HILLSIDE PROTECTION ZONES HP-1, HP-2, HP-31

11-12-1: PURPOSE

  1. The principal purpose of the hillside protection zones are to allow for the reasonable use and development of the hillside land in the City while promoting the public health, safety, convenience and general welfare of the citizens. These standards are to help maintain the character, identity, and image of the City. These zoning districts implement the "North Ogden City North Hillside Development Study".
  2. To meet these objectives, it is necessary during planning and implementation of development activities to give consideration to the following: 1) conservation of the natural environmental function of the site; 2) compatibility with the surrounding land; 3) stabilization of hillsides, slopes or other areas subject to erosion or mass movement; and 4) preservation of the natural capacity of drainage courses and protection of natural drainageways.

11-12-2: PERMITTED USES

Uses permitted in the HP-1, HP-2 and HP-3 zoning districts shall be limited to the following:

  1. Accessory buildings. See 11-9M-8.
  2. Accessory Dwelling Units. See 11-9M-9.
  3. Agriculture subject to County Health regulations and CCNO 5-3, Sound Regulations.
  4. Attached Dwelling Units. See 11-13.
  5. Places of worship.
  6. Cemeteries.
  7. Daycare. See CCNO 11-9M-13.
  8. Educational institutions, public schools, public playgrounds and recreational areas.
  9. Golf course, except miniature golf.
  10. Home occupations. See 11-14.
  11. Household pets.
  12. One single-family dwelling per lot or parcel.
  13. Preschool. See CCNO 11-9M-13.
  14. Private Park, playground or recreation areas. See 11-9M-17.
  15. Public buildings, public parks, recreation grounds and associated buildings. See 11-9M-18.
  16. Public utility substation or water storage reservoir developed by a public agency. See 11-9M-19.

(1) Buildings that meet the design standards requirements in 11-9M-8: a building up to 10’ tall may be 3’ from the property line. Beginning at 5’ from the property line, an increase in building height beyond 10’ is permitted at a 1:1 ratio up to a maximum building height of 25’. Rooflines may exist within the vertical envelope created by the 1:1 ratio of building height and setback.
