166.07 through
166.20 regulations and restrictions of this Zoning Code shall apply as follows:
1. Regulations to Be Uniformly Applied. The regulations set by this Zoning Code shall apply uniformly to each class or kind of structure or land, and particularly within each district, except as hereinafter provided.
2. All Uses and Structures to Conform. No building, structure, or land shall hereafter be used or occupied and no building or structure or part thereof shall hereafter be erected, constructed, reconstructed, moved or structurally altered unless in conformity with all of the regulations herein specified for the district in which it is located.
3. Height, Density or Yards Shall Not Be Violated. No building or other structure shall hereafter be erected or altered to exceed the height, to accommodate or house a greater number of families or to have narrower or smaller rear yards, front yards, side yards or other open spaces than herein required or in any other manner contrary to the provisions of this Zoning Code.
4. Separate Yards, Open Spaces and Off-Street Parking Required. No part of a yard, or other open space, or off-street parking or loading space required about or in connection with any building for the purpose of complying with this Zoning Code shall be included as part of a yard, open space or off-street parking or loading space similarly required for any other building.
5. Minimum Yards and Lot Areas May Not be Reduced. No yard or lot existing at the time of passage of Ordinance No. 136 shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date of the zoning ordinance shall meet at least the minimum requirements established by these regulations.
6. New Areas Annexed to City. All territory that may hereafter be annexed to the City shall be zoned by the City Council as lying and being in the district most appropriate in accordance with the intent and provisions of this Zoning Code. Such zoning shall be in accordance with the procedures for amending the Zoning Map and shall occur concurrently with the annexation of such territory.
7. Parking. No parking space required by this Zoning Code in a residential district shall be provided in any required front yard, within the required side yard along the street side of a corner lot or within five (5) feet of an interior side or rear lot line, except as provided in this subsection. In an R-District, R-1b District or R-2 District, one required parking space may be provided in a required yard for each dwelling unit in a single-family or two-family dwelling. No merchandise, display or exterior storage shall be provided in any required front yard or in the first five feet inside the property line of any required side or rear yard in any C district.
8. Propane Tanks. All propane tanks installed within the incorporated City shall be located at least 25 feet from any building or structure which is used as a business or residence and shall comply with all structures setback requirements for lot lines. All installations and hookup for such propane tanks must pass inspection by the Zoning Administrator and Fire Chief. Standards adopted are those adopted by the State of Iowa for such installations and hookups.
9. Water and Sewage Requirements. In any district in which residences are permitted, except the A-1 District, and where neither public water supply nor public sanitary sewer is available, the minimum lot area and frontage requirements shall be as follows:
A. Lot area – 20,000 square feet; lot width at building line – 100 feet; provided, however, where a public water supply system is available, these requirements shall be 15,000 square feet, and 100 feet, respectively.
B. The above requirements shall not apply in subdivision developments, providing private common water supply and sewage collection and disposal systems, which have been approved by the Iowa Department of Natural Resources.
C. In all districts where a proposed building, structure or use will involve the use of private sewage facilities, and public sewer and/or water is not available, the lot size and sewage disposal system and domestic water supply shall comply with all of the requirements and standards of the Story County Board of Health.
10. Front Yard – Exceptions. In areas where some lots are developed with a front yard that is less than the minimum required for the district by this Zoning Code or where some lots have been developed with a front yard greater than required by this Zoning Code, the following rule shall apply. Any new building or addition in front thereof shall not be closer to the street right-of-way than the average of the front yard of the first building on each side within a distance of 200 feet measured from building to building, except as follows:
A. Buildings located entirely on the rear half of a lot shall not be counted.
B. No building shall be required to have a front yard greater than 50 feet.
C. If no building exists on one side of a lot within 200 feet of the lot in question, the minimum front yard shall be the same as the building on the other side.
11. Lots of Record. In any district where dwellings are permitted, a single-family dwelling may be located on any lot of record as of the effective date of the zoning ordinance irrespective of its area or width; provided however:
A. The sum of the side yard widths of any such lot or plot shall not be less than 20 percent of the width of the lot, but in no case less than ten percent of the width of the lot or five feet, whichever is greater, for any one side yard.
B. The depth of the rear yard of any such lot need not exceed 20 percent of the depth of the lot, but in no case less than 20 feet.
C. Where such a lot is a corner lot, the width on the longer street side of the corner lot shall not be less than 75 percent of the front yard required on the lot to the rear if there is a reverse frontage of the corner lot.
