CHAPTER 1252

Two-Family Residence District, U-2

1252.01 GENERAL PROVISIONS.

   The following regulations shall apply to Two-Family Districts, subject, however, to such of the provisions of Chapters 1244, 1272, 1276 and 1280 as are pertinent to this chapter.

1252.02 PERMITTED USES.

   Permitted uses in Two-Family Residence Districts are:
   (a)   All uses permitted in One-Family Residence Districts and as regulated in such Districts, except as modified hereinafter.
   (b)   Two-family dwellings.

   (c)   Planned multi-family residential areas when contiguous to U-4, U-6, U-7, U-8, or U-9 Districts, subject to the standards and criteria of Section 1280.07.
   (d)   Planned one-family residential areas, subject to the standards and criteria of Section 1280.08.

1252.03 HEIGHT REGULATIONS.

   The height regulations in Two-Family Residence Districts are the same as in One Family Residence Districts. (Section 1250.03).

1252.04 LOT AREA AND WIDTH.

   (a)   Minimum lot area shall be provided as follows: for one-family dwellings, 6,000 square feet per dwelling unit, and for two-family dwellings, 4,000 square feet per dwelling unit; for planned residential areas (Section 1280.07), an average of 4,000 square feet per dwelling unit, and for three-family and four-family dwellings, 3,000 square feet per dwelling unit, and all dwelling units in accessory buildings shall be counted.
   (b)   Except in planned residential areas, each one-family dwelling shall have a lot not less than fifty feet in width, each two-family dwelling shall have a lot not less than 60 feet in width and each multi-family dwelling shall have a lot not less than 70 feet in width.
   (c)   Notwithstanding the preceding provisions of this section, any lot or parcel owned and held as a separate lot or parcel, and not as a part of any adjoining lot or parcel, on the same street prior to March 17, 1952, and not less than 5,000 square feet in area nor less than forty feet in width may be used for a two-family dwelling and, if smaller in lot area and lot width, may be used for a one-family dwelling.

1252.05 YARD REGULATIONS.

   (a)   Front Yards. Each lot shall have a front yard not less in depth than the setback building line established for it or as may be shown on the Building Zone Map.
   (b)   Side Yards.
      (1)   Each one-family and each two-family dwelling shall have two side yards of a combined width not less than one-fifth the average width of the lot, but in no event less than 12 feet; the narrower of the two side yards shall have at least 25% of this combined width.
      (2)   Each apartment building and each nonresidential building shall have a side yard on each side not less than ten feet or less than one-half the height of the building.

   (c)   Rear Yards.
      (1)   Each lot shall have a rear yard not less in depth than 25 feet nor less than the height of the main building.
      (2)   A garage not over 15 feet in height may occupy up to 35 % of the rear yard, providing that the area of such garage, together with all other structures located on the same parcel of land, shall not exceed the maximum percentage of lot area that may be built upon in accordance with Section 1252.06. Garage occupancy for multi-family residences and apartments, if permitted, shall be the same as those required in Multi-Family Residence Districts.

1252.06 MAXIMUM LOT AREA USE.

   (a)   The maximum area of any lot that may be built upon shall be limited to 25% of the total lot area for lots having an area of less than 8,000 square feet, upon which two-family homes are permitted, but the maximum permitted building area on such lots shall not be less than 1,750 square feet. Lots with an area of 8,000 square feet or more shall be limited to a building area of 20% of the total lot area, but not less than 2,000 square feet. In calculating the building to land ratio, unenclosed decks shall not be included, except to the extent that such unenclosed decks exceed 300 square feet.
   (b)   The lot area built upon shall be computed by totaling the square foot area occupied by all structures upon the lot, including, but not limited to, main buildings, garages, tool houses, summer houses, porches, breezeways, enclosed patios and terraces, steps, platforms and walls, but shall not include driveways, walks and steps, open patios or terraces not more than one foot above ground level, permanent swimming pools not above ground level, collapsible swimming pools, fish ponds not above ground level, swings, sand boxes, slides, teeter boards or fences.
