CHAPTER 1264

Shopping Center District, U-8

1264.01 DEFINITION; TRAFFIC SAFETY.

   (a)   For the purpose of this Zoning Code, a "Shopping Center District" means a business district containing a variety of stores, offices and business establishments to serve the general business needs of the community, and which may consist in whole or in part of a grouping of stores planned for operation as a unified area and built according to such plan.
   (b)   In order to insure traffic safety through adequate provision for off-street parking and off-street loading and through arrangement for safe traffic movement into, within and out of car parking areas, and to insure conservation of property values and neighborhood character of adjoining residential areas through provision of adequate open space and of suitable barriers and planting along boundaries of residential districts, no building permit or occupancy permit shall be issued by the Building Commissioner until the site plan is approved by the City Planning Commission with respect to traffic safety and the residential area considerations herein described. The approval of the City Planning Commission shall be based upon compliance with the standards contained in this Zoning Code and with supplementary standards which the Planning Commission shall adopt from time to time.
   (c)   The following regulations shall apply to Shopping Center Districts, subject, however, to such of the provisions of Chapter 1244 and Chapters 1272, 1274, 1276 and 1280, as are pertinent to this chapter.

1264.02 PERMITTED USES.

   Permitted uses in Shopping Center Districts are:
   (a)   Business uses permitted in Local Retail Districts as regulated under Sections 1262.02(b)(c) and 1280.08.
   (b)   (1)   Department stores; furniture stores, hardware, paint and wallpaper stores.
      (2)   Dry cleaning shops in which nonexplosive and nonflammable solvents are used, and in which no cleaning work is done for other shops, outlets or receiving stations. Laundries in which no cleaning work is done for other shops, outlets or receiving stations. Both uses may include coin-operated automatic establishments m accordance with State and City regulations.
      (3)   Restaurants and other eating places, but such places that sell alcoholic beverages for consumption on the premises where sold shall comply with Section 1280.08.
      (4)   Hotels, telephone exchanges, transformer stations.
      (5)   Job printing employing not more than five persons.
      (6)   Theaters, bowling alleys, assembly halls.
      (7)   The following uses, provided the location is approved by the City Planning Commission with respect to effect on traffic safety on values and uses of adjacent property; automobile salesrooms, automobile repair shops.
      (8)   Any other building, use or service similar to the uses herein listed in type of services or goods sold, in the number of persons employed, in the number of persons and number and type of vehicles attracted to the premises, and in the effect upon conforming uses of property in adjacent more restricted districts. Poultry killing shall not be considered a similar use.

   (c)   Signs shall be prohibited unless in conformity with Chapter 1270 and any other applicable provisions of the Codified Ordinances.

   In any Shopping Center District a sign may be provided on the front or back of the shopping center building in addition to other allowed signs, advertising the presence of a business located in the shopping center which does not have an entrance directly from the facing of the shopping center on which the sign authorized by this section is located, but whose entrance is instead accessible only from an arcade running through the shopping center or accessible only by use of such arcade, such entrance fronting on the opposite side of the shopping center. Such sign shall be a maximum of five feet wide and two feet high and may not be illuminated except by a flood light limited to the sign area. In the event that there is more than one such business in any shopping center, all such signs shall be of uniform design and shall be placed together on the building in as nearly symmetrical arrangement as possible.

1264.03 HEIGHT REGULATIONS.

   Buildings and structures may be built to a maximum height of three stories or 40 feet.

1264.04 LOT AREA REGULATIONS.

   Any building containing a dwelling unit shall have a lot not less in area than 4,000 square feet per dwelling unit.

1264.05 YARD REGULATIONS.

   (a)   Front Yards. Each lot shall have a front yard not less in depth than the setback building line shown on the Building Zone Map.
   (b)   Side Yards. Any building on a lot which adjoins a dwelling in a residence district or a vacant lot in a residence district shall have a side yard on that adjoining side not less than ten feet in width.
   (c)   Rear Yards. Each building that contains any dwelling unit shall have a rear yard not less than 25 feet in depth; any other building whose lot adjoins a residence district at its side lot line or rear lot line shall have a rear yard not less than 20 feet in depth.

1264.06 FIRE LANES.

   (a)   Establishment. In order to facilitate the operation of the Division of Fire of the Department of Public Safety, and in order to make effective the work of such Division during fires, at least 20 feet in the rear of any lot located in a Shopping Center District shall remain clear and unobstructed by any accessory buildings or structures whatsoever, and no such building, structure or other obstacle shall be erected, placed or left, or permitted to be erected, placed or left in the 20-foot fire lane herein established, or in any fire lane fixed and established by Council through ordinance duly and regularly passed.
   (b)   Exceptions to Fire Lane Regulations. The provisions prescribing the minimum distance at which buildings or structures shall be located from any lot line or any provisions relating to open fire lanes do not apply when Section 1262.06 and this section are or can be complied with by or with the use of adjoining property, and when such property affords the widths and areas as prescribed by such sections and is available for the purposes intended, and when such adjoining property is owned and permanently dedicated to such use by the owners of the buildings or structures that such adjoining property becomes an accessory to, so as to preclude the erection of any building or structure or part thereof on the widths and areas so used, during the existence of the building or structure.
