19.22 Open

Space / Agriculture District

The purpose of the Open Space / Agriculture District is to limit development on lands impacted wholly or in large measure by sensitive environmental features, such as wetlands and floodplains, or natural hazard areas, such as lands impacted by sediment containing naturally occurring asbestos carried and deposited by the Sumas River, where urban development has the potential to adversely impact such sensitive environmental features or pose a threat to public health and safety and where uses other than open space and agriculture would be inappropriate. It is also the purpose of the district to establish open space corridors within and between urban growth areas and adjacent to agricultural lands of long-term commercial significance.

19.22.010 Open Space / Agriculture District – Established.

There is hereby established an Open Space / Agriculture District and the standards and regulations by which certain uses may be permitted therein. [Ord. 659 §12, 2012.]

19.22.020 Open Space / Agriculture District – Purpose.

The purpose of the Open Space / Agriculture District is to limit development on lands impacted wholly or in large measure by sensitive environmental features, such as wetlands and floodplains, or natural hazard areas, such as lands impacted by sediment containing naturally occurring asbestos carried and deposited by the Sumas River, where urban development has the potential to adversely impact such sensitive environmental features or pose a threat to public health and safety and where uses other than open space and agriculture would be inappropriate. It is also the purpose of the district to establish open space corridors within and between urban growth areas and adjacent to agricultural lands of long-term commercial significance. 19.22.030 Open Space / Agriculture District – Permitted Uses.

The uses permitted within the Open Space/Agriculture District are as follows:

A. Agricultural uses.

B. Uses accessory to agricultural uses.

C. Public parks, open space and low-impact recreational areas.

D. Public utilities. [Ord. 659 §12, 2012.]

19.22.040 Open Space / Agriculture District – Conditional Uses.

The following conditional uses may be permitted within the Open Space / Agriculture District by the City Council upon application and in accordance with Chapter 19.56:

A. One single-family residence per legal lot of record on parcels greater than five (5) acres in area where impacts to critical areas and risks from natural hazards are mitigated to the maximum extent practicable.

B. Private open space and low-impact recreational uses.

C. Other uses not explicitly called out in NMC 19.22.030 or 19.22.040 but that are consistent with the purpose of the district. [Ord. 659 §12, 2012.]

19.22.050 Open Space / Agriculture District – Lot and Setback Requirements.

The following minimum size requirements shall be applicable to permitted uses within the Open Space / Agriculture District:

A. Minimum Lot Size. Division of land within the Open Space / Agriculture District is prohibited except where the City Council determines that such division is necessary to support a public purpose.

B. Setbacks. Setbacks shall be as follows:

1. Front: Twenty feet (20'), except that the front setback shall be increased to 25 feet adjacent to an arterial street.

2. Side: Seven and one-half feet (7-1/2'), except that the side setback shall be increased to twenty feet (20') for corner lots.

3. Rear: Ten feet (10'). [Ord. 659 §12, 2012.]

19.22.060 Open Space / Agriculture District – Building Height Restrictions.

The maximum building height in the Open Space / Agriculture District is thirty feet (30'). [Ord. 659 §12, 2012.]
