ARTICLE 8

- COMMERCIAL DISTRICTS C-1, C-2

Section 8-3008-1.- General purpose.

These districts are established to provide appropriate areas for the development of commercial and service activities consistent with the existing character of commercial development. Commercial districts should have access from major traffic arteries, however, it is the intent of this ordinance to discourage the development of long, narrow strips of commercial development fronting on major arteries, often referred to as "strip commercial" areas. Such strip commercial development damages the traffic-carrying capacity of streets, increases congestion, is often incompatible with adjacent residential areas, and creates disproportionate costs in the provision of government services. Extension of commercial zoning requiring amendments to this ordinance should be made principally for the provision of planned, unified commercial areas, and not in such a way that strip commercial areas are encouraged. Extension of commercial zoning should only be made after careful consideration of compatibility with adjacent uses and whether or not other land is available which is already zoned for commercial use.

Section 8-3008-2. - General commercial district (C-1).

8-2.1. Purpose. This district is intended to be a general commercial zone to provide a wide variety of commercial and service facilities and serve a large market area but should be consistent with the established nature of the downtown business district.

8-2.2. Permitted uses. The following uses are permitted in C-1 districts subject to the provisions of article 14, section 8-3014-5:

(a)

Any use permitted in the PI district.

(b)

Branch bank or other financial institution.

(c)

Retail establishments, including the following:

(1)

Apparel.

(2)

Bakery.

(3)

Confectionery store.

(4)

Drive-in type retail business where customer is waited upon in an off-street parking area or where customer conducts business directly from a vehicle with an agent in the building.

(5)

Drugstore.

(6)

Dry goods or notions store.

(7)

Florist or gift shop.

(8)

Grocery, fruit or vegetable market.

(9)

Hardware or electric appliance store.

(10)

Jewelry store.

(11)

Meat market or delicatessen.

(12)

Music store.

(13)

Newsstand.

(14)

Retail filling station.

(15)

Shoe store and shoe repair shop.

(16)

Supermarket.

(17)

Variety store.

(d)

Personal service establishments including the following:

(1)

Barbershop or beauty parlor.

(2)

Photographer.

(3)

Tailor.

(4)

Dry cleaning and laundry establishment, excluding steam and power laundries, operated in conjunction with customer service counters and limited to the dry cleaning and laundering of articles delivered to the premises by individual customers; provided, however, that no materials may be used in any laundering or cleaning process which are explosive, inflammable, combustible or toxic in greater degree than perchloroethlylene or equivalent, and provided further, that no odor, fumes or other nuisance producing agents are expelled in such a way as to be detectable beyond the property lines of the property used for such a business.

(e)

Eating and drinking establishments.

(f)

Commercial recreational uses, such as theaters, but specifically excluding poolrooms, dancehalls and video game rooms.

(g)

Hotels and motels.

(h)

Service and repair establishments including automobile service stations and repair garages and automobile washing establishments; subject to the provisions of section 8-3013-14 but excluding junkyards.

(i)

Commercial parking facilities.

(j)

Accessory buildings and uses of structures customarily incidental to any permitted use, provided such structures are located in the rear yard and not less than five feet from any property line.

(k)

Cold storage and freezer locker facilities.

(l)

Retail or wholesale business outlets operated as part of a manufacturing establishment, provided that there is no open storage of junk or salvage materials of any type in conjunction with the operation, and provided that the outlet is incidental to the operation.

(m)

Private recreational facilities, provided that such facilities are incidental to a permitted use and located on the same premises subject to the provisions of section 8-3013-14.3.

(n)

Commercial group developments.

(o)

Veterinary clinics, provided that all animals shall be kept inside enclosed buildings.

(p)

Private and public schools offering business and vocational courses.

(q)

Any business which is similar in character or nature to the above-mentioned uses, upon written approval of the planning and design commission shall be permitted in a C-1 zone.

(r)

Signs, subject to the provisions in section 8-3013-13.

(s)

Special exceptions, as prescribed in section 8-3013-1.

Section 8-3008-3. - Highway oriented commercial district (C-2).

8-3.1. Purpose. This district is intended to be utilized by those commercial uses which serve community and regional shopping needs as well as the traveling public. These commercial uses occupy relatively large sites and require access to major thoroughfares. It is intended that this district be located at major road intersections.

8-3.2. Permitted uses. The following uses are permitted in C-2 districts subject to the provisions of article 14, section 8-3014-5:

(a)

Any use permitted in the C-1 district.

(b)

Commercial recreational uses, such as theaters, bowling alleys, pool rooms, miniature golf courses, driving ranges, video game rooms and the like, subject to the provisions of section 8-3013-14.3.

(c)

Radio and television stations.

(d)

Wholesaling, warehousing bulk storage, supply and distribution operations;

(e)

Truck and bus terminals, freight and passenger terminals.

(f)

Mobile home sales lots, new farm equipment sales lots, boat sales lots, other lots for the sale of large items which cannot reasonably be stored indoors, but excluding the display of scrap, salvage, or junk products.

(g)

Distributors of gasoline, fuel oil, agricultural chemicals and fertilizers, and liquefied petroleum gases.

(h)

Accessory buildings and uses of structures customarily incidental to any permitted use, provided such structures are located in the rear yard and not less than five feet from any property line.

(i)

Miniwarehouses.

(j)

Baking, confectionery, dressmaking, dyeing, laundry, printing, tailoring, upholstering and similar establishments, and businesses of a similar and no more objectionable character, subject to the following provisions: All goods or products manufactured or processed shall be sold on the premises. All such manufacturing and processing shall be done on the premises.

(k)

Any business which is similar in character or nature to the above-mentioned uses, upon written approval of the planning and design commission shall be permitted in a C-2 zone.

(l)

Signs, subject to the provisions in section 8-3013-13.

(m)

Special exceptions, as prescribed in section 8-3013-1.
