ARTICLE 4

- GENERAL PROVISIONS

Section 8-3004-1.- Use within districts and zones.

No building, structure or land shall be used or occupied, and no building or structure or part thereof shall be erected, constructed, reconstructed, moved or structurally altered unless in conformity with all of the regulations herein specified for the district in which it is located. Further, no building, structure or land shall be used for any purposes other than a purpose permitted by this ordinance in a zone in which such building, structure or land is located.

Section 8-3004-2. - Height, density and lot area.

No building or other structure shall be created or altered:

4-2.1. To exceed the height; or

4-2.2. To exceed the number of families; or

4-2.3. To reduce or diminish front yards, rear yards, side yards or other open spaces unless in conformity with all of the regulations herein specified for the district in which it is located.

Section 8-3004-3. - Yards applying to only one building.

No part of a yard, off-street parking or loading space, or other open space around a building or structure for the purpose of complying with the provisions of this ordinance shall be included as part of a yard, off-street parking or loading space, or other open space for any other building or structure.

Section 8-3004-4. - One principal building on lot.

Only one principal building and its customary accessory buildings may hereinafter be erected on any lot, except as otherwise provided by this ordinance. (See article 10 for exceptions permitting group development.)

Section 8-3004-5. - Public street frontage.

No principal building shall be erected on any lot which does not have immediate frontage on at least one public street or road for a distance of at least 25 feet.

Section 8-3004-6. - Nonconforming uses.

4-6.1. It is the intent of this section to respect established private property rights. The lawful use of any building, structure or land existing prior to the time of enactment of or subsequent amendment to this ordinance may be continued subject to the regulations contained in this section.

4-6.2. The nonconforming use of a building, structure or land shall not be changed to another nonconforming use.

4-6.3. Any nonconforming use of a building, structure or land which has been abandoned for a period of one year or more shall not be re-established.

4-6.4. Repairs and alterations to a nonconforming use:

(a)

May be made up to 75 percent of the fair market value of the building or structure as determined from the Screven County Tax Assessor's Office.

(b)

In the event of destruction by fire or by an act of God, shall be permitted to the full value of the building or structure.

(c)

Shall be permitted to the full value of an owner-occupied dwelling.

4-6.5. The nonconforming use of a building, structure or land shall not be extended or enlarged unless such addition is made to conform to the regulations of the zone in which it is located.
