48 - WWT—WASTEWATER TREATMENT DISTRICT
The wastewater treatment district shall be an overlay district. This wastewater district is being created to meet the intent of NR 110.15(3)(d) of the Wisconsin Administrative Code. That section prescribes standards for the separation distances of the sewage treatment facilities and other property. All the requirements of the underlying district shall remain in effect.

The only areas affected by the district regulations in 20.48.030 shall be those areas zoned as a wastewater treatment district and which are located within five hundred feet of any tankage or stationary mechanical equipment used for the treatment of wastewater. Lift stations physically separate from the treatment plant shall not be considered to be tankage or stationary mechanical equipment.

District regulations are as follows:
A.
Except as set forth in subsection D of this section, residential development, construction or use shall be prohibited.
B.
Except as set forth in subsection D of this section, development, construction or use of healthcare facilities shall be prohibited.
C.
There shall be no commercial development, construction or use in the area affected by district regulations, except for areas zoned B-2 (highway business) as of the date of the enactment of the ordinance codified in this chapter. Areas zoned, B-2 (highway business) as of the date of the ordinance codified in this chapter shall be exempted from the restrictions of the district regulations. However, areas zoned B-2 (highway business) are not exempt from the district regulations to the extent that they allow residential or healthcare uses.
D.
Residential and healthcare uses which are existing on the date of passage of the ordinance codified in this chapter are permitted. Existing residential and healthcare uses may expand, replace or remodel existing buildings, facilities and parking areas according to the zoning requirements of the underlying zoning district if the city determines that the expansion, replacement or remodeling will not be unreasonably impacted by the proximity of the wastewater treatment facilities.
