CHAPTER 20

28 - B-1 CENTRAL BUSINESS DISTRICT

20.28.010 - Use regulations.

The B-1 central business district is designed to accommodate those retail and office uses which are characteristic of the major shopping streets of the downtown area, and excludes mobile homes.

A.

Uses Permitted by Right. In the central business district, no building and land shall be used and no building shall be erected or structurally altered, unless otherwise provided in this chapter, except for the following uses:

Antique shops

Art and school supply stores

Art galleries and museums

Automobile accessory stores

Banks and financial institutions

Barbershops and beauty parlors

Bicycle sales, rental and repair stores

Bowling alleys

Blueprinting and photocopying establishments

Book and stationery stores

Bus depots

Business machine sales and service

Camera and photographic supply stores

Catering

Carpet and rug stores

China and glassware stores

Clothing stores

Clubs and lodges (nonprofit and fraternal)

Computer and software sales

Computer cafes and coffee shops offering internet access

Drugstores

Dressmaking

Department stores

Dry goods stores

A.

Hobby shops, including coins and stamps

Hotels and motels

Interior decorating shops

Jewelry stores

Laundromats or hand laundries

Leather good and luggage stores

Liquor stores

Millinery shops

Medical supply stores

Music stores

Medical and dental clinics, not including veterinary clinics

Newspaper or magazine publishing or distribution

Offices, business, organizational and professional, not including veterinarians

Office supply stores

Optical sales and service

Photographic studios

Picture framing

Plumbing and heating sales

Public buildings

Restaurants

Radio and TV stations and studios

Sewing machine and supply and needlecraft shops

Shoe, clothing and hat repair

Shoe stores

Signs, as regulated in Chapter 18.28 of this code

Sporting goods stores

Stormwater management facilities, including but not limited to retention ponds or any stormwater management structures as required by city ordinance or the State of Wisconsin Department of Natural Resources' rules and regulations.

Taverns and bars, which must not be located within one hundred feet of any residence district boundary

Taxi stands and bus stops

Theaters, indoor

Ticket agencies, amusement

Tobacco shops

Toy shops

Tailor shops

Telephone booths and coin telephones

Travel bureaus

Thrift shops or secondhand clothing stores

Variety stores

Undertaking

Accessory uses incidental to and on the same zoning lot as the principal use

Uses clearly similar in character to those listed above.

B.

Uses Permitted with Conditional Use Permit. The following uses may be permitted after due consideration by the plan commission of the impact of such use on the neighboring properties and such other concerns as set forth in Section 20.52.131 of this title as may be appropriate. In granting a conditional use permit the plan commission may impose site design or operating limitations on the use as needed to mitigate any potential negative impacts of the development.

Motor vehicle service stations

Motor vehicle sales in enclosed buildings

Parks

Pawnshops

Pet shops, not including veterinary offices, clinics or hospitals

Physical culture and health services, gymnasiums or baths

Residential one-family, two-family and multiple-family dwellings. However, if the property is located in the downtown development district (see map attached to the ordinance from which this section derives) then the residential unit must be located above the first floor level of the principal use.

Schools of music, dance, business, commercial or trade

Tattoo parlors

Taxidermists

C.

All Businesses, Servicing or Processing. In the central business district, all businesses, servicing or processing except for off-street parking or loading, shall be conducted within completely enclosed buildings.

D.

Prohibited Uses. Sale, distribution or display of obscene material including but not limited to printed material, videos, compact disks, films and live entertainment.

E.

Existing Residences. Existing owner-occupied residences, excluding mobile home and home occupations, shall comply with the provisions of the R-1 residential district.

20.28.020 - Height regulations.

No building erected or structurally altered shall exceed sixty feet in height from the sidewalk level.

20.28.030 - Area regulations.

A.

Front Yard. None required, except that sidewalk width or distance from the front elevation of the building to the face of curb must be a minimum of ten feet. Buildings on corner lots must be a minimum of ten feet from the curb to the elevation of the building on each side of the corner. Buildings, which occupy the entire depth of a block, must be set back ten feet from the curb on each street faced.

B.

Side Yard. None required, but every side yard that is provided where not required by these regulations shall be a minimum of ten feet from the lot line to the elevation of the building. Where a lot abuts upon the side yard required in the adjoining district, it shall provide the side yard required in the adjoining district.

C.

Rear Yard. Structures erected after 1981 shall have a minimum rear yard of ten feet, and any or all of this yard may be used to meet off-street loading requirements.

D.

Vision Clearance. No structure shall be permitted so as to interfere with a clear line of sight. The area required for the line of sight shall be in accordance with the current standards set forth by the American Association of State Highway and Transportation Officials (AASHTO) in their Policy on Geometric Design of Highways and Streets.

20.28.050 - Off-street parking regulations.

A.

Improvements Required. Parking area for more than four vehicles shall provide the following:

1.

Yards. The front yard setback before the parking area shall be the same as for buildings in the district in which the parking area is located. Side yards shall be seven feet from the lot line on either side of the parking area. No rear yard is required.

2.

Surfacing.

a.

All driveways and open off-street parking areas shall be surfaced with bituminous or concrete.

b.

Driveway aprons between the street and sidewalk shall be of concrete.

c.

Grading. Open off-street parking areas shall be graded and drained so as to dispose of all surface water into an onsite stormwater collection system going into the municipal stormwater collection system.

3.

Screening and Landscaping. (See Title 23—Landscaping and Bufferyard Regulations)

B.

Ingress and Egress.

1.

Parking lots accommodating twenty-four or fewer cars:

a.

One-way access to the parking lot shall be a minimum of ten feet in width;

b.

Driveways accommodating two-way traffic shall be a minimum of twenty feet in width.

2.

Parking lots accommodating twenty-five or more vehicles shall be a minimum of twenty feet in width,

a.

One-way access shall be a minimum of twelve feet in width;

b.

Driveways accommodating two-way traffic shall be a minimum of twenty-four feet in width.

3.

Parking lots accommodating commercial or industrial vehicles:

a.

One-way access shall be a minimum of fourteen feet in width;

b.

Driveways accommodating two-way traffic shall be a minimum of twenty-eight feet in width.

C.

Lighting. Any lighting used to illuminate off-street parking areas shall use full cut-off design fixtures and shall be directed downward to minimize light spill onto adjacent properties.

20.28.060 - Off-street loading requirements.

On structures built following the effective date of the ordinance codified in this chapter, space must be provided for off-street loading of sufficient size so that no streets, sidewalks or alleys are blocked.

20.28.070 - Storage of flammable liquids.

The storage of flammable liquids, as defined in Comm. 10 Wisconsin Administrative Code, in above ground tanks outside of buildings is prohibited within this district.
