CHAPTER 20

20 - RESIDENCE DISTRICT 3—MULTIPLE-FAMILY

20.20.010 - Use regulations R-3 multiple-family.

Residence district 3 is intended to provide a living area which is pleasant and includes multiple housing. In R-3, no building or land shall be used and no building shall be erected or structurally altered unless otherwise provided in this chapter except for the following uses:

A.

Any use permitted in residence district 2;

B.

Multiple-family dwellings of eight units or less;

C.

Multiple-family dwellings or eight units, as conditional uses;

D.

School dormitories, and sororities and fraternities which provide sleeping quarters, as conditional uses;

E.

Mobile homes or trailers as part of a mobile home subdivision or park. A mobile home subdivision or park is permitted as a conditional use, and is intended exclusively for residential use of mobile homes.

20.20.015 - Conditional use minimum requirements.

The requirements set forth in Sections 20.20.020 through 20.20.040 of this chapter, are minimum requirements for conditional uses under this chapter. Those requirements may be made more restrictive by the plan commission during the conditional use permit approval process if deemed necessary to comply with the purpose and intent of Sections 20.52.131 through 20.52.139 inclusive, of this code.

20.20.020 - Height regulations.

In R-3, no building shall be erected or structurally altered to exceed forty-five feet or two and one-half stories; provided, however, that this height limit may be increased one foot for each additional foot that each yard exceeds the minimum required. Accessory dwelling units shall be no higher than the principal structure on the lot. Supporting accessory buildings shall not exceed eighteen feet in height. Heights are determined from the main elevation of the finished grade adjoining and along the front of the building to the highest point.

20.20.030 - Area regulations and site design standards.

A.

Yards and Setbacks.

1.

Front Yards. On every lot in R-3, except for those located within mobile home parks, there shall be an open and unobstructed front yard depth of not less than twenty-five feet. Within mobile home parks, the front yard depth shall be not less than ten feet.

Side Yard.

a.

For any use permitted in residence district 2, the side yard regulations of residence district 2 are required.

b.

Multiple-family dwellings, school dormitories, and fraternities and sororities with sleeping quarters shall have a minimum side yard width of fifteen feet on each side of the building, except that on corner lots, there shall be provided a building setback of at least twenty-five feet from each street right-of-way. Within mobile home parks, the depth of each side yard shall be not less than five feet.

3.

Rear Yard. On every lot in residence district 3, except for those located within mobile home parks, there shall be a rear yard of not less than thirty feet. Within mobile home parks, the rear yard depth shall be not less than seven feet.

4.

Separation Between Buildings. When there is more than one principal building on a site, buildings shall be no closer to each other than twenty for one story plus ten feet per story or partial story above one. Accessory buildings shall be no closer than ten feet to a principal building.

5.

Setback from Drives and Parking Areas. Principal buildings shall be set back a minimum of ten feet from drives or parking areas.

6.

Access to Buildings. No building shall be farther than two hundred feet from public street or approved private street. Driveways in parking lots are not considered to be streets.

B.

Accessory Buildings. Accessory buildings may not project forward of the required setbacks of the main building, and may not be closer to any lot line than six feet.

C.

Lot Area and Minimum Lot Dimensions. In R-3, the following lot areas are required:

Single-family dwelling 5,000 square feet
Duplex dwelling 7,000 square feet
Multiple-family dwelling 7,500 square feet

 

Lot frontage shall be not less than sixty feet or sixty feet at the building line for single and duplex dwellings, and eighty feet for multiple-family dwellings; and the mean width of the lot shall be not less than sixty feet for multiple-family dwellings.

D.

Percentage of Lot Coverage. All buildings including accessory buildings shall not cover more than forty percent of the area of the lot.

E.

Minimum Usable Floor Area per Family Unit. In residence district 3, no building shall be erected or structurally altered to have less than five hundred square feet of usable living floor area per family unit, with the exception of studio apartments, which shall have a minimum of four hundred square feet of usable living floor area per family unit, and mobile homes in parks and subdivisions, which do not have a minimum floor area requirement.

F.

Landscaping. At least thirty percent of the site shall be open space and be landscaped with grass or ground cover and shrubs or trees, or left natural.

G.

Parking, Driveway and Lighting Design.

1.

Driveways shall be a minimum of twenty-four feet wide.

2.

Parking spaces shall be a minimum of nine feet by eighteen feet and clearly marked on pavement.

3.

Parking areas shall be paved with concrete or asphalt-bituminous materials.

4.

When roadways exit to adjacent properties rather than directly to a public street, permanent cross-easement agreements shall be recorded which adequately guarantee such accesses will be permanently maintained.

5.

Lighting. See Chapter 23.025—Exterior Lighting Standards.

H.

Storm Drainage. Stormwater drainage plans shall be required which provide for water to be collected and retained on the site with discharge into the public drainage system controlled to minimize flooding.

20.20.040 - Off-street parking regulations.

Off-street parking shall be the same as in residence district 1.

20.20.050 - Site plan review.

Site plans shall require approval of the plan commission in accordance with Section 20.52.100 of this title prior to commencing any site work or granting a building permit.
