CHAPTER 16

09: OPEN SPACE ZONES

§ 16.09.010 PURPOSE AND INTENT.

   Two open space zones, Open Space Passive (O) and Open Space Parks and Recreation (OPR), have been established to preserve, manage, and protect natural resources, open space lands, cultural and historic resources, geologic hazard areas, parks and recreational resources, and scenic resources which contribute to the overall character and density of the community, consistent with the goals of the Santa Paula General Plan.
   (A)   Open Space Passive (O) Zone . This zone accommodates land that is intended to remain undeveloped, such as properties in the Santa Clara River bed (south of the Public Levee Bank Protection Line), Santa Paula Creek, undevelopable and set-aside areas of Adams Barranca and Fagan Barranca, and undevelopable slopes and natural landmarks. Permitted uses are limited to flood control channels and other waterways, bridges, and hiking, biking, and equestrian trails. Surface mining is conditionally permissible in this zone, subject to the provisions of Chapters 16.100 through 16.104 (Surface Mining) and Conditional Use Permit review pursuant to Chapter 16.218 (Conditional Use Permits) of this Title 16.
   (B)   Open Space Parks and Recreation (OPR) Zone. This zone accommodates development of active parks and recreation resources.

§ 16.09.020 LAND USE AND PERMIT REQUIREMENTS.

   (A)   Permitted uses. Permitted uses in the Open Space Parks and Recreation (OPR) Zone are as follows:
   (1)   Parks, picnic areas, and playgrounds;
   (2)   Hiking, biking, and equestrian trails;
   (3)   Preservation and use of historic landmarks;
   (4)   Flood control channels and other waterways; and
   (5)   Landscaped areas for passive use.
   (B)   Uses requiring a Conditional Use Permit. The following uses may be permitted in the Open Space Parks and Recreation (OPR) Zone subject to Conditional Use Permit review pursuant to Chapter 16.218 (Conditional Use Permits) of this Title 16. Special conditions that may apply to these or other civic/institutional uses are contained in Chapters 16.54 through 16.76 (Standards for Specific Land Uses) of this Title 16.
      (1)   Public or private equestrian stables;
      (2)   Public and private country clubs and golf courses, except miniature golf;
      (3)   Public and private athletic fields and facilities;
      (4)   Commercial outdoor recreation facilities;
      (5)   Shooting ranges and gun clubs; and
      (6)   Surface mining, subject to the provisions of Chapters 16.100 through 16.104 (Surface Mining) of this Title 16.
   (C)   Use requiring a Temporary Use Permit. The following use may be permitted with a Temporary Use Permit pursuant to Chapter 16.228 (Temporary Use Permits) of this Title 16:
      (1)   One-time or annually occurring events such as arts and craft shows and exhibits, carnivals, circuses, fairs, seasonal outdoor sales, and farmers' markets.

§ 16.09.030 DEVELOPMENT STANDARDS.

   (A)   Table 9-2 identifies the development standards applicable to all development in the Open Space zones.
   (B)   Those lots shown on an approved and recorded subdivision map, or for which a deed was recorded prior to the incorporation of the City of Santa Paula, may be used as a building site irrespective of the minimum lot size, lot width, and lot depth standards set forth in Table 9-2.

§ 16.09.040 OTHER APPLICABLE REGULATIONS.

   In addition to the requirements contained in this Chapter 16.09, the following applicable requirements in this Title 16 apply to development in the Open Space zone:
