District
The purpose of the Agricultural Urban Reserve District is to protect agricultural lands and enterprises from urban growth pressures and to discourage premature division of agricultural land within the City while allowing rezoning of such lands to the appropriate residential designations as established in the Nooksack comprehensive land use plan without requiring an amendment to the comprehensive plan.
There is hereby established an Agricultural Urban Reserve District and the standards and regulations by which certain uses may be permitted therein. [Ord. 659 §6, 2012; Ord. 195 §5, 1980.]
The purpose of the Agricultural Urban Reserve District is to protect agricultural lands and enterprises from urban growth pressures and to discourage premature division of agricultural land within the City while allowing rezoning of such lands to the appropriate residential designations as established in the Nooksack comprehensive land use plan without requiring an amendment to the comprehensive plan. The uses permitted within the Agricultural Urban Reserve District are as follows:
A. Agricultural uses.
B. Uses accessory to agricultural uses.
C. One single-family dwelling per legal lot of record.
D. Public utilities. [Ord. 659 §8, 2012; Ord. 195 §7, 1980.]
The following conditional uses may be permitted within the Agricultural Urban Reserve District by the City Council upon application and in accordance with Chapter 19.56:
A. Other uses not explicitly called out in NMC 19.20.030 but that are consistent with the purpose of the district. [Ord. 659 §9, 2012.]
The following minimum size requirements shall be applicable to permitted uses within the Agricultural Urban Reserve District:
A. Minimum Lot Size. Division of land within the Agricultural Urban Reserve District is prohibited except where the City Council determines that such division is necessary to support a public purpose.
B. Setbacks. Setbacks shall be as follows:
1. Front: Twenty feet (20'), except that the front setback shall be increased to 25 feet adjacent to an arterial street.
2. Side: Seven and one-half feet (7-1/2'), except that the side setback shall be increased to 20 feet for corner lots.
3. Rear: Ten feet (10'). [Ord. 659 §10, 2012.]
The maximum building height in the Agricultural Urban Reserve District is thirty feet (30'). [Ord. 659 §11, 2012.]
