LIGHT INDUSTRIAL DISTRICT.

The M-1 District is intended and designed to provide for increased flexibility in the location of certain manufacturing and industrial uses while maintaining protection for nearby residential districts. It allows selected industries of a non-nuisance character to locate in areas within reasonable proximity of residential uses. The M-1 District is characterized by large lots, with landscaped grounds and ample provisions for off-street parking and loading spaces, and structures generally one or two stories in height.
   1.   Permitted Principal Uses and Structures. Only the uses of structures or land listed in this section shall be permitted in the M-1 District, provided, however, that all manufacturing, assembling, compounding, processing, packaging or other comparable treatment, including storage of any and all materials and equipment shall take place within completely enclosed buildings, except for parked motor vehicles and off-street parking and loading as required in Section 166.21(14). No dwelling or dwelling unit is permitted except those for employees having duties in connection with any premises requiring them to live on said premises, including families of such employees when living with them. In addition, all open areas not used for off-street parking or loading shall be planted with grass, shrubs and trees, properly maintained, and kept free from refuse and debris.
      A.   Permitted commercial uses:
         (1)   Animal hospitals/vet clinics/kennels.
         (2)   Automotive display, sales, service and repair.
         (3)   Boats, motors, travel trailers and mobile home display, sales, service, and repair.
         (4)   Building materials sales yards.
         (5)   Bus terminal.
         (6)   Car sales.
         (7)   Car washes.
         (8)   Farm implement display, sales, service and repair.
         (9)   Greenhouse and plant nursery.
         (10)   Lumber yards.
         (11)   Printing, publishing and engraving.
         (12)   Railroads and public utilities but not including storage or maintenance yards and buildings.
         (13)   Retail printing/copy shops.
         (14)   Storage yards.
         (15)   Truck stops.
         (16)   Wholesale display and salesroom.
      B.   Assembly of small electrical appliances, small industrial and electronic instruments and devices, radios, phonographs and television sets, including the manufacture of small accessory parts only, such as coils, condensers, transformers, crystal holders and similar products.
      C.   Commercial trade school.
      D.   Compounding and packaging of drugs, pharmaceuticals, cosmetics, perfumes and toiletries.
      E.   Laboratories; research, experimental and testing.
      F.   Manufacturing, assembling, compounding, processing, packaging, or other comparable treatment of the following:
         (1)   Bakery goods, candy and food products.
         (2)   Cameras and other photographic equipment.
         (3)   Electric and neon signs, outdoor advertising signs.
         (4)   Musical instruments, toys, novelties, and rubber and metal hand stamps.
         (5)   Pottery and other ceramic products using only previously pulverized clay, and kilns fired only by electricity or gas.
         (6)   Products from the following previously prepared materials: bone, canvas, cellophane, cloth, rope, cord, twine, feathers, felt, fiber, fur, glass, hair, horn, leather, paper, cardboard, plastics, natural and synthetic rubber, previous or semi-precious metals or stones, shells, textiles, tobacco, wax, wood, yarns, light metal mesh, pipe, rods, strips or wire.
         (7)   Small precision instruments, such as barometers, clocks, watches and compasses.
      G.   Office buildings.
      H.   Printing, lithographing or film processing plants.
      I.   Radio and television broadcasting stations and studios, but not including antennas or towers.
      J.   Warehouses for storage of merchandise or material in connection with the uses permitted in this district only.
   2.   Permitted Accessory Uses and Structures. Following are the accessory uses and structures permitted in the M-1 Light Industrial District:
      A.   Uses and structures clearly incidental and necessary to their permitted principal uses or structures of this district.
      B.   Temporary buildings used in conjunction with construction work, provided that such buildings are removed promptly upon completion of the construction work.
      C.   Dwelling units for watchmen or caretakers employed on the premises provided that an open yard of at least 2,400 square feet is reserved and maintained for use by the occupants.
   3.   Special Exception Uses and Structures.
      A.   Subject to subsection 2 of Section 168.13 and the other requirements contained herein, the board may permit as special exception bulk storage of petroleum products under pressure provided that such uses shall not be located within 500 feet of any existing dwelling, park, school, or place of public assembly; and that it is located so that prevailing winds will not cause fumes, odors or gases to be carried toward developed properties in the vicinity and that one parking space for each employee and one space for each vehicle or trailer used by the industry be provided.
      B.   No use shall be permitted to be established or maintained which by reason of its nature or manner of operation is or may become hazardous, noxious, or offensive owing to the emission of odor, dust, smoke, cinders, gas, fumes, noise, vibrations, refuse matter or water-carried waste.
   4.   Minimum Lot Area and Width. Following is the minimum required lot area and width for the M-1 Light Industrial District:
      A.   Area – no minimum.
      B.   Width – no minimum.
   5.   Minimum Required Front, Side and Rear Yards. The minimum requirements for front, side and rear yards in the M-1 Light Industrial District are as follows:
      A.   Front – 40 feet.
      B.   Rear – 30 feet.
      C.   Side – 25 feet.
      D.   Street side, corner lot – 40 feet.
   6.   Maximum Height. The maximum height for structures in the M-1 Light Industrial District is 60 feet.
   7.   Permitted Signs. Permitted signs in the M-1 Light Industrial District are as follows:
      A.   Temporary sign advertising the sale or lease of the premises, not exceeding 12 square feet in area.
      B.   Trade, business or industry identification signs for firms located on the site provided that:
         (1)   Free-standing signs shall not exceed 150 square feet in area or 25 feet in height. Such a sign shall not be located closer than 10 feet to the right-of-way line.
         (2)   A directory sign or monument sign may be substituted in place of a free standing sign, subject to the requirements set forth above. A monument sign shall not be more than 10 feet in height and shall not be located closer than 10 feet to any property line.
         (3)   Signs mounted flush on the wall of a building shall not exceed 10 percent of the area of the wall of the building on which they are located or 200 square feet, whichever is smaller.
         (4)   Overhanging signs, attached to a building shall not project above the height of the building or more than four feet from the wall of the building and shall not have more than 100 square feet of area.
         (5)   Not more than one sign of each category above may be provided for any single use, although each sign may be a double faced or back to back sign.
      C.   All signs and billboards shall be maintained in a neat and presentable condition and in the event that they shall become illegible or their use shall cease they shall be promptly removed and the area occupied restored to a condition free from refuse and debris.
      D.   Any sign not conforming to these regulations shall be made to conform or moved to a conforming location or be removed.
   8.   Off-Street Parking and Loading. Spaces for off-street parking and loading shall be provided in accordance with the provisions of Section 166.21(14).
   9.   Site Plan Requirements. See Section 166.21(16).
   10.   Minimum Open Space. The total land area devoted to open space and landscaping shall not be less than 10 percent of the gross land area included in the building lot. Such open space shall be maintained as grassed and landscaped area and shall not include access drives, parking areas, structures or buildings; except ornamental structures included as part of the landscaping theme.
