ARTICLE XVIII

Amendments

§ 125-81 Procedure.

A. 
The Town Board may from time to time, on its own motion or on petition or on recommendation of the Planning Board, amend, supplement or repeal the regulations and provisions of this chapter.
B. 
At least 30 days before taking final action on any such proposed amendment or change, the Town Board shall transmit a copy of such proposed amendment or change to the Planning Board of the Town of Owego. In the event that the Planning Board of the Town of Owego fails to make a report to the Town Board in connection with any such application or other matter transmitted to it, within said 30 days, then and in such event it shall be deemed that such Planning Board shall have given its consent to such appeal or application. If the Planning Board recommends against enactment of any proposed amendment or change, such amendment or change shall become effective only by a favorable vote of four members of the Town Board. C. 
The Town Board, at a stated meeting, shall fix the time and place of a public hearing on the proposed amendment and shall cause notice to be given as follows:
(1) 
By publishing a notice once in at least one newspaper of general circulation in such Town, at least 10 days prior to the date of such public hearing.
(2) 
By mailing a notice thereof to every association of residents of the Town which shall have registered its name and address for this purpose with the Town Clerk. The notice shall state the general nature of the proposed amendment.
D. 
Whenever the owners of 51% or more of the street frontage in any district or any specified part thereof shall present to the Town Board a petition duly signed and acknowledged, requesting an amendment, supplement, change, modification or repeal of the regulations prescribed for the Zoning Maps, including said district or specified part thereof, it shall be the duty of the Town Board to hold a public hearing thereon and to cause notice thereof to be given in the manner prescribed above.
