Perryville City Zoning Code

The regulations set forth in this chapter, or set forth elsewhere in this title and referred to in this chapter, are the regulations of the R-4 high-density residential district. The purpose of the R-4 high-density residential district is to provide for compact residential development, including multi-family housing, with provisions for adequate light, air, and open space. For a general listing of uses, see land use table in Chapter 17.34 Use Regulations.

In addition to the specific requirements for the R-4 high-density residential district, all height, area, and lot size regulations and exceptions set forth in Chapter 17.36, as they apply to uses in the R-4 high-density residential district, shall be observed.

A.

Height. The maximum height of buildings permitted shall be as follows:

1.

Detached single-family dwellings, attached single-family dwellings, and two-family dwellings: thirty-five (35) feet and not over two and one-half stories.

2.

All other buildings: forty-five (45) feet and not over three stories, except that towers or steeples on churches or similar places of worship may not exceed seventy-five (75) feet.

B.

Area. No building or structure shall be erected or enlarged, unless the following yards are provided and maintained in connection with such building, structure, or enlargement:

1.

Front Yard. Each lot upon which a building is constructed shall have a front yard of not less than twenty-five (25) feet.

2.

Side Yard. Each lot upon which a building is constructed shall have a side yard on each side of not less than five feet, except that any building two stories or more shall have a side yard on each side of not less than ten feet. For attached residential units, side yard requirements do not apply to interior walls separating units.

3.

Rear Yard. Each lot upon which a building is constructed shall have a rear yard of not less than twenty-five (25) feet.

C.

Lot Size. The minimum lot size permitted shall be as follows:

1.

Single-family dwellings: five thousand (5,000) square feet.

2.

Two-family dwellings: five thousand (5,000) square feet.

3.

Attached single-family dwellings (2 units): two thousand five hundred (2,500) square feet per unit.

4.

Multifamily dwellings (3-8 units): two thousand five hundred (2,500) square feet per unit.

5.

Multifamily dwellings (9 or more units): twenty thousand (20,000) square feet.

6.

Churches and similar places of worship, community buildings, museums, libraries, galleries, schools, fraternal and other private clubs, and other similar buildings: thrity thousand (30,000) square feet.

D.

Lot Width. The minimum lot width at the front lot line (i.e. street frontage) shall be as follows:

1.

Single family dwellings: fifty (50) feet.

2.

Two family dwellings: fifty (50) feet when units are on a single parcel, or twenty-five (25) feet per lot when units are located on individual lots.

3.

Multi family dwellings: seventy-five (75) feet.

4.

Churches and similar places of worship, community buildings, museums, libraries, galleries, schools, fraternal and other private clubs, and other similar buildings: one hundred and fifty (150) feet.

E.

Percentage of Lot Coverage. All buildings, including accessory buildings, shall not cover more than fifty (50) percent of the area of the lot.
