166.14 C-1A

NEIGHBORHOOD COMMERCIAL DISTRICT.

The C-1A District is designed to provide space for the general retail and service commercial uses outside the central business district. The uses permitted are intended to accommodate primarily the local and trade area retail customer.
   1.   Permitted Principal Uses and Structures. Only the use of structures or land listed in this section shall be permitted in the C-1A District.
      A.   Clinics, group medical centers, or the office of a doctor, dentist, osteopath, or similar profession.
      B.   Business and professional offices including the following: law, engineering, real estate, insurance, and similar uses.
      C.   Personal service businesses such as beauty and barber shops, shoe repair, and similar uses.
      D.   Retail business or service establishments such as the following:
         (1)   Animal hospitals/veterinary clinics/kennels.
         (2)   Antique shops.
         (3)   Apparel shops.
         (4)   Art shops.
         (5)   Automotive display, sales, services, and repairs.
         (6)   Baby and children stores.
         (7)   Bakeries or bakery outlets - retail sales only.
         (8)   Bicycle shops, sales and repairs.
         (9)   Book stores.
         (10)   Camera stores.
         (11)   Car sales.
         (12)   Car Washes.
         (13)   Clothes cleaning and laundry pickup stations.
         (14)   Confectionery stores, including ice cream or snack bars.
         (15)   Convenience store.
         (16)   Dairy stores - retail only.
         (17)   Delicatessens.
         (18)   Dance studios.
         (19)   Drug stores.
         (20)   Dry goods stores.
         (21)   Florist shops.
         (22)   Furniture stores.
         (23)   Gift shops.
         (24)   Grocery stores.
         (25)   Hardware stores.
         (26)   Hobby shops.
         (27)   Jewelry stores and watch repair shops.
         (28)   Key shops.
         (29)   Launderettes, coin-operated dry cleaning establishments, and dry cleaning or pressing establishments.
         (30)   Meat market - retail sales only.
         (31)   Leather goods store.
         (32)   Music stores.
         (33)   Music studios other than recording studios.
         (34)   Paint and wallpaper stores.
         (35)   Photographic studios.
         (36)   Postal substations.
         (37)   Professional offices.
         (38)   Retail printing/copy shops.
         (39)   Radio and television sales and repair shops.
         (40)   Real estate, insurance and financial institutions.
         (41)   Restaurants, cafes.
         (42)   Shoe and hat repair shops.
         (43)   Sporting goods stores.
         (44)   Storage yards.
         (45)   Tailor and dressmaking shops.
         (46)   Toy stores.
         (47)   Variety stores.
         (48)   Child care centers and nursery schools.
         (49)   Video stores.
      E.   Services, businesses or recreational uses such as the following:
         (1)   Automobile accessory stores.
         (2)   Drive-in banks.
         (3)   Food, meat and fruit stores and food catering services - retail only.
         (4)   Laundry pickup stations.
         (5)   Travel and tourist information centers.
   2.   Permitted Accessory Uses and Structures. Following are the permitted accessory uses and structures allowed in the C-1A Neighborhood Commercial District:
      A.   Uses and structures clearly incidental and necessary to their permitted principal uses or structures of this district.
      B.   Storage warehouses in conjunction with the permitted principal uses or structures of this district.
      C.   Temporary buildings used in conjunction with construction work, provided that such buildings are removed promptly upon completion of the construction work.
   3.   Special Exception Uses and Structures. Following are the permitted special exception uses and structures allowed in the C-1A Neighborhood Commercial District:
      A.   One and two family residential dwellings.

   4.   Minimum Lot Area and Width. There is no minimum lot area and width requirement for the commercial uses in the C-1A Neighborhood Commercial District.
   5.   Minimum Required Front, Side and Rear Yards. Following are the minimum requirements for front, side and rear yards in the C-1A Neighborhood Commercial District.
      A.   Front – 30 feet when fronting on the right-of-way of a major street shown on the major street plan. The front yard shall be measured from the proposed right-of-way line.
      B.   Side street, corner lot – 30 feet.
      C.   Side yard – 10 feet.
      D.   Rear yard except where apartments are above a store or shop, a rear yard of 30 feet shall be provided and where adjacent to an “A” or “R” district, a side yard of 20 feet and a rear yard of 30 feet shall be provided.
   6.   Maximum Height. The maximum height for structures in the C-1A Neighborhood Commercial District is 2½ stories or 35 feet.
   7.   Permitted Signs. Permitted signs in the C-1A Neighborhood Commercial District are as follows:
      A.   Trade, business or industry identification sign for firm located on the site provided that:
         (1)   Free-standing signs shall not exceed 25 feet in height and 60 square feet in area per face. The face or copy area of such signs shall not be located lower than 10 feet above grade, or closer than 10 feet to the right-of-way line.
         (2)   A directory sign or monument sign may be substituted in place of a post sign, subject to the requirements set forth above. A monument sign shall not be more than 10 feet in height and shall not be located closer than 10 feet to any property line.
         (3)   Signs attached to a building shall not project above the height of the building and shall be flat, wall mounted signs projecting not more than one foot from the face of the building except identification signs of less than two square feet in area.
         (4)   Wall mounted signs shall not exceed 100 square feet in area or more than 20 percent of building front elevation, whichever is smaller.
         (5)   All new signs or all signs being replaced shall be flush mounted.
      B.   No sign or billboards shall be located in, overhang or project into a required yard except as otherwise provided for herein.
      C.   All signs and billboards shall be maintained in a neat and presentable condition and in the event their use shall cease they shall be promptly removed and the surrounding area restored to a condition free from refuse and rubbish.
      D.   In the event a nonconforming sign is removed it shall be replaced only by a sign conforming to the provisions contained herein.
   8.   Off-Street Parking and Loading. Spaces for off-street parking and loading shall be provided in accordance with the provisions of Section 166.21(14).
   9.   Site Plan Requirements. See Section 166.21(16).
   10.   Minimum Open Space. The total land area devoted to open space and landscaping shall not be less than 10 percent of the gross land area included in the building lot. Such open space shall be maintained as grassed and landscaped area and shall not include access drives, parking areas, structures or buildings; except ornamental structures included as part of the landscaping theme.
