ARTICLE 6

- RESIDENTIAL DISTRICTS R-1, R-2, R-3 and R-MH

Section 8-3006-1.- General purpose.

[The purposes of this article are] to establish residential districts and to protect property in the districts from the depreciating effects of incompatible land uses. Residential uses are intended to be the primary uses within each district. The residential districts are intended to preserve and protect the residential character of neighborhoods.

Section 8-3006-2. - Single-family residential district (R-1).

6-2.1. Purpose. To establish a low density, single-family residential district and to protect property in the district from the depreciating effects of incompatible land uses.

6-2.2. Permitted uses. The following uses are permitted in R-1 districts subject to the provisions of article 14, section 8-3014-5:

(a)

Single-family dwellings, excluding manufactured homes.

(b)

Industrial dwellings having a roof pitch of at least 5/12 (five inches of vertical rise for every 12 inches of roof), as determined appropriate by the planning and design commission under section 8-3014-1 et seq., and further subject to the design standards, as are all structures, as set forth in section 8-3014-1 et seq.

(c)

Accessory buildings and uses of structures customarily incidental to any permitted use, provided such structures are located in the rear yard and not less than five feet from any property line.

(d)

R-1 home occupations as defined by section 8-3002-2; customary home occupations.

(e)

Special exceptions, as prescribed in section 8-3013-1.

Section 8-3006-3. - Single-family residential (R-2).

6-3.1. Purpose. To establish a medium density residential district and to protect property in the district from the depreciating effects of incompatible land uses.

6-3.2. Permitted uses. The following uses are permitted in R-2 districts subject to the provisions of article 14, section 8-3014-5:

(a)

Any use permitted in [an] R-1 residential district.

(b)

Accessory buildings and uses of structures customarily incidental to any permitted use, provided such structures are located in the rear yard and not less than five feet from any property line.

(c)

Special exceptions, as prescribed in section 8-3013-1.

Section 8-3006-4. - Multifamily residential (R-3).

6-4.1. Purpose. To establish a medium to high density residential district and to protect property in the district from the depreciating effects of incompatible land uses.

6-4.2. Permitted uses. The following uses are permitted in R-3 districts subject to the provisions of article 14, section 8-3014-5:

(a)

Any use permitted in [an] R-2 residential district.

(b)

Two-family dwellings (duplexes).

(c)

Residential group developments including single-family, two-family and multifamily residences, such as apartment and condominium developments and manufactured home parks, subject to the provisions of section 8-3006-6.

(d)

Accessory buildings and uses of structures customarily incidental to any permitted use, provided such structures are located in the rear yard and not less than five feet from any property line.

(e)

Rest homes, convalescent homes and nursing homes, provided that no building in connection with such facility shall be closer than 50 feet from the lot line.

(f)

Central laundry or sanitation facilities accessory to a manufactured home park, apartment complex or other residential group development.

(g)

Special exceptions, as prescribed in section 8-3013-1.

Section 8-3006-5. - Manufactured home provisions, general.

6-5.1. Location and age. No manufactured home shall be placed within any zoning district in the city subsequent to the date of adoption of this ordinance other than a manufactured home district (MH), except for manufactured homes to be placed within the existing established mobile home park on Clifford Avenue that was developed under former Sylvania Code § 8-3011-5 (green code book). Furthermore, no manufactured home that is more than 20 years old prior to placement or installation within the city shall be placed, installed, permitted or located anywhere within the city.

6-5.2. Manufactured home tiedowns. Any manufactured home which is not anchored may blow over or off its blocks when the wind velocity reaches approximately 70 mph. Therefore, this section of this ordinance is intended to make certain that all manufactured homes hereafter placed within the city are equipped with tiedowns and anchored.

(a)

Tiedowns.

(1)

All manufactured homes placed in the incorporated areas of the City of Sylvania after the adoption of this ordinance shall have tiedowns with provisions for distributing the load of these tiedowns and provisions for the attachment to ground anchors so as to resist wind overturning and sliding.

(2)

Each shall be designed to resist an allowable working load equal to or exceeding 3,150 pounds and shall be capable of withstanding a 50 percent overload without failure.

(b)

Ground anchors. Ground anchors shall be installed at each manufactured home stand when a manufactured home is located thereon to permit tiedowns of manufactured homes comply with this section.

(1)

Each ground anchor shall be capable of resisting an allowable working load equal to or exceeding 3,150 pounds applied in the direction of the tiedown. In addition, each ground anchor shall be capable of withstanding a 50 percent overload without failure.

(2)

Ground anchors shall be resistant to weathering deterioration at least equivalent to that provided by a coating of the zinc on steel strapping of not less than 0.30 ounce per square foot of surface coated.

Section 8-3006-6. - Manufactured home parks (MH).

6-6.1. General. Manufactured home parks as so defined in these regulations must adhere to the following conditions:

(a)

The minimum area per park shall be five designated and described acres; the minimum width for [the] portions used for entrances and exits shall be 50 feet; and the minimum width for portions containing manufactured home spaces or stands shall be 50 feet.

(b)

The minimum number of spaces completed and ready for occupancy before the first occupancy is permitted shall be 15 spaces, and the minimum area for each manufactured home space or stand shall be 6,000 square feet. Each space shall contain a permanent manufactured home stand constructed of at least concrete on a suitable subgrade material to support the manufactured home.

(c)

No manufactured home space or stand shall be rented for residential use of a manufactured home in any such park except for periods of 30 days or more, and no manufactured home shall be admitted to any park unless it can be demonstrated that it meets the requirements of any additional laws and regulations of the governing authority.

(d)

In addition to meeting the above requirements, the manufactured home park site plan shall be accompanied by a certificate of approval from the area health department.

(e)

No manufactured home shall be located within:

(1)

Ten feet of its individual lot line.

(2)

Twenty-five feet from any exterior boundary of the manufactured home park.

(f)

A buffer strip at least 25 feet wide shall be located adjacent to each exterior property line of the manufactured home park and not be included within any individual trailer lot. Such a buffer shall include a solid fence not less than ten feet in height or of evergreen vegetation of sufficient density to accomplish the purposes of a solid fence, and shall be maintained in good order at all times.

(g)

Water, sewerage and electricity. All manufactured home stands shall be completed with underground water, sewer and electrical connections.

(h)

Street access. All manufactured home spaces shall be made accessible from an abutting street by a driveway having a width of not less than 12 feet.

(i)

Off-street parking facilities. Off-street parking facilities established in connection with manufactured home parks shall be either located on each manufactured home space or in integrated groupings, bays, clusters, etc., provided that no parking space shall be further than 50 feet from the mobile home space it is to serve.

6-6.2. Required improvements to manufactured home parks. In every manufactured home park the following street improvements and utilities shall be planned for and provided by the developer, by installation and/or payment prior to the approval of the manufactured home park;

(a)

All streets shall be named and marked with signs in accordance with city-approved names and shall include street grading and street paving.

(1)

Base and paving shall meet the requirements of the department of transportation for rural roads.

(2)

Manufactured home park street improvement widths shall be 20 feet unless a street serves 15 homes or less, then it may be 18 feet side.

(3)

Linear street grades. Maximum and minimum linear street grades shall be as follows:

i.

Collector streets; not more than 12 percent.

ii.

Subcollectors, lanes and parking spaces; not more than 15 percent.

iii.

No linear street grade shall be less than one-half of one percent.

(b)

Sanitary sewer lines, septic tanks or other sewerage disposal systems shall be in conformity with requirements of the county health department.

(c)

All utilities, except power lines and telephone lines, shall be installed underground in the shoulders of the road.

(d)

Storm drainage facilities:

(1)

A registered engineer must certify that the proposed storm drainage improvements indicated on the manufactured home park plan are adequate.

(2)

If a storm drainage sewer system exists in the City of Sylvania area, then the proposed manufactured home park must contain an underground storm drainage system which will be connected to the existing area system. Such system shall be indicated on the plan.

(3)

If a storm drainage sewer system does not exist in the City of Sylvania area, the adequate surface drainage facilities, as certified by an engineer, shall be included in the manufactured home park and so indicated on the plan.

(4)

Where a proposed manufactured home park is traversed by a watercourse, drainageway, channel or stream, there shall be provided a stormwater easement or drainage right-of-way along each side of the channel or course for the purpose of widening, deepening, relocating, improving or protecting such drainage easement.

(e)

All manufactured home subdivisions shall be required to meet all standards and provisions of the subdivision regulations, if any, adopted by the City of Sylvania. In the event of any inconsistency, the provisions of this ordinance shall control.

(f)

All manufactured home places erected or located in the City of Sylvania shall be required to meet the adopted building, heating, plumbing, electrical, fire, gas, mechanical, air conditioning and all other codes, if any, adopted by the City of Sylvania.

(g)

Penalties to single-family manufactured home owners. Failure by the owner of a manufactured home to obtain and utilize tiedowns and anchors for his manufactured home placed in the City of Sylvania after November 3, 1992.

6-6.3. Grandfather clause. This section 8-3006-6 on Manufactured home parks shall not apply to any manufactured home park or lot developed prior to November 3, 1992.
