CHAPTER 1258

University-College District, U-5

1258.01 INTENT.

   University-College Districts and their regulations are hereby established in order to achieve among others, the following purposes:
   (a)   To provide educational facilities in locations for the full development of a university or college campus in a spacious and well organized environment; and
   (b)   To protect the surrounding residential neighborhoods during the period of development and establish a stable relationship; and to provide a zoning classification and conditions for the proper functioning of university-college educational facilities in conformance with the objectives of the comprehensive plan of the City.

1258.02 USE REGULATIONS.

   Buildings and land shall be used and buildings shall be designed, erected, altered, moved or maintained in a University-College District only for the uses set forth in the following schedule:
   (a)   Main Buildings and Uses Permitted. Administrative offices, classrooms, auditoriums, commons, dormitories, assembly and dining facilities of universities, colleges and other institutions of higher learning.
   (b)   Similar Main Uses Permitted. Any other educational use not listed above and determined as "similar" by the recommendation of the Planning Commission and approval of Council.
   (c)   Accessory Buildings and Other Uses Permitted.
      (1)   Accessory uses as permitted in, and as regulated in the adjoining residential districts.
      (2)   Lunch rooms, book stores, lounges and social centers for students, faculty, officials and guests of the university or college and operated by or for the institution.
      (3)   Laundry, heating facilities.
      (4)   Recreation facilities, playgrounds, athletic fields and stadia or other spectator seating facility; gymnasium swimming pool.
      (5)   Parking garages and surface parking areas.

1258.03 PLANNING CRITERIA.

   (a)   Area Regulations. The area or parcel of land for a permitted university-college educational facility shall be not less than required to provide a site for the main and accessory buildings, parking and other accessory uses, yards and open spaces to accommodate the facility and to maintain the character of the neighborhood in accord with the following general criteria:
      (1)   The buildings shall not cover more than 20% of the total land area, provided however, that stadia or other such open seating facilities, as well as open parking structures, shall not be counted in computing the coverage.
      (2)   Surface parking areas, open parking structures and drives shall not exceed 25%.
      (3)   The remainder shall be landscaped, of which remainder not more than 50% may be used for outside recreational purposes.
   (b)   Yard Regulations.
      (1)   Front yards. The setback for buildings shall be not less than established for the street on which the development is to be located as shown on the Zone Map. Open parking structures (as defined in Section 1240.06) shall be limited to three levels or a maximum of 35 feet in height, not including stairtowers or penthouses or limited architectural features which combined shall not exceed ten feet above such 35 feet and which additional height shall be subject to the approval of Council, must be set back not less than 25 feet from the property line. All parking structures greater in height shall be set back as required for buildings as regulated pursuant to Section 1258.04. Surface parking areas and drives, excluding entrances and exits, must be set back not less than 25 feet from the property line, and landscaping sufficient to effectively screen the parked automobiles from view must be provided and may be included in the setback.
      (2)   Side and rear yards. Side and rear yards of the property in the University-College District shall be not less than the following from an adjoining residential district:

      (3)   Illumination. Flood lighting and illumination shall be located and designed so as to shield the light source from every adjoining residential district.
      (4)   Driveways and parking areas for any of the above uses, shall be located not less than 26 feet from an adjoining residential district line.
      (5)   Height regulations. The main institutional buildings and their components, such as penthouses, water tanks and other mechanical appurtenances located upon or constituted as an integral part of such building may be built to a height not to exceed 60 feet.
      (6)   Architectural features. Chimneys, spires, cupolas, towers, flagpoles, radio or television antennae, monuments and similar architectural features when erected as an integral part of a building shall conform to and be permitted as provided by Section 1280.02.

1258.04 PARKING REQUIREMENTS.

   Parking shall be provided on off-street lots to total the sum of the following applied formula:
   (a)   The total number of students, full-time and part-time, divided by four students per parking space, plus
   (b)   The total number of faculty, staff and graduate assistants multiplied by a 90% attendance factor divided by 1.25 persons per parking space.

1258.05 APPLICATION TO PLANNING COMMISSION.

   Preliminary development plans of all proposed educational and institutional buildings and land improvements shall be submitted along with maps, surveys, landscaping plans and other required information to the Planning Commission for review, report and recommendation to Council. General criteria for reviewing a development plan for such facility shall be:
   (a)   The proposed building or use shall be in conformance with the provisions of this chapter, and other applicable sections of the Code, the objectives of the duly adopted or accepted comprehensive zoning plan and Community Facilities Plan of the City; and
   (b)   The proposed building or use is properly located in relation to the duly adopted or accepted Street Plan so as to generate a minimum of traffic on local streets; and
   (c)   The location, design and operation of such building or use will not adversely affect the surrounding residential neighborhoods; and
   (d)   Adequate sewers and drainage is present, available or provided for.

1258.06 APPLICATION APPROVAL.

   Within 30 days after receipt of report and recommendation of the Planning Commission, Council shall either approve, disapprove or modify the preliminary plan. After approval of the preliminary plan, final plans shall be prepared, filed with the Building Commissioner and submitted to Council for final decision which Council shall render within 30 days after receipt of such final plans. A building permit shall not be issued until such plans are approved by Council. In addition to the above requirements, appropriate safeguards and conditions applying to the particular situation may also be specified in the approval and permit.
