SECTION 18

1528.- "OS" OPEN SPACE DISTRICT

Sec. 18-1528.1.- STATEMENT OF INTENT.

The "OS" Open Space District is specifically designated to provide for public and private open space and recreational facilities in order to provide relief from the urban environment; to provide adequate active and passive recreational areas; and to adequately provide for the needs of the population. Development within this designated area is limited to provide for a variety of active and passive park and recreational uses. Areas of the City for which this zoning category is appropriate are designated on the Land Use Plan Map as Recreation/Open Space (R/OS), Transportation/Utility (T/U) or Community Redevelopment District (CRD) areas.

Sec. 18-1528.2. - DENSITY REGULATIONS.

No residential development is permitted in the "OS" Open Space District.

Sec. 18-1528.3. - PERMITTED AND CONDITIONAL USES.

No building or land in the "OS" District shall be used, and no building shall be hereafter erected, structurally altered or enlarged, except for the permitted and conditional uses listed below. The uses listed as conditional uses below may be permitted if their site locations and proposed development site plans are first approved, as provided in the procedure for approval of conditional uses under Section 18-1531, "Conditional Use Regulations", of this Article.

Preliminary site plan approval by the City Council shall be required for all lands zoned "OS" Open Space, in accordance with the procedures and requirements of Section 18-1540, "Preliminary Site Plan Requirements." Minor amendments to site plans approved by City Council may be approved by the City Manager.

Permitted (P) and conditional (C) uses shall be subject to the conditions established in the following Table 18-1528.3 and other applicable conditions of this district and Article.

Sec. 18-1528.4. - DIMENSIONAL AND AREA REGULATIONS.

Except as provided under the regulations for conditional uses, the City Council shall determine the appropriate lot sizes, building height, building separation, yard setbacks, off-street parking provisions, signage, and other provisions that are adequate to meet the intent and requirements of these regulations, and further that such uses are harmonious to the adjacent uses and to the area. The following maximum intensity standards shall apply:

(A)

MAXIMUM LOT COVERAGE. Fifty (50) percent.

(B)

MAXIMUM FLOOR AREA RATIO. Fifteen hundredths (0.15).

Sec. 18-1528.5. - ADDITIONAL REGULATIONS.

(A)

FENCES. See Section 18-1530.10, "Fences, Walls and Hedges" for fence regulations and setbacks.

(B)

LANDSCAPING AND BUFFERING. See Section 18-1533, "Landscaping Regulations."

The Open Space District may be used to meet landscaping and open space requirements of an abutting district on the same parcel of land.

(C)

ILLUMINATION. See Section 18-1503.15, "Illumination."

(D)

DUMPSTER ENCLOSURES (See Section 18-1530.20, "Dumpsters"), AND ALSO SUPPLEMENTAL USE REGULATIONS (See Section 18-1530, "Accessory Use and Supplementary District Regulations").

(E)

OFF-STREET PARKING AND LOADING. See Section 18-1532, "Parking and Loading Regulations."

(F)

PRELIMINARY SITE PLAN APPROVAL REQUIREMENTS. For all lands zoned "OS" Open Space, City Council will review and approve a preliminary site plan in accordance with the procedures and requirements of Section 18-1540, "Preliminary Site Plan Requirements." The City Council may prescribe appropriate conditions and safeguards in conformity with this Article, including the installation of additional buffering in order to reduce or eliminate the adverse impact of the proposed use upon the adjacent uses and to the area. Minor amendments to site plans approved by City Council may be approved by the City Manager or his designee.
