CHAPTER 1272

Off-Street Parking and Loading

1272.01 COMPLIANCE REQUIRED.

   The following regulations shall apply to all districts, subject, however, to such of the regulations of Chapters 1244, 1276 and 1280 as are pertinent to this chapter.
   (a)   No building shall be erected and no existing building shall be moved onto another lot unless the requirements herein for off-street parking and off street loading spaces are fulfilled. No existing building shall be altered or added to and no change shall be made in the use of a building or premises that will increase the number of parking spaces needed for the occupants, employees, patrons, client or guests thereof, or that will increase the volume of loading operations, unless the required number of off-street parking and loading spaces for such increased need and at least one-fourth of any existing deficiency in such spaces are provided.
   (b)   Any required parking spaces for a building or use that are provided on adjacent land, where such arrangement is permitted under this Zoning Code, shall be allocated to the exclusive use of such building or premises during its normal hours of activity or operation and the right to such exclusive use shall be officially recorded as a limitation upon such adjacent land, such limitation to continue in effect as long as the requirement under this Zoning Code exists.

1272.02 OFF-STREET CAR PARKING.

   (a)   Except as otherwise provided in Section 1272.03, not less than one off-street car parking space shall be provided on the same premises for:
      (1)   Each dwelling unit on a lot;
         Each two roomers or boarders in one-family, two-family or multi-family dwellings;
         Each three roomers or boarders in rooming and boarding houses;
         Each two staff members of a school.
      (2)   Each two beds of a hospital that is a bed establishment and each 200 square feet of gross floor area of other hospitals and of medical clinics, unless such other hospital or medical clinic is located in a Local Retail District, then for each 400 square feet of gross floor area;
         Each eight members of clubs and lodges.
      (3)   Each three sleeping rooms in a hotel.
      (4)   Each five seats in a theater, auditorium, stadium, main worship hall of a church when opened to its maximum capacity, and other place of public assembly not otherwise specifically provided herein.

      (5)   Each 100 square feet of gross floor area in a restaurant or tavern.
   Each 200 square feet of gross floor area of a retail establishment, or of a general public banking floor of a bank, provided, however, that where basement storage space is not available, upon application to the Board of Zoning Appeals, the Board may deduct or credit area, not to exceed 20% for the floor space found by the Board necessarily required for storage or packaging of merchandise.

      (6)   Each 200 square feet of gross floor area of an office building in a Local Retail District or Shopping Center District.

   (b)   With respect to any other use than enumerated above, the Planning Commission shall determine the amount of parking space and access space thereto that is required, and such determination shall be deemed required space for this purpose which shall not be encroached upon or reduced, except in accordance with a revised plan approved by the Planning Commission with respect to adequacy in accordance with the conditions then prevailing.

1272.03 PARKING RESTRICTED TO HOURS OF OPERATION.

   (a)   With respect to uses permitted in Chapters 1260, 1262 and 1264, required off-street parking shall be provided as required by this chapter, but in no event shall land in District U-6, Office Building District, District U-7, Local Retail District, or U-8, Shopping Center District, be used for the purpose of parking a motor vehicle except during the hours and on the days in which the business usage permitted in such district is taking place and in which the premises with which the required parking is associated is actually open for business or in operation.
   (b)   This section shall not apply to motor vehicles owned or leased by the owner of the business, any officer or employee thereof, or any member of an officer's or employee's family.

1272.04 CONDITION OF OFF-STREET PARKING AREAS AND PARKING STRUCTURES.

   (a)   "Parking areas" as used herein shall include parking lots and/or open parking structures.
   (b)   Open parking structures (as defined in Section 1240.06) shall be limited to three levels or a maximum of 35 feet in height, not including stairtowers or penthouses or limited architectural features which combined shall not exceed ten feet above such 35 feet and which additional height shall be subject to the approval of Council. All parking structures shall be set back as required for buildings, except as otherwise provided by ordinance or permitted by Council after consideration by the Planning Commission.
   (c)   Open parking structures shall be permitted only in the following districts: University-College District U-5 (Chapter 1258), Office Building District U-6 (Chapter 1260), Local Retail District U-7 (Chapter 1262), Shopping Center District U-8 (Chapter 1264), and Mixed Use District U-9 (Chapter 1270), provided that all other criteria and limitations are met.

   (d)   Any required off-street car parking area other than for dwellings and any parking lot permitted under this Zoning Code shall comply with the following conditions: the driveways and parking spaces are smoothly graded, paved with asphalt or concrete surface and adequately drained; surface waters are not permitted to discharge over or onto public sidewalks or roadways or onto other premises; lighting is reflected away from adjacent residence areas and so arranged as to cause no annoying glare. Parking lots in business districts shall be lighted whenever open for business.
   (e)   Wherever a parking lot or driveway thereto adjoins a residential district, such parking lot or driveways thereto shall be separated from the residence district by a solid masonry wall, or by other effective sightly screening as approved by the Planning Commission. The height of such wall shall be determined by the Planning Commission.
   (f)   On any street frontage there shall be not over one access driveway per 150 feet of such street frontage, such access driveway not to exceed 24 feet in width at the sidewalk, and the remainder of such frontage shall be so protected by a curb or barrier, subject to the approval of the City Engineer, that vehicles cannot enter or leave the lot except at such access driveway. However, the Planning Commission may vary the distance between driveways and vary the widths thereof where it determines that same cannot reasonably be complied with and the variance does not adversely affect the character and value of surrounding property.

1272.05 OFF-STREET LOADING REQUIREMENTS.

   Every nonresidential establishment which requires the loading or unloading of goods, supplies or materials in its daily operation shall provide not less than one off-street loading space for every 6,000 square feet of gross floor area or major portion thereof, so located as to avoid backing vehicles into or out of public streets in order to serve the premises.

1272.06 OCCUPANCY OF SPECIAL CHARACTER.

   In case a proposed occupancy is of such special character that it does not require the amount of parking space or loading space herein specified, and such lesser or reduced need is clearly demonstrated to the satisfaction of the Board of Zoning Appeals, the Board may approve a lesser number of parking or loading spaces, but in so doing the Board shall take into full consideration the probabilities of future changes in occupancy and the parking and loading needs thereof, and how such needs will be met.

1272.07 OVERNIGHT PARKING.

   Overnight parking of any motor vehicle or trailer between 2:00 a.m. and 5:00 a.m. in residential districts is prohibited unless inside of garages or to the rear of the front setback line on approved driveway surfaces, provided however, that where the garage is attached at the front setback line parking is permitted on the driveway between the sidewalk and abutting the front setback line.
