CHAPTER 16

52: SWIMMING POOLS

§ 16.52.010 PURPOSE AND INTENT.

   (A)   The purpose of this chapter is to provide minimum standards to protect neighborhood aesthetics and to guard against impacts to adjoining properties.
   (B)   Any property owner wishing to construct a swimming pool must submit plans for the swimming pool to the Planning Department, and must have received written approval of such plans prior to obtaining building permits, in accordance with the provisions of this chapter.

§ 16.52.020 PERMITTED LOCATION.

   No swimming pool, hot tub, spa, or similar body of water, or pool equipment, may be located within three feet of any property line, or within any front or side yard setbacks.

§ 16.52.030 FENCES, WALLS AND GATES.

   All fences, walls and gates required by the Building Code must also meet the requirements of Chapter 16.44 (Fences, Walls & Hedges).

§ 16.52.040 DECKS.

   (A)   Above ground decks must comply with all setback requirements of the applicable zone.
   (B)   Ground level decks may be constructed to the property line, provided adequate drainage features are available to prevent overflow or splash water from the pool from draining onto the adjacent property.

§ 16.52.050 OTHER APPLICABLE REGULATIONS.

   In addition to the requirements contained in this chapter, any applicable requirements in the following chapter(s) apply:
