19.26 Central

Market District

The purpose of the Central Market District is to allow for pedestrian-oriented commercial activities to occur in a centralized area separate from, yet in close proximity to, residential areas consistent with the goals and policies of the Comprehensive Plan and the Community Action Plan.

19.26.010 Central Market District – Established.

There is hereby established a Central Market District and the standards and regulations by which certain uses may be permitted therein. [Ord. 539 §2, 2001.]

19.26.020 Central Market District – Purpose.

The purpose of the Central Market District is to allow for pedestrian-oriented commercial activities to occur in a centralized area separate from, yet in close proximity to, residential areas consistent with the goals and policies of the Comprehensive Plan and the Community Action Plan. [Ord. 539 §2, 2001.]

19.26.030 Central Market District – Permitted Uses.

The uses permitted outright within the Central Market District are as follows:

A. Retail stores and shops or services;

B. Barbers and beauty shops;

C. Craft shops;

D. Cleaning and laundry agencies, laundromats;

E. Dance, music and voice studios;

F. Financial institutions;

G. Florists, Nurseries;

H. Furniture outlets;

I. Grocery stores, delicatessens, bakeries;

J. Open air markets, farmers' markets

K. Offices – dental, insurance legal, medical, real estate;

L. Photographic studios;

M. Pharmacies;

N. Printing, blueprinting, publishing;

O. Public and community facilities including police and fire stations, libraries, community centers and other related uses;

P. Indoor public or private recreational facilities;

Q. Residential units accessory to other permitted uses;

R. Restaurants, food stands, bars;

S. Other pedestrian-oriented commercial activities that are consistent with the purpose of the district;

T. Uses or structures that are accessory to other permitted uses. [Ord. 539 §2, 2001.]

19.26.040 Central Market District – Conditional Uses.

The following conditional uses may be permitted within the Central Market District by the City Council upon application and in accordance with Chapter 19.56:

A. Churches;

B. Hotels, motels;

C. Laboratories medical, dental, optical;

D. Private recreational facilities;

E. Vehicle repair shops;

F. Uses not explicitly called out in NMC 19.26.030 or 19.26.040 that are similar in character, size and impact and that are consistent with the purpose of the district. [Ord. 539 §2, 2001.]

19.26.050 Central Market District – Lot and Setback Requirements.

The following minimum size requirements shall be applicable to permitted uses within the Central Market District:

A. Minimum Lot Size: The minimum lot size shall be determined by the City Council for each applicant.

B. Front Setback: Five feet (5').

C. Rear Setback: Ten feet (10')

D. Side Setback: Five feet (5'); zero feet (0') by Conditional Use. [Ord. 539 §2, 2001.]

19.26.060 Central Market District – Building Height Restrictions.

The maximum building height in the Central Market District is thirty-five feet (35'). [Ord. 539 §2, 2001.]

19.26.070 Central Market District – Off-Street Parking and Traffic Requirements.

A. Off-Street Parking Spaces. Each commercial use shall provide not less than one (1) off-street parking space for every two (2) employees, plus such additional spaces as may be required in Chapter 19.44. Off-street parking shall be provided in the rear and shall not decrease available store frontage.

B. Parking Lot Design. Design of parking lots providing ten (10) or more spaces shall conform to the design standards of Chapter 19.44.

C. Screening. Parking lots providing twenty (20) or more spaces shall comply with the screening requirements of Chapter 19.44.

D. Turnarounds. The City Council may require that commercial uses whose front lot line abuts a designated arterial provide approved on-site turnarounds. [Ord. 539 §2, 2001.]

19.26.080 Central Market District – Street and Sidewalk Requirements.

A. Planter Boxes. Planter boxes or tubs approved by the City Council shall be provided, planted and maintained along all street frontage.

B. Sidewalks. The City Council may require the installation or repair of sidewalks, in accordance with City standards, prior to issuance of any building permit. [Ord. 539 §2, 2001.]

19.26.090 Central Market District – Supplemental Design Standards.

Permitted uses in the Central Market District shall comply with the Central Market District Supplemental Design Standards, once adopted. Prior to adoption of such Standards, permitted uses shall conform to any additional design requirements established by the City Council upon application. [Ord. 539 §2, 2001.]
