- ESTABLISHMENT OF DISTRICTS
For the purposes of this ordinance, the areas shown on the "Official Zoning Map of the City of Sylvania, Georgia," are hereby divided into the following districts or zones:

The boundaries of the districts listed in section 8-3003-1 are hereby established as shown on the map which is entitled "Official Zoning Map of Sylvania, Georgia," adopted June 15, 1980, as amended. An official copy of the zoning map shall be kept on file in the office of the building inspector.
Where reasonable uncertainty exists with respect to the boundaries of any of the aforesaid districts as shown on the zoning map, the board of adjustment shall decide the location of said boundaries, and in so doing shall be guided by the following rules:
3-3.1. Where district boundaries are indicated as approximately following the centerlines of streams, railroads, streets or highways, or right-of-way lines, then such centerlines shall be construed to be such boundaries.
3-3.2. Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries.
3-3.3. Where district boundaries are so indicated that they are approximately parallel to the centerlines of streets, highways or railroads, or rights-of-way of same, such district boundaries shall be construed as being parallel thereto and such distance therefrom as indicated on the zoning map. If no distance is given, such dimension shall be determined by the use of the scale shown on said zoning map.
3-4.1. As is evidenced by the permitted uses in each district, higher uses shall be allowed in lower use districts based on the following hierarchy of uses:
Districts D, H, R-MH and FH shall stand alone and shall not be included in the above hierarchy of uses.
3-4.2. In the event a higher use (as defined in section 8-3003-4.1) is located in a zone or district permitting lower uses, the persons or entities owning or using the property on which such higher use is being employed shall not be entitled to any greater protection of the law, including nuisance laws, than would persons or entities employing a use specifically permitted within such zone or district. Provided further, it shall be the responsibility of the person or entity employing the higher use in the lower use zone to comply with the requirements of section 8-3013-14. The requirements of section 8-3013-14 shall not be required unless either [sic] the person employing the lower use requests that said section be complied with.
