SECTION 18

1541.- FINAL SITE PLANS

Sec. 18-1541.1.- PURPOSE AND INTENT.

Site plans, prepared and approved in accordance with the provisions of this Division, shall be required as a basis for the City to ensure that various development activities occur in compliance with the requirements of Chapter 18, "Land Development Code", and the terms of any prior approvals associated with the project. Final site plans are designed to show the specific arrangement of buildings and other improvements on a site in relation to each other, existing site conditions, and surrounding property, together with specific information on the nature and intensity of land use.

Sec. 18-1541.2. - APPLICABILITY.

Final site plans are hereby required in connection with applications for the following permits, approvals, and activities, none of which shall be issued or become effective prior to the approval of a final site plan: (See Section 18-1541.9, "Effect on Final Site Plan Approval".)

(A)

BUILDING PERMITS. Issuance of building permits unless exempted below:

1.

Manufactured Home, Recreational Vehicles, and Travel Trailers. Where a final subdivision plan or final site plan approval was previously granted for the development of a manufactured home subdivision or manufactured home park, as provided in the T-1, Manufactured Home Subdivision District, or the T-2, Manufactured Home Park District, respectively.

2.

Limited Increase in Gross Floor Area. Additions, improvements, or alterations to existing uses and structures when such changes do not result in an increase in gross floor area of the structure in excess of five hundred (500) square feet or one-third (⅓) of the existing gross floor area of the structure, whichever is less, provided there is no increase in the number of required parking or loading spaces required pursuant to Section 18-1532, "Off-Street Parking and Loading Regulations".

3.

Dwellings. Individual single-family or two-family dwellings (duplex) and their accessory uses and structures that are not part of a larger development that the Zoning Director finds should be site planned as one (1) cohesive unit.

4.

Temporary Uses. Any use permitted under Section 18-1530.14, involving temporary buildings.

5.

Signs. Any actions for which a sign permit is required by applicable City regulations, provided that signs shall be subject to review in connection with any other use or structure requiring a final site plan under this Section.

(B)

ENGINEERING PERMITS. Any engineering permit necessary for earthwork or infrastructure installation or modification that is preparatory for construction activity that requires a building permit.

Sec. 18-1541.3. - AUTHORITY.

Applications for final site plan approval shall be reviewed and decided administratively, provided that the Zoning Director may forward any application for final site plan approval to the City Council for final disposition pursuant to Section 18-1541.6(D). Within the Community Redevelopment Area, the Community Redevelopment Agency shall replace the City Council for this purpose.

Sec. 18-1541.4. - APPLICATION REQUIREMENTS; FORMAT AND GRAPHIC STANDARDS.

All final site plans shall conform to the following provisions, unless the Zoning Director determines that certain provisions are not applicable for a given submission.

(A)

SHEET SIZE. All required information shall be presented on sheets no larger than twenty-four (24) by thirty-six (36) inches, unless the Zoning Director determines that another sheet size would more aptly be suited to the requirements of preparing said Site Plan.

(B)

MULTIPLE SHEETS. Drawings may be presented on one (1) or more sheets to clearly show the information needed. If a drawing is prepared on more than one (1) sheet, match lines shall clearly and accurately indicate where the sheets join. All sheets shall be consecutively numbered, and must show the particular number of that sheet and the total number of sheets included.

(C)

DIMENSIONS. All dimensions shall be feet and decimals of a foot, accurate to the nearest tenth of a foot (except survey).

(D)

NORTH ARROW. All drawings shall have a north arrow.

(E)

SCALE. Plans shall be prepared at a scale of one inch equals fifty feet (1″ = 50′) or larger, provided that the Zoning Director may approve a smaller scale for large projects. All drawings shall show the scale (graphically and numerically) at which they are drawn.

(F)

DATE. All drawings shall show the date they were drawn.

(G)

REVISIONS. A revision record shall be incorporated into each plan sheet and each revision shall be notated and dated for tracking and plan identification purposes.

Sec. 18-1541.5. - APPLICATION REQUIREMENTS; CONTENT.

An application for final site plan approval shall consist of a City application form accompanied by all items identified thereon for submittal, including the specified number of site plan sets and the required administrative fee established by Resolution of City Council, as may be amended from time to time. No review shall be made of the final site plan until the fee is paid to the City of Pinellas Park. All final site plans shall contain the following.

(A)

GENERAL INFORMATION.

1.

Project Identification. Project name, County, State, Section, Township, Range, and a location map at a scale not less than one inch equals two thousand feet (1" = 2,000'), and indicating State Plane Coordinates, if available.

2.

Contacts. Name and contact information (phone number, facsimile number, email address, and physical address) of the developer, agent, and person(s) who prepared each plan sheet.

3.

Certification Required. All plans involving the services of an architect, landscape architect, engineer, or licensed Professional Surveyor and Mapper shall be certified by the individual responsible for said portion of the site plan and shall bear the seal, registration number and name and address of said individual. Plan shall be prepared and certified only by those professionals licensed by the State of Florida to prepare and certify such plans.

(B)

SURVEY OF EXISTING SITE CONDITIONS. A fully-dimensioned, certified boundary survey of the tract, prepared by a licensed Florida Professional Surveyor and Mapper within six (6) months of application submittal, containing the following information:

1.

Location and type of boundary evidence related to the State Plane Coordinate System, if available.

2.

Accurate legal description of the property.

3.

Computation of the total acreage of the tract to the nearest hundredth of an acre, with accompanying square-footage.

4.

Name, location, width, construction, centerline, type of dedication instrument, and book and page of recordation of all existing street rights-of-way, all reservations and easements, and watercourses, including top-of-bank and edge-of-water. This information shall be based upon an abstract of title that was certified as being accurate by the preparing title attorney no earlier than sixty (60) days prior to the date the survey was prepared (or updated).

5.

Existing topography with a maximum contour interval of two (2) feet, except where existing ground is on a slope of less than two (2) percent, in which case either one (1) foot contours or spot elevations shall be provided where necessary, but not more than one-hundred (100) feet apart.

6.

The delineation of all flood-prone areas as delineated by the FEMA 100-year Flood Plain, including flood zone(s) and base flood elevations.

7.

Clearly show and delineate all environmentally sensitive areas, indicating square footage and percentage of site, and the source of the delineation.

8.

Location and size of underground and above ground utilities and facilities, including, but not limited to:

(a)

Water and sanitary sewer pipe sizes, rim and invert elevations, direction of flow, and top and bottom elevations.

(b)

Telephone, electric, gas, and other utilities.

9.

Existing lot lines, with dimensions and bearings.

10.

Location and width of driveways and sidewalks within rights-of-way, including swales or parkways, curbs, medians, lanes for acceleration, deceleration, and left turns, and adjacent curb cuts.

11.

Location, dimensions, size and height of all buildings and structures, including signs, indicating whether such shall remain or be removed.

12.

All existing walkways and vehicular use areas, indicating type of surfacing, stall size, angle and width.

13.

Existing tree survey (including species, diameter at breast height, canopy spread, clear wood height, and condition of all trees over four and one-half (4 1/2") diameter, indicating which trees will be relocated or removed.

14.

Zoning, and present use of all adjoining property and structures within fifty (50) feet of site plan boundary.

(C)

PROPOSED SITE DESIGN. Location and dimensions for all of the features and improvements required to be shown in (B), above that will remain, and all proposed improvements and site modifications, including the following:

1.

Proposed buildings and other structures including distance to property lines.

2.

Proposed sidewalks to and around buildings and parking areas on-site.

3.

Clearly delineate any proposed outdoor storage area(s), including any required screening, outdoor seating, and any outdoor display area(s).

4.

Proposed street right-of-way (name, location, width, construction, and centerline), as provided by City Code.

5.

Proposed reservations and easements (including purpose and width).

6.

Proposed sidewalks or pedestrian ways within rights-of-way (including width and construction).

7.

Proposed driveways (including location, type, width, and turn radii), acceleration, deceleration and left turn lanes, and median cuts.

8.

Location and size of all proposed underground and above ground utilities and facilities (water and sanitary sewer, including rim and invert elevations, direction of flow, and top and bottom elevations; telephone, electric, gas, and other utilities (including whether overhead or underground); fire hydrants).

9.

Proposed finished grading by contours supplemented where necessary by spot elevations and, in particular, at those locations along lot lines.

10.

Proposed drainage plan, which may be preliminary, providing for the adequate disposition of natural and stormwater in accordance with the adopted design criteria and standards of the City of Pinellas Park indicating the location, size, type, and grade of ditches, canals, streams, berms, and all other key topographic features located within or directly adjacent to and serving the land to be developed; catch basins and pipes; connections to existing drainage system, including rim and invert elevations; onsite stormwater management facilities (retention/detention); and calculations for runoff detention, and pipe sizes.

11.

Provisions for the adequate control of erosion and sedimentation, indicating the proposed temporary and permanent control practices and measures that will be implemented during all phases of clearing, grading, and construction.

12.

Proposed vehicular use areas, including: surface construction; angle, length and width of parking, loading and stacking spaces; "typical" space detail that shows wheel stops and vehicle overhang dimensions where applicable; typical curb detail; turn radii; directional arrows and traffic markings and signage; fire lanes; and, landscape islands.

13.

Disabled-accessible parking details, including stall width and color, signage and ramps.

14.

Location of overhead doors (commercial/industrial).

15.

Proposed dumpster locations (including any concrete pads and screening).

16.

Proposed mechanical equipment external to structure (including A/C units and exhaust fans).

17.

Proposed outdoor lighting (including lighting structure location, height, fixture type (ex: full-cutoff, directional, etc.), and photometric plan.

18.

Proposed sign(s) including height, total sign area, and setbacks.

19.

Proposed fencing, retaining walls, and screen planting where required, including location, type, size, and height; elevation and typical wall section.

20.

All required site distance triangles.

21.

Dimensioned building elevation (horizontal view) drawings.

22.

Proposed Landscaping, including:

(a)

Location, size, description, and specifications of all landscape materials and planting areas (including common and botanical names). See Section 18-1533 for permitted trees, plant material requirements, and minimum planting requirements;

(b)

Typical planting details for trees and shrubs (including planting instructions, soil mixes, backfilling, mulching, and protective measures);

(c)

Irrigation system(s) (including type, water source, location, and spacing or coverage with respect to landscaped area);

(d)

Curbing of landscaped areas (including location, type and typical detail).

(D)

SUPPLEMENTAL INFORMATION.

1.

Land Use Plan Map and Official Zoning Map designations for the site. If the site is split by more than one designation, the dividing line(s) shall be shown.

2.

Minimum zoning district setbacks (stated or graphically shown).

3.

Proposed use(s) and gross floor area for each use (existing and proposed).

4.

Number of dwelling units (including size of units and number of bedrooms).

5.

Gross and net density for residential development.

6.

Number of floors and height of all buildings.

7.

Gross and net floor area and floor area ratio for all nonresidential buildings.

8.

Building coverage (square footage and percent of net site area).

9.

Finished floor elevation of all structures (required and proposed).

10.

Parking and loading spaces calculation (including minimum required, existing, and provided).

11.

Percentage of impervious lot coverage and open space (existing and proposed), using net lot area for the calculations.

12.

Paved area coverage of parking lot and the vehicular use area (square footage).

13.

Interior landscape coverage, expressed in square footage, exclusive of perimeter, buffer, and interior/detention areas, and as a percentage of the paved vehicular use areas.

14.

Proposed development schedule (written and graphic description of phasing).

15.

For multi-building projects, all buildings must be numbered.

16.

For sites under redevelopment, include the present assessed value of property (Pinellas County Property Appraiser or a MAI Estate Property Appraiser) and the total redevelopment costs.

17.

Such other information as may be reasonably be deemed necessary by the Zoning Director.

Sec. 18-1541.6. - REVIEW AND APPROVAL PROCEDURE.

All final site plans shall be reviewed and approved as prescribed in this Section.

(A)

PRE-APPLICATION CONFERENCE. Prior to application, the developer should confer with the staff of the Zoning Division to discuss informally the applicable requirements and procedures. For the purpose of such discussion, it is advised that the developer provide such information as necessary to describe the proposed development. Formal application or filing of a site plan with the Building/Development Division or Zoning Director is not required at the time of pre-application conference.

(B)

REVIEW AND APPROVAL OF FINAL SITE PLAN.

1.

Upon receipt of a final site plan submitted in accordance with the submittal requirements of this Section, the Building Development Director shall forward it to all other appropriate agencies for review under any applicable regulations or requirements, and shall initiate review of the final site plan for conformance with the provisions of Chapter 18.

2.

Upon the completion of such review, within a reasonable period of time following receipt of such site plan, the Building Development Director shall approve or deny the final site plan in accordance with the standards set forth in Section 18-1541.7, "Standards of Review", below, furnishing the applicant with a detailed memorandum of findings.

(C)

RESUBMITTAL IF PLAN DENIED. The applicant shall, within six (6) months of said denial of a final site plan, resubmit revised plans, complying with the comments provided by the reviewing agencies and the provisions of Chapter 18, or such final site plan shall be considered withdrawn and void. Any resubmittals after such six-month time frame shall be considered a new final site plan and shall be submitted in accordance with the provisions of this Section. Review of the revised resubmittal shall follow the procedure of paragraph (B), above.

(D)

DEFERRAL TO CITY COUNCIL

1.

Following the procedures of Section 18-1541.6, "Review and Approval Procedure", above, the Zoning Director may forward any final site plan application to the City Council, or CRA if applicable, if there is any question of fact or interpretation of any Code provision relative to the site plan in question, including but not limited to whether a proposed final site plan properly implements any City Council directive or conditions of a prior City Council approval.

2.

No application for final site plan may be forwarded to City Council for public hearing until the Zoning Director finds that the application complies with the review criteria of Sec. 18-1541.7, "Standards of Review", below, or would comply subject to specific conditions of approval, notwithstanding any specific matters deferred to the City Council for final decision.

3.

The Zoning Director shall cause public notice to be given, pursuant to Section 18-1534, "Public Notice Requirements", that a quasi-judicial public hearing will be conducted by the City Council pursuant to the procedures and requirements of Resolution No. 94-65. The Zoning Director shall forward the application to the City Council for final disposition, along with staff findings and recommendations.

Sec. 18-1541.7. - STANDARDS OF REVIEW.

The City shall not approve a final site plan unless:

(A)

The plan complies with all applicable regulations of Chapter 18, Land Development Code; and

(B)

The proposal is in accordance with the terms and conditions of any approvals by City Council governing use or development of the subject property, including but not limited to, conditional use approval, plat approval, preliminary site plan approval and variance approval, and the final site plan substantially conforms to any area-wide policy plans as approved by City Council; and

(C)

The proposal has a valid of Certificate of Concurrency.

Sec. 18-1541.8. - APPEALS.

Any person submitting a final site plan under this Section and aggrieved by any decision by the Zoning Director with respect to approval or denial of such final site plan may appeal such decision to the Board of Adjustment, or CRA if applicable, in accordance with Section 18-1535.2, "Administrative Appeals Procedure".

Sec. 18-1541.9. - EFFECT OF FINAL SITE PLAN APPROVAL.

Upon approval of a final site plan, the City is authorized to issue engineering permits for activity preparatory to construction, and building permit(s) pending compliance with the Building Code. Nothing herein shall prohibit the concurrent application and review of the final site plan and building permit(s).

Sec. 18-1541.10. - TIME LIMITS; EXPIRATION AND REVISIONS.

(A)

EXPIRATION. An approved final site plan shall expire and be void eighteen (18) months after the date of such approval if a building permit(s) has not been obtained for construction of a principal building therewith or occupancy has not been established on the site.

(B)

REVISIONS. Any final site plan may be revised in the same manner as originally approved.

Sec. 18-1541.11. - BUILDING PERMIT SUBMITTAL REQUIREMENTS.

For purposes of determining compliancy with Chapter 18, "Land Development Code" (LDC), all applications for building permits shall be accompanied by the following information and materials, as well as any additional items listed as being required on or with the City application form. The Zoning Director may waive submittal requirements that the Director determines are not applicable to a given application.

(A)

FINAL SITE PLANS. For proposals subject to the requirements of Section 18-1541, "Final Site Plans", above, the specified number of copies of the approved final site plan.

(B)

PLOT PLANS. For proposals not subject to Section 18-1541, "Final Site Plans", the specified number of copies of a plot plan containing the following information:

1.

General Requirements. Plot plans shall contain all basic information contained within Section 18-1541.4, "Application Requirements; Format and Graphic Standards", above.

2.

Supplemental Information. Additional information to be required shall include a tree removal permit or no tree verification form; documentation of submittal to outside agencies (D.E.R., SWFWMD, PPWMD, FDOT, and Pinellas County), as applicable; and such other information or may reasonably be deemed necessary by the Building Division Director.

3.

Building Construction Plans. The specified number of copies of the proposed building construction plans.
