ARTICLE 1

- AUTHORITY, PURPOSE AND JURISDICTION

Section 8-3001-1.- Authority and purpose.

Pursuant to the authority conferred by article IX, section II, paragraph IV of the 1982 Constitution of the State of Georgia and to guide development in accordance with existing and future needs; to protect, promote and improve public health, safety, morals, convenience, order, appearance, prosperity and the general welfare; to insure the adequate provision of light and air; to promote safety from fire and other dangers; to facilitate economical and adequate provision of public facilities such as transportation, water, sewerage, education, recreation, sanitation and other public requirements; with reasonable consideration of the character of each area and its suitability for particular uses, and with a view toward promoting desirable living conditions and sustained stability of living areas, protecting property against blight, conserving the value of land and buildings, securing economy in governmental expenditures, and encouraging the most appropriate use of land, buildings and structures, the Sylvania city council does ordain and enact into law the following regulations:

(a)

Dividing the city into districts and establishing the boundaries thereof;

(b)

Regulating the location, height, bulk and size of buildings and other structures;

(c)

Regulating the percentage of lot which may be covered;

(d)

Regulating the size of yards, courts and other open spaces;

(e)

Regulating the density and distribution of the population;

(f)

Regulating the uses and locations of buildings, structures and land for trade, industry, residence, recreation, agriculture, conservation, public activities, airports, water supply, sanitation, protection against floods;

(g)

Establishing a planning and design commission and defining the powers and duties thereof;

(h)

Regulating the design of structures within R-1, R-2, R-3, P-1, C-1 and C-2 zones;

(i)

Providing for the method of administration and amendment of these regulations;

(j)

Defining the powers and duties of the planning commission and board of adjustment with respect to these regulations;

(k)

Defining certain terms used herein; and

(1)

Providing penalties for violations of these regulations.

Section 8-3001-2. - Title.

This ordinance shall be known as and may be cited as the "Zoning Ordinance of the City of Sylvania, Georgia."

Section 8-3001-3. - Jurisdiction.

The provisions of this ordinance shall apply to all land, buildings and structures within the incorporated limits of the City of Sylvania, Georgia.

Section 8-3001-4. - Zoning map.

The location and boundaries of the zoning districts established by this ordinance are defined and shown on the map entitled "Official Zoning Map of Sylvania, Georgia," adopted June 15, 1980, as amended, and hereby made a specific part of this ordinance.
