CHAPTER 16

11: AGRICULTURAL ZONE

§ 16.11.010 PURPOSE AND INTENT.

   The Agricultural (A-1) zone allows agriculture, floriculture, horticulture, and resource production with related uses. This zone promotes and preserves agricultural activities on lands capable of supporting such activities, and excludes those activities which, by their development and association, would have detrimental effects on land designated for agricultural purposes, or creates materially adverse odor, smoke, dust, fumes, vibration or which is dangerous to life or property.

§ 16.11.020 LAND USE AND PERMIT REQUIREMENTS.

   (A)   Permitted uses. Permitted uses in the Agriculture zone are as follows:
      (1)   Agriculture, floriculture, and horticulture and related uses.
      (2)   One single-family dwelling of a permanent character in a permanent location on a lot or building site.
      (3)   Day care, small and large family. Large family day cares will also be required to comply with Chapter 16.60.
      (4)   Accessory buildings and structures necessary to the agricultural or residential use located on the same lot or parcel of land, including private garages with a capacity not to exceed four automobiles, children's playhouses, covered patios, windmills, silos, tank-houses, barns, coops, provided all uses are of an accessory nature. Accessory uses are not permitted on any property where a permitted primary use does not already exist.
      (5)   Storage incidental to permitted uses, provided such storage is contained within an accessory building.
      (6)   Home occupations pursuant to Chapter 16.230 (Home Occupation Permits) of this Title 16.
      (7)   Farmworker housing and migrant farmworker housing consisting of not more than 12 units designed for use by a single household or 36 beds in a group quarters in accordance with Cal. Health & Safety Code §§ 17000 et seq.
   (B)   Uses requiring a Conditional Use Permit. The following uses may be permitted subject to Conditional Use Permit review pursuant to Chapter 16.218 (Conditional Use Permits) of this Title 16. Special conditions that may apply to these or other civic/institutional uses are contained in Chapters 16.54 through 16.76 (Standards for Specific Land Uses) of this Title 16.
      (1)   Animal keeping of other than domestic dogs, cats, and similar household pets.
      (2)   Kennels.
      (3)   Cemeteries.
      (4)   Churches and other religious institutions.
      (5)   Radio and television transmitters.
      (6)   Public utility and public services uses.
      (7)   Private educational facilities and accessory uses.
      (8)   Parks and recreational uses.
      (9)   Day care centers.
      (10)   Hospitals and sanitariums.
      (11)   One stand for the display and sale of only those agricultural products raised on the premises, provided such stand does not exceed 300 square feet in area and is not located nearer than 20 feet to any public right-of-way.
      (12)   Separate workers' quarters or guest rooms on properties where a primary dwelling unit exists.
      (13)   Community care facilities.
      (14)   Public or private stables.
      (15)   Surface mining, subject to the provisions of Chapters 16.100 through 16.104 (Surface Mining) of this Title 16.
      (16)   Golf, swimming, tennis, polo, hunting, and country clubs and similar uses.
      (17)   Hatching, raising and fattening of chickens, turkeys or other fowl or poultry and rabbits, fish, frogs or other small animals for domestic or commercial use. A minimum lot size of one acre is required. Also, the killing or dressing of such animals or poultry for commercial purposes will not be permitted.
      (18)   Storage of petroleum products for use on the premises.

§ 16.11.030 DEVELOPMENT STANDARDS.

   (A)   Table 11-1 identifies the development standards applicable to all development in the A-1 zone.
   (B)   Those lots shown on an approved and recorded subdivision map, or for which a deed was recorded prior to the incorporation of the City of Santa Paula, may be used as a building site irrespective of the minimum lot size, lot width, and lot depth standards set forth in Table 11-1.

§ 16.11.040 KEEPING OF ANIMALS .

   (A)   Purpose and intent.
      (1)   These regulations for the keeping of animals are established to ensure protection of the health, safety, and general welfare.
      (2)   No animal may be kept in any manner that constitutes a health hazard or noise nuisance to the owner or to any neighbor.
      (3)   Any request for the keeping of animals must be considered under a Conditional Use Permit application pursuant to the provisions of Chapter 16.218 (Conditional Use Permits) of this Title 16.
   (B)   Equine species. Horses, mules, and other equine species are conditionally permitted in the A-1 zone at a density of not more than 2 animals per 1 acre.
   (C)   Bovine and ovine species. Bovine (cow like) and ovine (sheep like) species are conditionally permitted in the A-1 zone and are subject to the following regulations:
      (1)   Two bovine animals are permitted for each 1-½ acre of lot area.
      (2)   Eight bovine animals are permitted for each four acres of lot area, provided that the number of such animals will not exceed one animal per one-half acre of area. On any lot or parcel of land having an area of more than four acres, eight of any one combination of said animals may be kept.
   (D)   Poultry and small animals. Poultry, rabbits, chinchillas, hamsters and other small animals are conditionally permitted at a maximum density of 25 of any one or combination thereof per one acre. The killing or dressing of such animals or poultry for commercial purposes will not be permitted.
   (E)   Apiculture and honey extraction.
      (1)   No occupied hive may be located or maintained within 150 feet of any public road, street, or highway, or within 150 feet of any lot line, unless such lot line is common with other property utilized for an apiculture and honey extraction use; and
      (2)   No occupied hive may be located or maintained within 400 feet of any dwelling on any adjacent property or within 100 feet of any dwelling on the same property, unless the written consent of the owner of such dwelling is obtained.
      (3)   Available and adequate water supply must be maintained on the property at all times to serve the bees.
   (F)   Outdoor aviaries.
      (1)   Birds in outdoor aviaries are permitted, provided the total number of birds does not exceed ten birds for each 1,500 square feet of lot area.
      (2)   Aviaries must be located in accordance with the minimum distance requirements for animal-keeping areas set forth in subsection 16.13.210(E)(1)(c) of this Title 16.
   (G)   Stables, barns and corrals. Any stable, barn, corral, or other animal enclosure must be located as follows:
      (1)   A minimum distance of 50 feet from any dwelling or other building used for human habitation.
      (2)   A minimum distance of 100 feet from the front lot line of the lot upon which it is located.
      (3)   A minimum distance of 100 feet from any public park, school, hospital, or similar institution.
      (4)   A minimum distance of 20 feet from any interior side lot line or rear lot line.
      (5)   A minimum distance of 75 feet from any side street, or the distance equal to one-half the width of the lot abutting the side street, whichever distance is lesser.
   (H)   Additional animals. Any request for the keeping of more animals than specified in this section will require a Conditional Use Permit application pursuant to the provisions of Chapter 16.218 (Conditional Use Permits) of this Title 16.
   (I)   Commercial animal keeping. Any request for a commercial operation must be considered under a Conditional Use Permit application.

§ 16.11.050 OTHER APPLICABLE REGULATIONS.

   In addition to the requirements contained in this Chapter 16.11, the following applicable requirements of this Title 16 apply to development in the A-1 zone:
