ARTICLE II

INTERPRETATION

Sec. 2.1.- Interpretation and application held to minimum requirements.

(a)

In interpretation and application, the provisions of this chapter shall be held to be minimum requirements adopted for the promotion of the public health, safety, high water quality in Lake Jovita (Clear Lake), an aesthetically desirable environment, morals, comfort, prosperity and general welfare and for implementation of the mandates of the comprehensive plan, and the conclusions of the report on nonpoint pollution and the report on sewage disposal systems. It is not intended by this ordinance to repeal, abrogate or annul any existing provisions adopted or issued, or which shall be adopted or issued pursuant to law relating to the use of buildings or premises, or with any private restrictions placed upon property by covenant, deed or recorded plat; provided, also, that where this ordinance imposes a greater restriction upon the use of buildings or premises or upon the heights of buildings or requires greater lot areas, larger yards, courts or other open spaces than are imposed or required by such existing provisions of law, or by such rules, regulations or permits, or by such private restrictions, the provisions of this ordinance shall control.

(b)

Where there is a conflict between the Land Development Code and the town's comprehensive plan, the comprehensive plan shall govern. Interpretation of the Town of St. Leo Land Development Code shall be made by the town commission or its designee. The comprehensive plan shall be utilized in making such interpretations. Interpretations must be made in writing and kept on file in the town clerk's office. Interpretations shall be incorporated into the next chapter amendment.
