are encouraged on landscaped "end-cap" islands to allow stormwater runoff into islands, and proper island design to infiltrate runoff. [Approved 12-18-24, Item #36631-3]

240-70-100.60

On-site storage of stormwater shall be employed to the maximum extent feasible. On-site storage methods include, but are not limited to, landscaped depressions, grass swales, infiltration trenches, and retention or detention basins. [Approved 12-18-24, Item #36631-3]

240-70-100.70

In situations in which a waiver of immediate installation of parking per Section 240-80-40 is requested, a detailed plan shall be provided for review by the Commission, depicting proposed landscaping for the area held in reserve for future parking installation. Said plan shall include an attractive mix of trees and shrubs and appropriate ground cover and shall be reasonably accessible for maintenance. [Amended 12-18-24, Item #36631-3]

240-70-110.10

A minimum of a five-foot wide landscape buffer shall be provided between all parking lots and the front and side lot lines of the property. This landscaped area shall be surfaced with lawn or other aesthetically suitable ground cover. [Approved 12-18-24, Item #36631-3]

240-70-110.20

Any portion of a parking area not used for parking, circulation, or emergency access, must be landscaped. [Approved 12-18-24, Item #36631-3]

240-80-20.10

Within the Municipal Parking District, existing parking facilities no more than one thousand (1,000) feet from a site may be used to satisfy the off-street parking requirements. Documents, including a lease agreement or easement, shall be submitted with a zoning permit application to assure the adequacy of such additional or substitute parking facilities during the use of the premises and all successors.

If the use of the premises is changed, enlarged or extended by a subsequent user, such subsequent user will provide off-street parking in accordance with Section 240-80-20 subject to approval of a new zoning permit. [Approved 11-20-24, Item #36582-3]
